Mustadrak al-Hakim — Hadith 2856

حدَّثَناه علي بن حَمْشاذَ العدل، حدثنا إسماعيل بن إسحاق القاضي، حدثنا مسلم بن إبراهيم، حدثنا حسين المعلّم، عن عمرو بن شعيب. وحدثنا عليٌّ، حدثنا علي بن عبد العزيز، حدثنا عمرو بن عَون، حدثنا هُشَيم، حدثنا عامر الأحول، عن عمرو بن شعيب، عن أبيه، عن جده قال: قال رسول الله ﷺ: "لا طلاقَ قبل نِكاح"، وفي حديث هُشَيم: "لا نَذْرَ لابن آدمَ فيما لا يَملِكُ، ولا طلاقَ فيما لا يَملِكُ، ولا عَتاقَ فيما لا يَملِك" (1).
Amr bin Shu'ayb narrates from his father, and he from his grandfather (Sayyiduna Abdullah bin Amr bin al-As, may Allah be pleased with them both), that the Messenger of Allah (peace and blessings be upon him) said: "There is no divorce before marriage." And in the narration of Hushaym: "The son of Adam has no valid vow in what he does not own, no divorce in what he does not own, and no freeing of a slave in what he does not own."

(1) إسناده حسن. حسين المعلم: هو ابن ذكوان، وعامر الأحول: هو ابن عبد الواحد، وهُشيم: هو ابن بَشير.
Grading: The chain of this hadith is "hasan".
Note / Clarification: Husayn al-Mu'allim (in the chain) is "Ibn Dhakwan", 'Amir al-Ahwal is "Ibn Abd al-Wahid", and Hushaym is "Ibn Bashir".
وأخرجه أحمد 11/ (6780)، وابن ماجه (2047)، والترمذي (1181) من طريق هُشَيم بن بَشير، بهذا الإسناد. وقال الترمذي: حديث حسن صحيح، وهو أحسن شيء روي في هذا الباب.
Reference / Source: Ahmad (11/ 6780), Ibn Majah (2047) and al-Tirmidhi (1181) narrated it via Hushaym bin Bashir, with this chain. Al-Tirmidhi said: the hadith is "hasan sahih", and it is the best that has been narrated in this chapter.
وأخرجه أحمد (6932) من طريق محمد بن إسحاق، وأبو داود (2190) من طريق مطر الورّاق، كلاهما عن عمرو بن شعيب، به.
Reference / Source: Ahmad (6932) narrated it via Muhammad bin Ishaq, and Abu Dawud (2190) via Matar al-Warraq; both from 'Amr bin Shu'ayb, likewise.
وسيأتي برقم (8016) من طريق عبد الرحمن بن الحارث المخزومي عن عمرو بن شعيب.
Details of the narration: This narration will come later at no. (8016) via Abd al-Rahman bin al-Harith al-Makhzumi, from 'Amr bin Shu'ayb.
وأخرج منه قوله: "لا نذر فيما لا يملك" أحمدُ (6990)، وأبو داود (3274)، والنسائي (4715) من طريق عُبيد الله بن الأخنس، عن عمرو بن شعيب، به.
Reference / Source: The part of it: "There is no vow concerning what one does not own" was narrated by Ahmad (6990), Abu Dawud (3274) and al-Nasa'i (4715) via 'Ubayd Allah bin al-Akhnas, from 'Amr bin Shu'ayb, likewise.
ويشهد له حديث عائشة الآتي برقم (3611)، ورجاله ثقات.
Corroborating chains and supporting reports: It is supported (as a shahid) by the hadith of 'A'ishah (may Allah be pleased with her) that will come at no. (3611), and its narrators are trustworthy (thiqat).
