Mustadrak al-Hakim — Hadith 7996

حدثنا أحمد بن كامل، حدثنا أحمد بن عُبيد الله بن إدريس، حدثنا يزيد بن هارون، أخبرنا هشام بن حسّان، عن محمد بن سِيرِين، عن عِمران بن حُصَين قال: قال رسول الله ﷺ: "مَن حَلَفَ على يمينٍ مصبورةٍ كاذبةٍ، فليتبوَّأ بوجهِه مَقعَدَه من النار" (4).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه بهذا اللفظ.

It is narrated from Sayyiduna Imran bin Husayn (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever deliberately swears a false oath (in court) to usurp someone's right, let him take his seat in Hell."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it with these words.

Grading: Its chain is sahih.
وأخرجه أحمد 33/ (19912) و (19967)، وأبو داود (3242) من طريق يزيد بن هارون، بهذا الإسناد.
Reference / Source: Imam Ahmad (33/ 19912 and 19967) and Imam Abu Dawud (3242) narrated it by the route of Yazid bin Harun with this same chain.
قوله: "مصبورة"، أي: أُلزِمَ بها وحُبسَ عليها، وكانت لازمةً لصاحبها من جهة الحُكم، وقيل لها: مصبورة - وإن كان صاحبها في الحقيقة هو المصبور - لأنه إنما صُبر من أجلها، أي: حُبس، فوُصفت بالصبر، وأضيفت إليه مجازًا. قاله ابن الأثير في "النهاية".
Note / Clarification: In the hadith, "masburah" (an oath) means one to which a person is bound or held (by the ruling of the Shari'ah). In reality it is the person swearing the oath who is "masbur" (held back or compelled), but since he was held back because of this oath, the oath itself is figuratively called "masburah". This explanation was given by Ibn al-Athir in "al-Nihayah".
