(1) معنى قوله: فغُلِبا: ضعُفا عن أن يطيبا بالولد. وفي بعض الروايات: فغَلبا، أي: صاحا وتخاصما.
Note / Clarification: "Fa-ghulibā" (passive) means: the two of them (the mother and father) were too weak to give up the child willingly. In some narrations it is "fa-ghalabā" (active), meaning: they shouted and quarrelled.
(2) إسناده ضعيف لاضطرابه كما هو مبيّن في "مسند أحمد" 32/ (19329)، وقد نبَّه على اضطرابه أبو حاتم في "العلل" لابنه (1204)، والنسائي (5652 - 5656)، وصَوَّبا أنه عن ابن الخليل مرسلًا موقوفًا، ومع ذلك صحَّح ابن حزم في "المحلى" 10/ 150 إسناد الثَّوري الذي قال فيه: عن صالح الهَمْداني - وهو ابن صالح بن حَيٍّ - عن الشعبي عن عبد خير الحضرميّ، عن زيد بن أرقم. فذكر عبد خير، بدل عبد الله بن الخليل، وذكر صالحًا الهمداني بدل الأجلح. وتابع ابنَ حزم على ذلك عبدُ الحق الإشبيلي في "أحكامه الوسطى" 3/ 220، وابنُ القطان في "بيان الوهم والإيهام" 5/ 433 و 436، وصحَّح الحديثَ قبل هؤلاء إسحاق بن راهويه كما في "مسائل إسحاق بن منصور الكوسج" (1047).
Grading: The chain of this hadith is "da'if" because of its "idtirab" (inconsistency), as is made clear in "Musnad Ahmad" (32/ 19329). Abu Hatim (al-'Ilal 1204) and al-Nasa'i (5652-5656) pointed out its inconsistency and judged correct (sawab) that it is from Ibn al-Khalil as "mursal mawquf". Despite this, Ibn Hazm declared the chain of al-Thawri sahih in "al-Muhalla" (10/ 150) (in which it is Salih al-Hamdani, from al-Sha'bi, from Abd Khayr, from Zayd bin Arqam), and Abd al-Haqq al-Ishbili and Ibn al-Qattan followed him in this. Before them, Ishaq bin Rahawayh also declared it sahih.
أبو المثنَّى: هو معاذ بن المثنَّى، ومُسدَّد: هو ابن مُسَرْهَد، ويحيى: هو ابن سعيد القطان، والأجلح عرَّفه المصنف.
Note / Clarification: (In the chain) Abu al-Muthanna is "Mu'adh bin al-Muthanna", Musaddad is "Ibn Musarhad", and Yahya is "Ibn Sa'id al-Qattan". The author (al-Hakim) has himself identified al-Ajlah.
وأخرجه أبو داود (2269) عن مُسدَّد، بهذا الإسناد.
Reference / Source: Abu Dawud (2269) narrated it from Musaddad with this same chain.
وأخرجه النسائي (5654) عن عمرو بن علي الفلّاس، عن يحيى القطان، به.
Reference / Source: Al-Nasa'i (5654) narrated it likewise from Amr bin Ali al-Fallas, from Yahya al-Qattan.
وأخرجه أحمد 32/ (19342) عن سفيان بن عيينة، و (19344) من طريق هُشَيم، والنسائي (5653) و (5995) من طريق علي بن مُسهر، ثلاثتهم عن الأجلح، به. لكن قال ابن عيينة: عن عبد الله بن أبي الخليل، وقال هشيم: عن أبي الخليل.
Reference / Source: Ahmad (32/ 19342) recorded it from Sufyan bin 'Uyaynah, and in (19344) from Hushaym; and al-Nasa'i (5653, 5995) by way of Ali bin Mushir. All three narrate it from al-Ajlah. Ibn 'Uyaynah said "Abd Allah bin Abi al-Khalil", and Hushaym said "Abi al-Khalil".
وسيأتي برقم (4710) من طريق عيسى بن يونس، وبرقم (4711) من طريق سفيان بن عيينة، وبرقم (7213) من طريق أبي غسان مالك بن إسماعيل النهدي، ثلاثتهم عن الأجلح.
Details of the narration: And this narration will come later at number (4710) by way of Isa bin Yunus, at (4711) by way of Sufyan bin 'Uyaynah, and at (7213) by way of Abu Ghassan Malik bin Isma'il al-Nahdi; all three narrate it from al-Ajlah.
ورواه عبد الرزاق عن سفيان الثَّوري، واختُلف عليه: ¤ ¤ فأخرجه أحمد (19329) عن عبد الرزاق، عن سفيان الثَّوري، عن أجلح، عن الشَّعبي، عن عبد خير، عن زيد بن أرقم. فذكر عبدَ خير بدل عبد الله بن الخليل.
Technical note / Defect ('illah): Abd al-Razzaq narrated it from Sufyan al-Thawri, and there is disagreement among those narrating from him: thus Ahmad (19329) narrated it from Abd al-Razzaq, from Sufyan al-Thawri, from al-Ajlah, from al-Sha'bi, from Abd Khayr, from Zayd bin Arqam (here Abd Khayr is mentioned in place of Abd Allah bin al-Khalil).
وأخرجه أبو داود (2270)، والنسائي (5652) و (5993) عن أبي عاصم خُشَيش بن أصرم، وابن ماجه (2348) عن إسحاق بن منصور، كلاهما عن عبد الرزاق عن سفيان الثَّوري، عن صالح بن صالح بن حَيٍّ الهَمْداني، عن الشعبي، عن عبد خير، عن زيد بن أرقم. فذكر صالحًا الهمداني بدل الأجلح، وذكر عبدَ خير بدل عبد الله بن الخليل.
Reference / Source: Abu Dawud (2270) and al-Nasa'i (5652, 5993) from Abu 'Asim Khushaysh bin Asram; and Ibn Majah (2348) from Ishaq bin Mansur; both from Abd al-Razzaq, from Sufyan al-Thawri, from Salih bin Salih bin Hayy al-Hamdani, from al-Sha'bi, from Abd Khayr, from Zayd bin Arqam (here Salih al-Hamdani is mentioned in place of al-Ajlah, and Abd Khayr in place of Abd Allah bin al-Khalil).
وأخرجه النسائي (5655) و (5994) من طريق أبي إسحاق الشَّيباني، عن الشعبي، عن رجل من حضرموت، عن زيد بن أرقم. فأبهم ذكر الحضرمي.
Reference / Source: And al-Nasa'i (5655, 5994) narrated it by way of Abu Ishaq al-Shaybani, from al-Sha'bi, from a man from Hadramawt, from Zayd bin Arqam (here the Hadrami is left unnamed).
وأخرجه أبو داود (2271)، والنسائي (5656) من طريق شعبة، عن سلمة بن كُهيل، عن الشعبي، عن أبي الخليل أو ابن الخليل، قال: أتي عليٌّ، فذكره مرسلًا موقوفًا ليس فيه ذكر النبي ﷺ.
Reference / Source: And Abu Dawud (2271) and al-Nasa'i (5656) narrated it by way of Shu'bah, from Salamah bin Kuhayl, from al-Sha'bi, from Abi al-Khalil (or Ibn al-Khalil), as "mursal mawquf"; the Prophet (peace and blessings be upon him) is not mentioned in it.
