Mustadrak al-Hakim — Hadith 2857

أخبرني أبو العباس محمد بن أحمد المحبُوبي بمَرْو، حدثنا الفضل بن عبد الجبار، حدثنا علي بن الحَسَن (2) بن شَقيق، أخبرنا الحسين بن واقِد وأبو حمزة جميعًا، عن يزيد النَّحْويّ، عن عِكرمة، عن ابن عباس قال: ما قالها ابنُ مسعود، وإن يكن قالها فزَلَّةٌ من عالِم؛ في الرجل يقول: إن تزوّجتُ فلانةَ فهي طالِق، قال الله ﷿: ﴿يَاأَيُّهَا الَّذِينَ آمَنُوا إِذَا نَكَحْتُمُ الْمُؤْمِنَاتِ ثُمَّ طَلَّقْتُمُوهُنَّ﴾ [الأحزاب: 49]، ولم يقُل: إذا طَلّقتم المؤمناتِ ثم نَكحتُموهن (3).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that concerning a man who says, "If I marry such-and-such a woman, she is divorced," he said: "Ibn Mas'ud would not have said this, and if he did say it, it is the slip of a scholar (that is, the woman will not be divorced), because Allah, the Mighty and Majestic, says: 'O you who believe! When you marry believing women and then divorce them' [Surah al-Ahzab: 49]; Allah did not say, 'When you divorce believing women and then marry them.'"
This hadith has a sahih chain of transmission, but the two Shaykhs did not record it.

Note / Clarification: In manuscript (Z) and the printed edition (the narrator's name) has been corrupted (tahrif) from "al-Hasan" into "al-Husayn".

(3) إسناده صحيح. أبو حمزة: هو محمد بن ميمون السُّكّري، ويزيد النَّحْوي: هو ابن أبي سعيد.
Grading: The chain of this hadith is "sahih".
Note / Clarification: Abu Hamzah (in the chain) is "Muhammad bin Maymun al-Sukkari", and Yazid al-Nahwi is "Ibn Abi Sa'id".
وأخرجه البيهقي في "الكبرى" 7/ 320، وفي "المعرفة" (14612) عن أبي عبد الله الحاكم، بهذا الإسناد. ¤ ¤ وأخرجه الطحاوي في "شرح مشكل الآثار" 2/ 139 عن أحمد بن عبد المؤمن المروَزي، عن علي بن الحسن بن شقيق، عن أبي حمزة السكري وحده، بهذا الإسناد.
Reference / Source: Al-Bayhaqi narrated it in "al-Kubra" (7/ 320) and "al-Ma'rifah" (14612) from Abu Abd Allah al-Hakim, with this chain. And al-Tahawi narrated it in "Sharh Mushkil al-Athar" (2/ 139) from Ahmad bin Abd al-Mu'min al-Marwazi, from 'Ali bin al-Hasan bin Shaqiq, from Abu Hamzah al-Sukkari alone, with this chain.
وأخرجه عبد الرزاق (11553)، وسعيد بن منصور (1022)، وابن المنذر في "الأوسط" (7739)، والبيهقي 7/ 383 من طريق محمد بن عجلان، والبيهقي 7/ 320 من طريق قتادة، وحرب بن إسماعيل في "مسائله" 1/ 379 من طريق عاصم الأحول، ثلاثتهم عن عكرمة، عن ابن عباس. ولفظ ابن عجلان: أنَّ ابن عباس كان لا يرى الظِّهار قبل النكاح شيئًا، ولا الطلاقَ قبل النكاح شيئًا. ولفظ قتادة: عن ابن عباس أنه قال: إنما الطلاق من بعد النكاح، ولفظ عاصم: لا طلاق إلّا بعد نكاح، ولا عتق إلّا بعد ملك.
Reference / Source: Abd al-Razzaq (11553), Sa'id bin Mansur (1022), Ibn al-Mundhir in "al-Awsat" (7739) and al-Bayhaqi (7/ 383) narrated it via Muhammad bin 'Ajlan; al-Bayhaqi (7/ 320) via Qatadah; and Harb bin Isma'il in his "Masa'il" (1/ 379) via 'Asim al-Ahwal. All three (Ibn 'Ajlan, Qatadah and 'Asim) narrate it from 'Ikrimah, from Ibn 'Abbas. The wording of Ibn 'Ajlan is: "Ibn 'Abbas did not consider zihar before marriage to be anything, nor divorce before marriage." The wording of Qatadah is: "Divorce is only after marriage." And the wording of 'Asim is: "There is no divorce except after marriage, and no emancipation except after ownership."
وأخرجه عبد الرزاق (11449)، وابن أبي شيبة 5/ 16 من طريق عبد الأعلى بن عامر، وابن أبي شيبة 5/ 18، وابن أبي حاتم في "تفسيره" 10/ 3142 من طريق آدم بن سليمان مولى خالد بن خالد بن عقبة، كلاهما عن سعيد بن جبير، عن ابن عباس. ولفظ عبد الأعلى بنحو لفظ عاصم الأحول عن عكرمة، ولفظ آدم بنحو لفظ يزيد النحوي عن عكرمة دون ذكر ابن مسعود.
Reference / Source: Abd al-Razzaq (11449) and Ibn Abi Shaybah (5/ 16) narrated it via Abd al-A'la bin 'Amir; and Ibn Abi Shaybah (5/ 18) and Ibn Abi Hatim in his "Tafsir" (10/ 3142) via Adam bin Sulayman, the freed slave of Khalid bin Khalid bin 'Uqbah. Both (Abd al-A'la and Adam) narrate it from Sa'id bin Jubayr, from Ibn 'Abbas. The wording of Abd al-A'la is like that of 'Asim al-Ahwal from 'Ikrimah, and the wording of Adam is like that of Yazid al-Nahwi from 'Ikrimah, but without mention of Ibn Mas'ud.
وسيأتي برقم (3609) من طريق طاووس عن ابن عباس، بنحو لفظ يزيد النحوي عن عكرمة دون ذكر ابن مسعود أيضًا.
Details of the narration: This narration will come later at no. (3609) via Tawus, from Ibn 'Abbas, with wording like that of Yazid al-Nahwi from 'Ikrimah, again without mention of Ibn Mas'ud.
وقد تقدم عند الطريق التي قبله تخريجه من طريق عطاء عن ابن عباس، ولفظه بنحو لفظ عاصم الأحول عن عكرمة.
Details of the narration: Its documentation via 'Ata' from Ibn 'Abbas preceded at the route before this one, and its wording is like that of 'Asim al-Ahwal from 'Ikrimah.
وسيأتي عن ابن عباس مرفوعًا برقم (3612) من طريق عطاء بن أبي رباح عنه، وهو وهمٌ، والصواب وقفه كما ورد في الطرق التي هنا.
Technical note / Defect ('illah): This narration will come later from Ibn 'Abbas as "marfu'" at no. (3612) via 'Ata' bin Abi Rabah, which is an "error" (wahm). The correct view is that it is "mawquf", as it is reported in the routes here.
