(1) حديث صحيح، وهذا إسناد حسن من أجل المحرَّر بن أبي هريرة، إلّا أنه وقع في روايته هنا نكارة من جهة قوله في الحديث: "ومن كان بينه وبين رسول الله ﷺ عهد فإنَّ أجله أربعة أشهر"، والصحيح أن أجله إلى أمَده بالغًا ما بلغ ولو زاد على أربعة أشهر، وذلك لقوله تعالى في سورة براءة: ﴿فَأَتِمُّوا إِلَيْهِمْ عَهْدَهُمْ إِلَى مُدَّتِهِمْ﴾، وأما من لم يكن له عهد من المشركين، أو كان له عهد لكن ظَاهَر على رسول الله ﷺ أو نَقَض عهدَه قبل انقضاء مدته، فذلك أمدُه إلى أربعة أشهر، انظر "تفسير الطبري" 10/ 62 - 63، و"تفسير ابن كثير" 4/ 45.
Grading: The hadith is sahih, and this isnad is hasan because of al-Muharrar bin Abi Hurayrah.
Technical note / Defect ('illah): However, in his narration here there is something objectionable (nakarah), namely his words in the hadith: "Whoever had a covenant with the Messenger of Allah (peace and blessings be upon him), his term is four months." The correct position is that his term runs to its appointed end, however long it is, even if it exceeds four months, because of the words of Allah the Exalted in Surah Bara'ah: ﴿فَأَتِمُّوا إِلَيْهِمْ عَهْدَهُمْ إِلَى مُدَّتِهِمْ﴾ (So fulfil their covenant with them until their term). As for those idolaters who had no covenant, or had a covenant but supported others against the Messenger of Allah (peace and blessings be upon him) or broke their covenant before its term ended, their respite was up to four months. See "Tafsir al-Tabari" (10/ 62-63) and "Tafsir Ibn Kathir" (4/ 45).
ثم إنَّ النضر بن شميل -وهو ثقة- قد تفرّد بروايته عن شعبة عن سليمان الشيباني عن الشعبي، وخالفه جماعة فرووه عن شعبة عن المغيرة بن مقسم الضبِّي عن الشعبي كما سيأتي.
Technical note / Defect ('illah): Furthermore, al-Nadr bin Shumayl - who is thiqah (trustworthy) - is alone in narrating it as "Shu'bah, from Sulayman al-Shaybani, from al-Sha'bi", while a group contradicted him and narrated it as "Shu'bah, from al-Mughirah bin Miqsam al-Dabbi, from al-Sha'bi", as will come.
وأخرجه ابن راهويه في "مسنده" (517)، وابن زنجويه في "الأموال" (673) عن النضر بن شميل، بهذا الإسناد.
Reference / Source: Ibn Rahawayh recorded it in his "Musnad" (517) and Ibn Zanjawayh in "al-Amwal" (673) from al-Nadr bin Shumayl, with this same isnad.
وسيأتي عند المصنف برقم (7542) من طريق وهب بن جرير وسعيد بن عامر، عن شعبة، عن مغيرة بن مقسم الضَّبِّي، عن الشعبي، به. وأخرجه كذلك أحمد 13/ (7977)، والنسائي (3935) من طريق محمد بن جعفر وعثمان ابن عمر، عن شعبة، عن مغيرة، عن الشعبي، به.
Reference / Source: It will come with the author at number (7542) by way of Wahb bin Jarir and Sa'id bin Amir, from Shu'bah, from Mughirah bin Miqsam al-Dabbi, from al-Sha'bi. Likewise, Ahmad (13/ 7977) and al-Nasa'i (3935) recorded it by way of Muhammad bin Ja'far and Uthman bin Umar, from Shu'bah, from Mughirah, from al-Sha'bi.
وأخرجه النسائي (3936)، وابن حبان (3820) من طريق جرير بن عبد الحميد، عن مغيرة، عن الشعبي، به.
Reference / Source: Al-Nasa'i (3936) and Ibn Hibban (3820) recorded it by way of Jarir bin Abd al-Hamid, from Mughirah, from al-Sha'bi, with this isnad.
وأخرج بعضه -وهو: لا يحج .. ولا يطوف … - البخاري (369)، ومسلم (1347)، وأبو داود (1946)، والنسائي (3934) من طريق حميد بن عبد الرحمن، عن أبي هريرة.
Reference / Source: Part of it - namely: "No one shall perform Hajj … and no one shall perform tawaf …" - was recorded by al-Bukhari (369), Muslim (1347), Abu Dawud (1946) and al-Nasa'i (3934) by way of Humayd bin Abd al-Rahman, from Abu Hurayrah.
ويشهد له بتمامه على الصواب حديثُ عليٍّ فيما سيأتي عند المصنف برقم (4437)، وإسناده حسن إن شاء الله.
Corroborating chains and supporting reports: It is supported in full, in its correct form, by the hadith of Ali (may Allah be pleased with him) that will come with the author at number (4437), and its isnad is hasan, in sha' Allah.
قوله: "صحل صوتي" أي: بُحَّ.
Note / Clarification: His words: "sahila sawti" mean: my voice became hoarse.
