Mustadrak al-Hakim — Hadith 2864

أخبرنا أبو بكر بن إسحاق، أخبرنا الحسن بن علي بن زياد، حدثنا إبراهيم بن موسى، حدثنا عيسى بن يونس، حدثنا عبد الحميد بن جعفر، حدثني أبي، حدثني رافع بن سِنان: أنه أسلمَ وأبَتِ امرأتُه أن تُسلِم، فأتتِ النبيَّ ﷺ، فقالت: ابنتي فَطِيمٌ، وقال رافع: ابنتي، فقال النبي ﷺ لِرافع: "اقعُدْ ناحِيةً" وقال لامرأته: "اقعُدي ناحيةً"، قال: وأقعَدَ الصَّبِيّةَ (3) بينهما، ثم قال: "ادعُواها" فمالَتْ الصَّبِيّة إلى أمها، فقال النبي ﷺ: "اللهم اهْدِها"، فمالَتْ إلى أبيها، فأخذها (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Rafi' bin Sinan (may Allah be pleased with him) that he accepted Islam while his wife refused to accept Islam. They both came to the Prophet (peace and blessings be upon him). The woman said: My daughter has been weaned (that is, she is now attached to me), while Rafi' said: She is my daughter. The Prophet (peace and blessings be upon him) said to Rafi': "Sit on one side," and said to his wife: "Sit on the other side." Then he (peace and blessings be upon him) seated the girl between them and said: "Both of you call her." The girl began to incline towards her mother, so the Prophet (peace and blessings be upon him) supplicated: 'Allahumma ihdiha' (O Allah, guide her). So she (immediately) inclined towards her father, and he took her.
This hadith has a sahih chain of transmission, but the two Shaykhs did not record it.

(3) تحرَّف في (ز) و (ص) و (ع) إلى: الصبي، وجاء على الصواب في (ب)، وفي رواية البيهقي ¤ ¤ في "سننه الكبرى" 8/ 3 عن أبي عبد الله الحاكم.
Note / Clarification: In manuscripts (Z), (S) and ('A) the word has been distorted into "al-sabi" (the boy), whereas it appears correctly in manuscript (B) and in al-Bayhaqi's "al-Sunan al-Kubra" (8/ 3) in the narration from al-Hakim.

(1) حديث صحيح، وهذا إسناد حسن، لكن قيل: إنَّ جعفرًا - وهو ابن عبد الله بن الحكم بن رافع - لم يسمع من جد أبيه رافع بن سنان، مع أنه صرَّح بسماعه منه هنا عند المصنف، لكن يُعكّر على ذلك أنَّ أبا داود روى هذا الحديث عن إبراهيم بن موسى، فلم يذكر التصريح بالسماع بل عنعنه، وعلى أي حال فجعفر هذا ثقة، وما رواه قصةٌ حصلت في أهل بيته، فهو أدرى بها، والله أعلم.
Grading: This hadith is "sahih", and this chain is "hasan".
Technical note / Defect ('illah): It has been said that Ja'far (Ibn Abd Allah bin al-Hakam bin Rafi') did not hear from his great-grandfather Rafi' bin Sinan, even though here, in the author's (al-Hakim's) narration, hearing is explicitly stated. But the difficulty with this is that Abu Dawud narrated it from Ibrahim bin Musa without mentioning the explicit statement of hearing; rather, he narrated it with "'an". In any case, Ja'far is trustworthy, and what he narrated is an incident from his own household, so he knows it best. And Allah knows best.
وأخرجه أبو داود (2244) عن إبراهيم بن موسى، بهذا الإسناد.
Reference / Source: Abu Dawud (2244) narrated it from Ibrahim bin Musa with this same chain.
وأخرجه أحمد 39/ (23757) عن علي بن بحر، عن عيسى بن يونس، به.
Reference / Source: Ahmad (39/ 23757) narrated it likewise from Ali bin Bahr, from Isa bin Yunus.
وأخرجه النسائي (6352) من طريق المعافَى بن عمران، عن عبد الحميد بن جعفر، به.
Reference / Source: Al-Nasa'i (6352) narrated it likewise by way of al-Mu'afa bin Imran, from Abd al-Hamid bin Ja'far.
ورواه عثمان البَتّي عن عبد الحميد، لكنه اختُلف عليه:
Technical note / Defect ('illah): Uthman al-Batti narrated it from Abd al-Hamid, but there is disagreement among those narrating from him:
فأخرجه أحمد (23755)، وابن ماجه (2352)، والنسائي (6354) من طريق إسماعيل ابن عُلَيَّة، وأحمد (23759)، والنسائي (5659) و (6353) من طريق سفيان الثَّوري، كلاهما عن عثمان البَتّي، قال ابن عُلَيَّة: عن عبد الحميد بن سلمة، وقال الثَّوري: عن عبد الحميد الأنصاري، به. كذا سماه ابنُ عُلَيَّة في روايته.
Reference / Source: Thus Ahmad (23755), Ibn Majah (2352) and al-Nasa'i (6354) narrated it by way of Isma'il bin 'Ulayyah; and Ahmad (23759) and al-Nasa'i (5659, 6353) by way of Sufyan al-Thawri, both from Uthman al-Batti. Ibn 'Ulayyah said: "from Abd al-Hamid bin Salamah", and al-Thawri said: "from Abd al-Hamid al-Ansari".
وأخرجه أحمد (23756) عن هُشَيم بن بَشير، عن عثمان البَتّي، عن عبد الحميد بن سلمة: أنَّ جده أسلمَ، فذكره مرسلًا.
Reference / Source: Ahmad (23756) narrated it from Hushaym bin Bashir, from Uthman al-Batti, from Abd al-Hamid bin Salamah, that: "His grandfather accepted Islam" (as mursal).
وأخرجه النسائي (6355) من طريق حماد بن سلمة، عن عثمان البَتّي، عن عبد الحميد بن سلمة، عن أبيه: أنَّ رجلًا أسلم، فذكره مرسلًا أيضًا.
Reference / Source: Al-Nasa'i (6355) narrated it from Hammad bin Salamah, from Uthman al-Batti, from Abd al-Hamid bin Salamah, from his father, that "A man accepted Islam" (this too is mursal).
كذا سمى عثمانُ البتي شيخه عبد الحميد بن سلمة، وهو خطأ، والصحيح أنه عبد الحميد بن جعفر، فقد روى الطحاوي في "شرح مشكل الآثار" بإثر الحديث (3093) وابن منده في "معجم الصحابة" 1/ 701 عن عبد الحميد بن جعفر، قال: أنا حدثتُ البَتِّي بحديث التخيير بالأهواز.
Technical note / Defect ('illah): Uthman al-Batti named his shaykh "Abd al-Hamid bin Salamah", which is a mistake. The correct view is that he is "Abd al-Hamid bin Ja'far"; al-Tahawi in "Sharh Mushkil al-Athar" (after 3093) and Ibn Mandah in "Mu'jam al-Sahabah" (1/ 701) narrated from Abd al-Hamid bin Ja'far that he said: "I narrated the hadith of the choice (takhyir) to al-Batti in al-Ahwaz."
