Mustadrak al-Hakim — Hadith 621

أخبرنا أبو عبد الله محمد بن يعقوب الحافظ، حَدَّثَنَا يحيى بن محمد بن يحيى. وأخبرنا أبو بكر بن إسحاق، أخبرنا أبو المثنَّى؛ قالا: حَدَّثَنَا مسدَّد، حَدَّثَنَا يحيى، عن شُعبة، عن الحَكَم، عن عبد الحميد بن عبد الرحمن، عن مقِسَم، عن ابن عباس، عن النَّبِيّ ﷺ في الذي يأتي امرأتَه وهي حائض - قال: "يتصدَّقُ بدينارٍ، أو بنصفِ دينار" (1).
هذا حديث صحيح، فقد احتجَّا جميعًا بمِقسَم بن نَجْدة (2)، فأما عبد الحميد بن عبد الرحمن فإنه أبو الحسن عبد الحميد بن عبد الرحمن الجَزَري (3)، ثقة مأمون. وشاهده ودليله:

It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Prophet (peace and blessings be upon him) said, concerning a man who has intercourse with his wife while she is menstruating: "He should give one dinar or half a dinar in charity."
This hadith is sahih (authentic); the two Shaykhs used Miqsam bin Najdah as evidence, and Abd al-Hamid bin Abd al-Rahman is trustworthy and reliable.

(1) صحيح موقوفًا، رجاله ثقات، وقد روي مرفوعًا وموقوفًا، والموقوف أصحُّ كما هو مبيَّن في تعليقنا على "مسند أحمد" 3/ (2033) و "سنن ابن ماجه" (640). أبو المثنى: هو معاذ بن المثنى العنبري، ومسدَّد: هو ابن مسرهَد البصري، ويحيى: هو ابن سعيد القطان، والحكم: هو ابن عتيبة.
Grading: It is sahih as mawquf (a statement of the Companion), and all its narrators are thiqah (trustworthy).
Important point: It is narrated both marfu' and mawquf, but the mawquf version is more correct, as explained in our notes on Musnad Ahmad (3/ 2033) and Sunan Ibn Majah (640).
Technical note / Defect ('illah): Abu al-Muthanna is Mu'adh bin al-Muthanna al-Anbari, Musaddad is Ibn Musarhad al-Basri, Yahya is Yahya bin Sa'id al-Qattan, and al-Hakam is al-Hakam bin Utaybah.
وأخرجه أبو داود (264) عن مسدَّد، بهذا الإسناد. وانظر تتمة تخريجه فيه.
Reference / Source: Abu Dawud recorded it (264) from Musaddad, with this chain; see the rest of its takhrij there.
وقال الترمذيّ (137) بعد أن أخرجه من طريق عبد الكريم - وهو ابن أبي المخارق - عن مقسم: حديث الكفارة في إتيان الحائض قد روي عن ابن عباس موقوفًا ومرفوعًا، وهو قول بعض أهل العلم، وبه يقول أحمد وإسحاق، وقال ابن المبارك: يستغفر ربَّه ولا كفارة عليه، وقد روي مثلُ قول ابن المبارك عن بعض التابعين، منهم سعيد بن جُبير وإبراهيم النَّخَعي، وهو قول عامَّة علماء الأمصار.
Important point: Al-Tirmidhi (137), after recording it via Abd al-Karim (Ibn Abi al-Mukhariq) from Miqsam, says: the hadith of the expiation for having intercourse with a menstruating woman is narrated from Ibn Abbas both mawquf and marfu'.
General principle: It is the view of some scholars, and Ahmad and Ishaq hold it; Ibn al-Mubarak said he should seek his Lord's forgiveness and owes no expiation. The like of Ibn al-Mubarak's view is narrated from some of the Successors, among them Sa'id bin Jubayr and Ibrahim al-Nakha'i, and it is the view of most scholars of the major cities.

(2) ويقال: بُجْرة.
Note / Clarification: It is also said: "Bujrah".

(3) كذا قال المصنّف وكنى عبدَ الحميد هذا أبا الحسن الجزري، وقد قال الحافظ المحقِّق ابن حجر العسقلاني في "التقريب": أبو الحسن الجزري مجهول وأخطأ من سمَّاه عبد الحميد. قلنا: وعبد الحميد بن عبد الرحمن هذا: هو ابن زيد بن الخطاب القرشي العَدَوي، وهو مدني، وقيل: عداده في أهل الجزيرة، وكنيته أبو عمر.
Technical note / Defect ('illah): This is what the author (al-Hakim) said, giving this Abd al-Hamid the kunyah "Abu al-Hasan al-Jazari"; but al-Hafiz Ibn Hajar says in "al-Taqrib" that Abu al-Hasan al-Jazari is unknown (majhul), and whoever named him Abd al-Hamid erred.
Important point: This Abd al-Hamid bin Abd al-Rahman is in fact Ibn Zayd bin al-Khattab al-Qurashi al-Adawi; he is from Madinah (it is also said that he is counted among the people of al-Jazirah), and his kunyah is "Abu Umar".
