(1) صحيح بطرقه وشاهده، وهذا إسناد ضعيف لضعف حفص بن عمر العَدَني كما قال الذهبي في "تلخيصه"، لكنه قد توبع، وقد اختُلف في وصل هذا الحديث وإرساله، وقد صحَّح وصله الترمذي وابن الجارود وابن حزم والضياء وغيرهم، وحسَّنه الحافظ في "الفتح" 16/ 198، ورجح أبو حاتم والنسائي إرسالَه، لكن يشهد له حديث سلمة بن صخر الذي قبله، والله أعلم.
Grading: This hadith is "sahih" by virtue of its routes and its supporting report, but this (particular) chain is "da'if" (weak).
Technical note / Defect ('illah): Its weakness is due to Hafs bin 'Umar al-'Adani, as al-Dhahabi said in "al-Talkhis", but he has been corroborated. There is disagreement over whether this hadith is "connected or mursal" (wasl and irsal). Al-Tirmidhi, Ibn al-Jarud, Ibn Hazm, al-Diya' and others declared the "connected" version correct, and al-Hafiz declared it hasan in "al-Fath" (16/ 198), whereas Abu Hatim and al-Nasa'i preferred the "mursal" version. However, the preceding hadith of Salamah bin Sakhr supports it (as a shahid). And Allah knows best.
وأخرجه أبو داود (2225 م)، والترمذي (1199)، والنسائي (5622) من طريق معمر بن راشد، عن الحكم بن أبان، به.
Reference / Source: Abu Dawud (2225 M), al-Tirmidhi (1199) and al-Nasa'i (5622) narrated it via Ma'mar bin Rashid, from al-Hakam bin Aban, likewise.
وذكر البيهقي في "السنن الكبرى" 7/ 386 أنَّ سعيد بن كليب قاضي عدن رواه بنحوه عن الحكم بن أبان.
Reference / Source: Al-Bayhaqi mentioned in "al-Sunan al-Kubra" (7/ 386) that the judge of Aden, "Sa'id bin Kulayb", narrated something similar from al-Hakam bin Aban.
وكذلك رواه موصولًا مسلم بن خالد الزنجي عند الطحاوي في "أحكام القرآن" (1959)، وحميد بن حماد بن خوار عن ابن جُرَيج عند الطبراني في "الكبير" (11599)، والوليد بن مسلم عن ابن جُرَيج كما في "علل ابن أبي حاتم" (1307)، كلاهما (مسلم بن خالد وابن جُرَيج) عن الحكم بن أبان، به. وهذه الطرق جميعًا فيها مقال، لكنها تصلح للاعتبار.
Reference / Source: Likewise it was narrated as "connected" (mawsul) by Muslim bin Khalid al-Zanji (al-Tahawi, Ahkam al-Qur'an: 1959); by Humayd bin Hammad bin Khuwar from Ibn Jurayj (al-Tabarani, al-Kabir: 11599); and by al-Walid bin Muslim from Ibn Jurayj (as in 'Ilal Ibn Abi Hatim: 1307). Both of them (Muslim bin Khalid and Ibn Jurayj) narrate it from al-Hakam bin Aban, likewise. All of these routes have some criticism, but they are fit for consideration (i'tibar).
وخالفهم إسماعيلُ ابن عُلَيَّة عند أبي داود (2223)، وسفيان بن عيينة عند أبي داود أيضًا (2221) و (2222)، ومعتمر بن سليمان عند أبي داود (2225)، والنسائي (5624)، ثلاثتهم عن الحكم بن أبان، عن عكرمة مرسلًا.
Technical note / Defect ('illah): They were all contradicted by Isma'il Ibn 'Ulayyah (Abu Dawud 2223), Sufyan bin 'Uyaynah (Abu Dawud 2221 and 2222) and Mu'tamir bin Sulayman (Abu Dawud 2225, al-Nasa'i 5624). All three narrate it from al-Hakam bin Aban, from 'Ikrimah, as "mursal".
وأخرجه أبو داود (2224) من طريق خالد الحذاء، عن مُحدِّثٍ، عن عكرمة مرسَلًا.
Reference / Source: Abu Dawud (2224) narrated it via Khalid al-Hadhdha', from an (unnamed) narrator, from 'Ikrimah, as "mursal".
لكن رواه موصولًا كذلك إسماعيل بن مسلم المكي، عن عمرو بن دينار، عن طاووس، عن ابن عباس، في الطريق التالية، وإسماعيل وإن كان ضعيفًا يكتب حديثه للاعتبار.
Details of the narration: However, it was likewise narrated as "connected" (mawsul) by Isma'il bin Muslim al-Makki, from 'Amr bin Dinar, from Tawus, from Ibn 'Abbas, in the next route. Although Isma'il is weak, his hadith is recorded for consideration (i'tibar).
ويشهد له حديث سلمة بن صخر الذي قبله.
Corroborating chains and supporting reports: And the preceding hadith of Salamah bin Sakhr supports it (as a shahid).
