Mustadrak al-Hakim — Hadith 623

حدَّثني علي بن عيسى، حَدَّثَنَا مسدد بن قَطَن، عن عثمان بن أبي شَيْبة، حَدَّثَنَا جَرِير، عن الشَّيباني، عن عبد الرحمن بن الأسود، عن أبيه، عن عائشة قالت: كان رسول الله ﷺ يأمرُنا في فَوْر حَيضتِنا أن نَتَّزِرَ ثم يباشرُنا، وأيكم يملِكُ إرْبَه كما كان رسول الله ﷺ يملكُ إرْبَه؟ (1)
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه بهذا اللفظ! إنما خرَّجا في هذا الباب حديثَ منصور، عن إبراهيم، عن الأسود، عن عائشة: كان رسول الله ﷺ يأمر إحدانا إذا كانت حائضًا أن تتَّزرَ ثم يُضاجِعُها (2).

Sayyidah Aishah (may Allah be pleased with her) narrates: During the heaviest days of our menstruation, the Messenger of Allah (peace and blessings be upon him) would order us to wrap a waist-wrapper, and then he (peace and blessings be upon him) would be intimate with us (caressing without intercourse). And which of you has control over his desire as the Messenger of Allah (peace and blessings be upon him) had?
This hadith is sahih (authentic) on the condition of Imam Bukhari and Imam Muslim, but they did not record it with this wording; they only agreed on the narration of similar meaning that he (peace and blessings be upon him) would order a menstruating woman to wrap a waist-wrapper and then lie down with her.

(1) إسناده صحيح. جرير: هو ابن عبد الحميد، والشيباني هو أبو إسحاق سليمان بن أبي سليمان، والأسود: هو ابن يزيد النَّخَعي.
Grading: Its chain is sahih.
Technical note / Defect ('illah): Jarir is Jarir bin Abd al-Hamid, al-Shaybani is Abu Ishaq Sulayman bin Abi Sulayman, and al-Aswad is al-Aswad bin Yazid al-Nakha'i.
وأخرجه أبو داود (273) عن عثمان بن أبي شيبة، بهذا الإسناد.
Reference / Source: Abu Dawud recorded it (273) from Uthman bin Abi Shaybah, with this chain.
وأخرجه أحمد 40/ (24046) عن محمد بن فضيل، والبخاري (302)، ومسلم (293) (2)، وابن ماجه (635) من طريق علي بن مُسهِر، كلاهما عن أبي إسحاق الشيباني، به. فاستدراك الحاكم له على الشيخين ذهولٌ منه.
Reference / Source: Ahmad recorded it at 40/ (24046) via Muhammad bin Fudayl, and al-Bukhari (302), Muslim (293) (2) and Ibn Majah (635) via Ali bin Mushir; both of them narrate from Abu Ishaq al-Shaybani, with it.
Important point: Al-Hakim's adding it as a supplement (istidrak) to the two Shaykhs (al-Bukhari and Muslim) is an oversight on his part, since it is already in their collections.
قوله: "فور حيضتها" أي: أولها ومعظمها.
Note / Clarification: "Fawr haydatiha" means the beginning of her menstruation and its heaviest part.
والإرْب، بكسر الهمزة وسكون الراء: الحاجة، وقيل: العقل، وقيل: العُضْو، ويروى بفتح الهمزة والراء: وهي الحاجة.
Note / Clarification: "Al-irb" (with a kasrah on the hamzah and a sukun on the ra') means need (desire); some said it means intellect, and some said the organ. It is also narrated with a fathah on the hamzah and the ra' ("arab"), which also means need.

(2) أخرجه البخاريّ برقم (300)، ومسلم (293) (1).
