Mustadrak al-Hakim — Hadith 7425

حدثنا أبو العباس محمد بن يعقوب، حدثنا محمد بن عبد الله بن عبد الحَكَم، حدثنا أبي وشعيب بن الليث قالا: حدثنا الليث، عن يزيد بن أبي حَبيب، أنَّ خالد بن كَثير الهَمْداني حدثه، أنَّ السَّرِيَّ بن إسماعيل الكوفي حدثه، أنَّ الشَّعبي حدثه، أنه سمع النُّعمان بن بَشير يقول: قال رسول الله ﷺ: "إنَّ من الحِنطة خمرًا، ومن الشَّعير خمرًا، ومن الزّبيب خمرًا، ومن التَّمر خمرًا، ومن العَسَل خمرًا، وأنا أنهاكم عن كلِّ مُسكِرٍ" (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه. آخر كتاب الأشربة [كتاب البر والصلة]

It is narrated from Sayyiduna al-Nu'man bin Bashir (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Indeed, wine is made from wheat, wine is made from barley, wine is made from raisins, wine is made from dates, and wine is made from honey; and I forbid you every intoxicant."
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) النهي عن كل مسكر مرفوعًا صحيح لغيره، وبقية الخبر صحَّ من قول عمر موقوفًا عليه، وهذا إسناد اختلف فيه على عامر الشعبي، فرواه جمع من الضعفاء والمتروكين عنه عن النعمان بن بشير، وخالفهم جمعٌ من رجال الصحيح، فرووه عن الشعبي عن ابن عمر عن عمر موقوفًا كما سيأتي، قال الترمذي وهذا أصح. وفي إسناد المصنف هذا السّري بن إسماعيل متروك، وبه أعلَّه الذهبي في "تلخيصه".
Grading: The prohibition of every intoxicant, as marfu', is "sahih li-ghayrihi", while the rest of the report is authentic as the saying of 'Umar (may Allah be pleased with him), "mawquf" on him.
Technical note / Defect ('illah): There is disagreement over this chain from 'Amir al-Sha'bi; a group of weak and matruk (abandoned) narrators narrated it from al-Sha'bi from al-Nu'man bin Bashir, whereas a group of the narrators of the Sahih contradicted them and narrated it as "al-Sha'bi from Ibn 'Umar from 'Umar", mawquf, as will come; Imam al-Tirmidhi said that this (its being mawquf) is more correct. In this chain of the author (al-Hakim) there is "al-Sari bin Isma'il", who is a matruk narrator, and on this basis Imam al-Dhahabi declared it defective.
وأخرجه أحمد 30/ (18407) عن يونس بن محمد وابن ماجه (3379) عن محمد بن رُمح، كلاهما عن الليث بن سعد، بهذا الإسناد.
Reference / Source: Imam Ahmad recorded it 30/ (18407) from Yunus bin Muhammad, and Ibn Majah (3379) from Muhammad bin Rumh; both of them from al-Layth bin Sa'd, with this chain.
وأخرجه أحمد (18350)، وأبو داود (3676)، والترمذي (1872) و (1873)، والنسائي (6756) من طريق إبراهيم بن المهاجر، عن الشعبي، به. وإبراهيم بن المهاجر ليِّن.
Reference / Source: Imam Ahmad recorded it (18350), Abu Dawud (3676), al-Tirmidhi (1872, 1873) and al-Nasa'i (6756) by way of Ibrahim bin al-Muhajir, from al-Sha'bi.
Technical note / Defect ('illah): Ibrahim bin al-Muhajir is "layyin" (soft, i.e. somewhat weak).
وأخرجه أبو داود (3677)، وابن حبان (5398) من طريق أبي حريز عبد الله بن حسين الأزدي عن الشعبي، به. وأبو حريز ليِّن.
Reference / Source: Imam Abu Dawud recorded it (3677) and Ibn Hibban (5398) by way of Abu Hariz 'Abdullah bin Husayn al-Azdi, from al-Sha'bi.
Technical note / Defect ('illah): Abu Hariz is also "layyin" (weak).
وأخرجه الطبراني في "الأوسط" (1103)، والدارقطني (4646) من طريق السيد بن عيسى، عن مجالد بن سعيد عن الشعبي به. وقال الطبراني: لم يرو هذا الحديث عن مجالد إلَّا السيد. قلنا: السيد بن عيسى ومجالد ضعيفان.
Reference / Source: Imam al-Tabarani recorded this narration in "al-Mu'jam al-Awsat" (1103) and Imam al-Daraqutni in his "Sunan" (4646) by way of al-Sayyid bin 'Isa, from Mujalid bin Sa'id, from 'Amir bin Sharahil al-Sha'bi.
Technical note / Defect ('illah): Imam al-Tabarani said that no one narrated this hadith from Mujalid except al-Sayyid bin 'Isa.
Grading: We say: this chain is weak, because al-Sayyid bin 'Isa and Mujalid bin Sa'id al-Hamdani are both weak narrators.
وأخرجه البزار (3253)، والدارقطني (4647) من طريق سلمة بن كهيل، عن الشعبي، به. وإسناده تالف لا يفرح به.
Reference / Source: Imam al-Bazzar recorded it in his "Musnad" (3253) and Imam al-Daraqutni (4647) by way of Salamah bin Kuhayl, from al-Sha'bi.
Grading: This chain is "talif" (ruined, extremely weak), and nothing is to be gained by it.
وأما حديث الشعبي عن ابن عمر عن عمر موقوفًا، فقد أخرجه البخاري (5581)، ومسلم (3032)، والترمذي (1874)، والنسائي (5068) و (5069) و (6751) و (6752) من طريق أبي حيان يحيى بن سعيد التيمي، والبخاري (5589)، والنسائي (6753) من طريق عبد الله بن أبي السفر، و (6754) من طريق محمد بن قيس الأسدي، ثلاثتهم عن الشعبي به.
Important point: As for the narration of al-Sha'bi from 'Abdullah bin 'Umar from 'Umar al-Faruq (may Allah be pleased with him) as "mawquf", it has been recorded by several imams.
Reference / Source: Al-Bukhari (5581), Muslim (3032), al-Tirmidhi (1874) and al-Nasa'i (5068), (5069), (6751) and (6752) recorded it by way of Abu Hayyan Yahya bin Sa'id al-Taymi; and al-Bukhari (5589) and al-Nasa'i (6753) by way of 'Abdullah bin Abi al-Safar; and al-Nasa'i (6754) by way of Muhammad bin Qays al-Asadi. All three of them (Abu Hayyan, 'Abdullah and Muhammad bin Qays) narrate it from al-Sha'bi.
ورواه أبو حصين - وهو عثمان بن عاصم الأسدي - عن الشعبي عن ابن عمر، لم يجاوزه عند النسائي (5070) و (6755).
Details of the narration: Abu Husayn ('Uthman bin 'Asim al-Asadi) also narrated it from al-Sha'bi, from Ibn 'Umar (may Allah be pleased with him).
Reference / Source: In al-Nasa'i (5070) and (6755) this narration stops at Ibn 'Umar and does not go beyond him (i.e. 'Umar is not mentioned in it).
وأخرج البخاري (4616) من طريق نافع عن ابن عمر قال: نزل تحريم الخمر، وإنَّ في المدينة يومئذ لخمسة أشربة ما فيها شراب العنب.
Reference / Source: Imam al-Bukhari (4616) recorded by way of Nafi' from Ibn 'Umar (may Allah be pleased with him) that he said: When the prohibition of wine was revealed, there were at that time in Madinah five kinds of drinks, among which there was no grape wine.
وأخرجه أحمد 10 / (5992) من طريق ابن لهيعة، عن أبي النَّضر، عن سالم، عن ابن عمر مرفوعًا.
Reference / Source: Imam Ahmad recorded it 10/ (5992) by way of 'Abdullah bin Lahi'ah, from Abu al-Nadr, from Salim bin 'Abdullah bin 'Umar, from his father (Ibn 'Umar), as "marfu'" (as a saying of the Prophet (peace and blessings be upon him)).
وابن لهيعة ضعيف، فكيف إذا خالف الثقات؟!
Technical note / Defect ('illah): 'Abdullah bin Lahi'ah is a weak narrator, so how can his narration be accepted when he contradicts the trustworthy narrators?! (i.e. the other trustworthy narrators reported it as mawquf).
وروي هذا القول أيضًا من قول أنس بسند صحيح فيما أخرجه أحمد 19 / (12099).
Corroborating chains and supporting reports: This same saying is also narrated from Anas (may Allah be pleased with him) with an authentic chain, recorded by Imam Ahmad 19/ (12099).
وفي الباب عن أبي هريرة مرفوعًا: "الخمر من هاتين الشجرتين النخلة والعنبة". عند أحمد 13/ (7753)، ومسلم (1985).
General principle: On this topic there is also a marfu' narration from Abu Hurayrah (may Allah be pleased with him): "Wine comes from these two trees: the date-palm and the grapevine."
