Mustadrak al-Hakim — Hadith 2855

حدثنا أبو العباس محمد بن يعقوب، حدثنا محمد بن سِنان القزّاز، حدثنا أبو بكر الحنفي، حدثنا ابن أبي ذئب، حدثنا عطاء، حدثني جابر، قال: سمعت النبي ﷺ يقول: "لا طلاقَ لمن لم يَملِكْ، ولا عَتاقَ لمن لم يَملِكْ" (2).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه. وشاهدُه الحديث المشهور في الباب عن عمرو بن شعيب عن أبيه عن جدِّه:

It is narrated from Sayyiduna Jabir (may Allah be pleased with him); he relates: I heard the Prophet (peace and blessings be upon him) say: "There is no divorce in what a person does not own, and there is no freeing of a slave whom a person does not own."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it. Its supporting narration (shahid) is the well-known hadith on this topic from Amr bin Shu'ayb from his father from his grandfather.

(2) إسناده ضعيف لاضطرابه وانقطاعه، وذكرُ صيغة التحديث فيه بين ابن أبي ذئب - وهو محمد بن عبد الرحمن بن المغيرة - وبين عطاء - وهو ابن أبي رباح - وهمٌ نظنُّه من أبي بكر الحنفي - وهو عبد الكبير بن عبد المجيد - فإن محمد بن سنان القزّاز - وإن كان فيه مقال - قد تابعه على ذكر التحديث فيه محمدُ بنُ منهال الضرير عن أبي بكر الحنفي عند حرب بن إسماعيل الكرماني في "مسائله" 1/ 377 وغيره، والصحيح أنَّ ابن أبي ذئب لم يسمعه من عطاء كما جزم به أبو زرعة وأبو حاتم الرازيان كما في "العلل" لابن أبي حاتم (1220)، والدليل على صحة قولهما أنَّ أبا داود الطيالسي وحسين بن محمد المرُّوذي - وهما ثقتان حافظان - قد روياه عن ابن أبي ذئب عن رجل عن عطاء.
Grading: The chain of this hadith is "da'if" (weak) because of its inconsistency (idtirab) and disconnection (inqita').
Technical note / Defect ('illah): The mention in it of a form of direct narration (tahdith) between Ibn Abi Dhi'b (Muhammad bin Abd al-Rahman bin al-Mughirah) and 'Ata' (Ibn Abi Rabah) is an "error" (wahm), which we think comes from Abu Bakr al-Hanafi (Abd al-Kabir bin Abd al-Majid); for Muhammad bin Sinan al-Qazzaz (although there is some criticism of him) was corroborated in mentioning tahdith in it by Muhammad bin al-Minhal al-Darir from Abu Bakr al-Hanafi (with Harb bin Isma'il al-Kirmani, Masa'il: 1/ 377, and others). The correct view is that Ibn Abi Dhi'b did not hear it from 'Ata', as the two Razis, Abu Zur'ah and Abu Hatim, stated with certainty (al-'Ilal of Ibn Abi Hatim: 1220). The proof that their statement is correct is that Abu Dawud al-Tayalisi and Husayn bin Muhammad al-Marrudhi (both trustworthy hafiz narrators) narrated it from Ibn Abi Dhi'b, from "a man", from 'Ata'.
وأخرجه البيهقي في "السنن الكبرى" 7/ 319، وفي "الصغرى" (2646) عن أبي عبد الله الحاكم، بهذا الإسناد.
Reference / Source: Al-Bayhaqi narrated it in "al-Sunan al-Kubra" (7/ 319) and "al-Sughra" (2646) from Abu Abd Allah al-Hakim, with this chain.
وأخرجه حرب الكرماني في "مسائله" 1/ 377، وأبو يعلى في "مسنده الكبير" وفي "مسنده الصغير" كما في "تغليق التعليق" للحافظ ابن حجر 4/ 448 ـ وعنه ابن عدي في "الكامل" 6/ 18 - والطبراني ¤ ¤ في "الأوسط" (8224) من طريق محمد بن المنهال، عن أبي بكر الحنفي، به. ووقع عند حرب وعند أبي يعلى في رواية "المسند الصغير" تصريح ابن أبي ذئب بتحديث عطاء له.
Reference / Source: Harb al-Kirmani in his "Masa'il" (1/ 377), Abu Ya'la in his "al-Musnad al-Kabir" and "al-Musnad al-Saghir" (as cited in al-Hafiz Ibn Hajar's "Taghliq al-Ta'liq": 4/ 448) (and via him Ibn 'Adi in "al-Kamil" 6/ 18), and al-Tabarani in "al-Awsat" (8224) narrated it via Muhammad bin al-Minhal, from Abu Bakr al-Hanafi, likewise. In the narrations of Harb and of Abu Ya'la (al-Musnad al-Saghir), Ibn Abi Dhi'b explicitly states that 'Ata' narrated it to him (tahdith).
وسيأتي برقم (3615) من طريق وكيع عن ابن أبي ذئب، عن عطاء. ولم يُصرِّح فيه ابن أبي ذئب بتحديث عطاء له، وقرن فيه بعطاءٍ محمدَ بنَ المنكدر، وحديث ابن المنكدر فيه اضطراب سيأتي بيانه في موضعه، وهو عند المصنف أيضًا برقم (3614) من رواية صدقة بن عبد الله -أحد الضعفاء - عن ابن المنكدر عن جابر.
Details of the narration: This narration will come later at no. (3615) via Waki', from Ibn Abi Dhi'b, from 'Ata'. In it Ibn Abi Dhi'b did not explicitly state that 'Ata' narrated it to him, and he paired "Muhammad bin al-Munkadir" with 'Ata'. The hadith of Ibn al-Munkadir contains inconsistency (idtirab), which will be explained in its place; it is also with the author (al-Hakim) at no. (3614) from the narration of Sadaqah bin Abd Allah (one of the weak narrators), from Ibn al-Munkadir, from Jabir.
وأخرجه البزار في "مسنده" كما في "المطالب العالية" (1714)، وابن المنذر في "الأوسط" (7708)، وأبو علي الحسن بن حبيب الحَصَائري في "جزئه" كما في "تغليق التعليق" لابن حجر 4/ 449 من طريق أيوب بن سويد، عن ابن أبي ذئب، به. ووقع عند الحصائري تصريح ابن أبي ذئب بتحديث عطاء له، لكن أيوب هذا ضعيف، كما قال الحافظ ابن حجر في "الفتح" 16/ 92، وقال: وفي كلٍّ من ذلك (يعني مما وقع فيه التصريح بالتحديث) نظر، والمحفوظ فيه العنعنة، ثم ذكر رواية الطيالسي والمرُّوذي.
Reference / Source: Al-Bazzar in his "Musnad" (as cited in "al-Matalib al-'Aliyah": 1714), Ibn al-Mundhir in "al-Awsat" (7708), and Abu 'Ali al-Hasan bin Habib al-Hasa'iri in his "Juz'" (as cited in Ibn Hajar's "Taghliq al-Ta'liq": 4/ 449) narrated it via Ayyub bin Suwayd, from Ibn Abi Dhi'b, likewise. With al-Hasa'iri, Ibn Abi Dhi'b explicitly states that 'Ata' narrated it to him, but this Ayyub is "da'if" (weak), as al-Hafiz Ibn Hajar said in "al-Fath" (16/ 92). He also said: all of these (i.e. the ones with explicit tahdith) are open to question, and the preserved (mahfuz) version is with 'an'anah. Then he mentioned the narration of al-Tayalisi and al-Marrudhi.
وأخرجه الطيالسي (1787)، وأخرجه أبو بكر الشافعي في "الغيلانيات" (627) من طريق حسين بن محمد المرُّوذي، كلاهما (الطيالسي وحسين) عن ابن أبي ذئب، عن رجل، عن عطاء، به.
Reference / Source: Al-Tayalisi (1787) narrated it, and Abu Bakr al-Shafi'i in "al-Ghaylaniyyat" (627) via Husayn bin Muhammad al-Marrudhi; both (al-Tayalisi and Husayn) from Ibn Abi Dhi'b, from "a man", from 'Ata', likewise.
ورواه ابن جُرَيج، عن عطاء، عن ابن عباس من قوله موقوفًا عليه، أخرجه من طريقه عبد الرزاق في "المصنف" (11448)، وابن أبي شيبة 5/ 16، وأحمد بن حنبل في "مسائل ابنه له" (1320)، والبيهقي في "السنن الكبرى" 7/ 320، وفي "معرفة السنن والآثار" (14611). وقال الحافظ ابن حجر في "التغليق": هذا الإسناد أصح ما ورد فيه.
Reference / Source: Ibn Jurayj narrated it from 'Ata', from Ibn 'Abbas, as his own statement, "mawquf" on him. Abd al-Razzaq in "al-Musannaf" (11448), Ibn Abi Shaybah (5/ 16), Ahmad bin Hanbal in "Masa'il" by his son (1320), and al-Bayhaqi in "al-Sunan al-Kubra" (7/ 320) and "Ma'rifat al-Sunan wa al-Athar" (14611) narrated it via him. Al-Hafiz Ibn Hajar said in "al-Taghliq": this chain is the most authentic that has been reported on this.
وسيأتي من طريق عطاء عن ابن عباس مرفوعًا برقم (3612)، لكن ما هنا هو الصحيح، لأنَّ عكرمة رواه عن ابن عباس أيضًا في الطريق الآتية برقم (2857) موقوفًا عليه كذلك.
Details of the narration: This narration will come later via 'Ata' from Ibn 'Abbas as "marfu'" at no. (3612), but what is here (mawquf) is the correct version, because 'Ikrimah also narrated it from Ibn 'Abbas in the coming route at no. (2857), likewise as "mawquf" on him.
وأحسن شيء في المرفوع حديثُ عمرو بن شعيب، عن أبيه، عن جده، الآتي بعده.
Important point: The best of the marfu' narrations is the hadith of 'Amr bin Shu'ayb, from his father, from his grandfather, which comes after it.
وحديثُ عائشة الآتي عند المصنف برقم (3611)، ورجاله ثقات إلا أن فيه اضطرابًا.
Note / Clarification: And the hadith of 'A'ishah (may Allah be pleased with her), which will come with the author at no. (3611); its narrators are trustworthy (thiqat), but it contains inconsistency (idtirab).
