(1) إسناده حسن في المتابعات والشواهد مريم بنت طارق لا تعرف، وقد توبعت، ووالد أبي حيان التيمي - واسم أبي حيان يحيى بن سعيد بن حيان - لم يرو عنه غير ولده، ووثقه العجلي وابن حبان. وقوله: "كل مسكر حرام" قد صحَّ من غير وجه عن عائشة مرفوعًا.
Grading: On the basis of corroborating chains and supporting reports this chain is "hasan".
Technical note / Defect ('illah): Maryam bint Tariq is not known, but she has been corroborated; and no one narrated from the father of Abu Hayyan al-Taymi (whose name is Yahya bin Sa'id bin Hayyan) except his son, though al-'Ijli and Ibn Hibban declared him trustworthy.
Important point: His (peace and blessings be upon him) saying "Every intoxicant is unlawful" is authentically established as marfu' from 'A'ishah (may Allah be pleased with her) through several other routes.
وأخرجه مسدد في "مسنده" كما في "إتحاف الخيرة" (3776)، وابن سعد في "الطبقات" 10/ 451، وابن أبي شيبة 8/ 105، وإسحاق بن راهويه في "مسنده" (1660)، وأبو الفضل الزهري في "حديثه" (56) و (57) من طرق عن أبي حيان التيمي، بهذا الإسناد. وعندهم جميعًا موقوف على عائشة.
Reference / Source: Imam Musaddad recorded it in his "Musnad" (as in "Ithaf al-Khiyarah" 3776), Ibn Sa'd in "al-Tabaqat" 10/ 451, Ibn Abi Shaybah 8/ 105, Ishaq bin Rahawayh in his "Musnad" (1660) and Abu al-Fadl al-Zuhri in his "Hadith" (56, 57), through various routes from Abu Hayyan al-Taymi, with this chain; and with all of them it is "mawquf" on 'A'ishah (may Allah be pleased with her) (her own saying).
وأخرج النسائي (5171) من طريق علي بن المبارك، عن كريمة بنت همام، سمعت عائشة تقول: نُهيتم عن الدُّباء، نُهيتم عن الحنتم، نُهيتم عن المزفَّت، ثم أقبلت على النساء، فقالت: إياكن والجرَّ الأخضر، وإن أسكركنَّ ماء حُبِّكُنَّ، فلا تشرَبْنَه. وهذا إسناد حسن في المتابعات والشواهد.
Reference / Source: Imam al-Nasa'i recorded (5171) by way of 'Ali bin al-Mubarak, from Karimah bint Hammam, who said she heard 'A'ishah (may Allah be pleased with her) say: "You have been forbidden the gourd vessel (dubba'), you have been forbidden the green earthen jars (hantam), you have been forbidden the pitch-coated vessel (muzaffat)." Then she turned to the women and said: "Beware of the green earthen jars, and if the water of your water-jars intoxicates you, then do not drink it."
Grading: This chain is "hasan" in corroborating chains and supporting reports.
وأما تحريم كل ما أسكر، فقد صح عن عائشة مرفوعا من غير وجه عنها، فقد أخرج أحمد 40/ (24082)، والبخاري (242)، ومسلم (2001)، وأبو داود (3682)، وابن ماجه (3386)، والترمذي (1863)، والنسائي (5081)، وابن حبان (5345) من طريق أبي سلمة، وأحمد 41/ (24992)، وأبو داود (3687)، والترمذي (1866)، والنسائي (5080)، وابن حبان (5383) من طريق القاسم بن محمد والنسائي (5172) من طريق أم أبان بن صعصعة، ثلاثتهم عن عائشة.
Grading: As for the prohibition of every intoxicant, it is authentically established as marfu' from 'A'ishah (may Allah be pleased with her) through several routes.
Reference / Source: Imam Ahmad recorded it 40/ (24082), al-Bukhari (242), Muslim (2001), Abu Dawud (3682), Ibn Majah (3386), al-Tirmidhi (1863), al-Nasa'i (5081) and Ibn Hibban (5345) by way of Abu Salamah; and Imam Ahmad 41/ (24992), Abu Dawud (3687), al-Tirmidhi (1866), al-Nasa'i (5080) and Ibn Hibban (5383) by way of al-Qasim bin Muhammad; and al-Nasa'i (5172) by way of Umm Aban bin Sa'sa'ah; all three of them narrate from 'A'ishah (may Allah be pleased with her).
قولها: "ماء حُبِّها" الحُبُّ: هو وعاء الماء كالزِّير والجرَّة، وجمعه: أحبابٌ وحِبَاب.
Note / Clarification: In her saying "ma' hubbiha", the word "hubb" means a large water vessel or water-jar, such as a pitcher or earthen jar; its plural is "ahbab" and "hibab".
