أخبرني إسماعيل بن محمد بن الفضل الشَّعْراني، حدثنا جدِّي، حدثنا عبد الله بن صالح حدثنا الليث بن سعد، عن عبد الرحمن بن خالد بن مُسافِر، عن الزُّهْري، عن محمد بن عُروة بن الزُّبير، عن عمِّه عبد الله بن الزُّبير، قال: قال رسول الله ﷺ: "إنما سمَّى اللهُ البيتَ العتيقَ، لأنه أعتَقَه من الجبابرة، فلم يَظهَرْ عليه جبَّارٌ قطُّ" (2). هذا حديث صحيح على شرط البخاري، ولم يُخرجاه. It is narrated from Sayyiduna Abdullah bin al-Zubayr (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Allah Almighty named the House of Allah al-Bayt al-Atiq (the Ancient, or Free, House) because Allah kept it free from the domination of tyrants and oppressors, so no tyrant has ever been able to prevail over it."
This hadith is sahih (authentic) on the condition of Imam Bukhari, but the two Shaykhs did not record it.

(2) إسناده ضعيف، عبد الله بن صالح - وهو كاتب الليث - يعتبر به في المتابعات والشواهد، وهو هنا قد خولف في وصله ورفعه. Grading: (2) Its chain is "da'if". Technical note / Defect ('illah): Abd Allah bin Salih (the scribe of al-Layth) is acceptable in corroborations, but here others have contradicted him in presenting this hadith as "mawsul" (connected) and "marfu'". وقد أخرجه الترمذي (3170) من طرق عن عبد الله بن صالح، بهذا الإسناد كالذي عند المصنف. وحسّنه. Reference / Source: Al-Tirmidhi (3170) narrated it from Abd Allah bin Salih and declared it "hasan". ثم رواه عن قتيبة بن سعيد - وهو ثقة ثبت - عن الليث بن سعد، عن عُقيل بن خالد، عن الزهري، عن النبي ﷺ مرسلًا. Technical note / Defect ('illah): Then (al-Tirmidhi) narrated it from Qutaybah bin Sa'id (thiqah, thabt), who narrated it from al-Layth, from Uqayl, from al-Zuhri, from the Prophet (peace and blessings be upon him) as "mursal". ورواه كذلك مرسلًا ابن جريج عن الزهري عند الطبري في "تفسيره" 17/ 151. Reference / Source: Likewise Ibn Jurayj narrated it from al-Zuhri as "mursal" (al-Tabari: 17/ 151). وخالف معمرٌ عند عبد الرزاق في "تفسيره" 2/ 37، والطبري 17/ 151، فرواه عن الزهري: أنَّ ابن الزبير قال … فذكره موقوفًا من قول الزبير. قال أبو حاتم الرازي كما في "العلل" لابنه (810): حديث معمر عندي أشبه، لأنه لا يحتمل أن يكون عن النبي ﷺ مرفوعًا. Technical note / Defect ('illah): Ma'mar, contradicting them (Abd al-Razzaq: 2/ 37; al-Tabari: 17/ 151), narrated from al-Zuhri that "Ibn al-Zubayr said..." i.e. he made it a "mawquf" statement of al-Zubayr (or Ibn al-Zubayr). Abu Hatim al-Razi (al-Ilal: 810) says: "In my view the narration of Ma'mar is more correct, because it is not possible for this hadith to be marfu' from the Prophet (peace and blessings be upon him)."
