Mustadrak al-Hakim — Hadith 2854

حدثنا أبو الوليد الفقيه، حدثنا الحسن بن سفيان، حدثنا عمار بن خالد ومحمد بن معاوية، قالا: حدثنا علي بن هاشم حدثنا إسماعيل بن مسلم، عن عمرو بن دينار، عن طاووس، عن ابن عباس: أنَّ رجلًا ظاهَرَ من امرأته، فرأى خَلْخالَها في ضَوْء القمر، فأعجبَه فوَقَع عليها، فأتى النبيَّ ﷺ، فذكر ذلك له، فقال: "قال الله ﷿: ﴿مِنْ قَبْلِ أَنْ يَتَمَاسَّا﴾ [المجادلة: 3] "، فقال: قد كان ذلك، فقال رسول الله ﷺ: "أمسِكْ حتى تُكفِّرَ" (1).

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that a man made zihar against his wife, then on a moonlit night he saw her anklet, it pleased him, and he had intercourse with her. Then he came to the Prophet (peace and blessings be upon him) and mentioned the whole matter. He (peace and blessings be upon him) said: "Allah, the Mighty and Majestic, says: 'Before they touch one another' [Surah al-Mujadilah: 3]." He said: "(Intercourse on my part) has already happened." So the Messenger of Allah (peace and blessings be upon him) said: "Now refrain (from further intimacy) until you have paid the expiation."

(1) صحيح بطرقه وشاهده كسابقه، وهذا إسناد ضعيف لضعف إسماعيل بن مسلم - وهو المكي - فهو ضعيف كما أشار إليه الذهبي في "تلخيصه"، وقد تقدم قبله من طريق أخرى عن ابن عباس، لكنه اختُلف فيها في الوصل والإرسال كما بيَّنّاه هناك، والحكم بوصله بجملة طرقه غير مستبعد.
Grading: Like the previous one, this hadith is "sahih" by virtue of its routes and its supporting report, but this (particular) chain is "da'if" (weak).
Technical note / Defect ('illah): Its weakness is due to "Isma'il bin Muslim" (al-Makki); he is weak, as al-Dhahabi indicated in "al-Talkhis". This hadith preceded before it through another route from Ibn 'Abbas, but there was disagreement in it over wasl and irsal, as we explained there. Judging it to be "connected" (mawsul) on the strength of all its routes together is not far-fetched.
وأخرجه البيهقي 7/ 386 من طريق إبراهيم بن إسحاق الصيني، عن علي بن هاشم، بهذا الإسناد.
Reference / Source: Al-Bayhaqi (7/ 386) narrated it via Ibrahim bin Ishaq al-Sini, from 'Ali bin Hashim, with this chain.
وأخرجه إسحاق بن راهويه في "مسنده" قسم مسند ابن عباس (773) عن عبد الله بن نمير، والدارقطني (3855) من طريق عبد الرحمن المحاربي، كلاهما عن إسماعيل بن مسلم، به.
Reference / Source: Ishaq bin Rahawayh narrated it in his "Musnad" (the section of Musnad Ibn 'Abbas: 773) from Abd Allah bin Numayr; and al-Daraqutni (3855) via Abd al-Rahman al-Muharibi. Both narrate it from Isma'il bin Muslim, likewise.
