أخبرَناهُ إسماعيلُ بن محمد بن الفضل، حدثنا جدي، حدثنا عمرو بن عَون، حدثنا شَريك، عن قيس بن وهب، عن أبي الوَدّاك، عن أبي سعيد الخُدْري، رفعه، أنه قال في سبايا أَوطاسٍ: "لا تُوطأُ حاملٌ حتى تَضَعَ، ولا غيرُ ذاتِ حَمْل حتى تَحيضَ حَيضة" (3). هذا حديث صحيح على شرط مسلم، ولم يُخرجاه. It is narrated from Sayyiduna Abu Sa'id al-Khudri (may Allah be pleased with him), attributing it to the Prophet (marfu'), concerning the captive women of the Battle of Awtas, that he (peace and blessings be upon him) said: "A pregnant woman is not to be approached until she gives birth, and one who is not pregnant (is not to be approached) until she has had one menstrual period (so that it is certain the womb is empty)."
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it.

Grading: The chain of this hadith is "hasan" because of "Sharik" (Ibn Abd Allah al-Nakha'i), and al-Hafiz Ibn Hajar declared it hasan in "al-Talkhis al-Habir" (1/ 172). Abu al-Waddak (in the chain) is "Jabr bin Nawf". Reference / Source: Abu Dawud (2157) narrated it from 'Amr bin 'Awn, with this chain. وأخرجه أحمد 17/ (11228) و 18/ (11596) عن يحيى بن إسحاق، و (11596) عن أسود بن عامر، كلاهما عن شريك النخعي، به. Reference / Source: Imam Ahmad narrated it (17/ 11228 and 18/ 11596) from Yahya bin Ishaq, and (11596) from Aswad bin 'Amir; both narrate it from Sharik al-Nakha'i, likewise. وأخرج مسلم (1456) من طريق أبي علقمة الهاشمي، عن أبي سعيد الخُدْري: أنَّ رسول الله ﷺ يوم حنين بعث جيشًا إلى أوطاس، فلقوا عدوًّا، فقاتلوهم فظهروا عليهم، وأصابوا لهم سبايا، فكأنَّ ناسًا من أصحاب رسول الله ﷺ تحرّجوا من غشيانهن من أجل أزواجهن من المشركين، فأنزل الله ﷿: ﴿وَالْمُحْصَنَاتُ مِنَ النِّسَاءِ إِلَّا مَا مَلَكَتْ أَيْمَانُكُمْ﴾ أي: فهن لكم حلال إذا انقضت عدتهن. Reference / Source: Imam Muslim (1456) narrated via Abu 'Alqamah al-Hashimi from Abu Sa'id al-Khudri (may Allah be pleased with him): The Messenger of Allah (peace and blessings be upon him), on the day of Hunayn, sent an army to Awtas. They met an enemy, fought them and overcame them, and took captive women from them. Some of the Companions of the Messenger of Allah (peace and blessings be upon him) felt uneasy about having intercourse with them because their husbands were among the idolaters. So Allah, Mighty and Majestic, revealed: ﴿وَالْمُحْصَنَاتُ مِنَ النِّسَاءِ إِلَّا مَا مَلَكَتْ أَيْمَانُكُمْ﴾ ("And [forbidden are] married women, except those your right hands possess"), meaning: they are lawful for you once their waiting period ('iddah) is complete. ويشهد لرواية شريك مُرسَلا طاووسٍ والشعبيِّ عند عبد الرزاق (12903) و (12904)، وابن أبي شيبة 4/ 369، ورجالهما لا بأس بهم. Corroborating chains and supporting reports: Among the supporting reports for Sharik's narration are the "mursal" narrations of Tawus and al-Sha'bi, found with Abd al-Razzaq (12903 and 12904) and Ibn Abi Shaybah (4/ 369), and there is no harm in their narrators (la ba'sa bihim). ويشهد للنهي عن وطء الحامل حتى تضع حديث ابن عباس المتقدم برقم (2367). Corroborating chains and supporting reports: A supporting report for the prohibition of intercourse with a pregnant woman until she delivers is the hadith of Ibn 'Abbas that preceded at no.
