Mustadrak al-Hakim — Hadith 2814

حدثنا أبو عبد الله محمد بن يعقوب الحافظ، حدثنا إبراهيم بن عبد الله السَّعدي، أخبرنا يزيد بن هارون. وأخبرنا أبو العباس محمد بن أحمد المحبُوبي بمَرْو، حدثنا سعيد بن مسعود، حدثنا يزيد بن هارون، أخبرنا سعيد بن أبي عَرُوبة. وأخبرنا الحسن بن يعقوب العَدْل، حدثنا يحيى بن أبي طالب، أخبرنا عبد الوهاب بن عطاء، أخبرنا سعيد، عن معمر، عن الزُّهْري، عن سالم، عن أبيه، قال: أسلم غَيلانُ بن سَلَمة الثَّقَفي وعنده عشرُ نِسوةٍ، فأمره النبيُّ ﷺ أن يأخذَ منهن أربعًا (1). هكذا رواه المتقدّمون من أصحاب سعيد: يزيد بن زُريع وإسماعيلُ ابن عُلَيَّة وغُنْدَر والأئمة الحفاظ من أهل البصرة، وقد حكم الإمام مسلم بن الحجّاج أنَّ هذا الحديث ممّا وَهِمَ فيه معمرٌ بالبصرة، فإن رواه عنه ثقةٌ خارجَ البصريين حكمْنا له بالصحة، فوجدتُ سفيان الثَّوْري وعبدَ الرحمن بن محمد المُحارِبي وعيسى بن يونس، وثلاثتُهم كوفيون، حدَّثوا به عن معمر. أما حديث الثَّوْري:
It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that Ghaylan bin Salamah al-Thaqafi (may Allah be pleased with him) accepted Islam while he had ten wives, so the Prophet (peace and blessings be upon him) commanded him to keep only four of them.
The early students of Sa'id, such as Yazid bin Zuray', Isma'il bin Ulayyah, Ghundar and the other hadith masters of Basrah, narrated it in this same way. However, Imam Muslim bin al-Hajjaj ruled that in this hadith Ma'mar fell into error in Basrah, but that if a trustworthy narrator other than the Basrans narrated it from Ma'mar, we would judge it to be sahih. So I found the narrations of Sufyan al-Thawri, Abdur-Rahman bin Muhammad al-Muharibi and Isa bin Yunus (who are Kufans), who narrated it from Ma'mar. As for the hadith of al-Thawri:

(1) حديث صحيح بطرقه وشواهده وبعمل الأئمة به كما قال الترمذي، وهذا إسناد رجاله ثقات لكنه قد أُعِلَّ بالوصل والإرسال كما نبه عليه المصنف بإثره، لأنه تفرَّد بوصله معمر بن راشد، وخالفه أصحاب الزُّهْري، رووه عنه فأرسلوه، فلم يذكروا فيه سالمًا - وهو ابن عبد الله بن عمر بن الخطاب - ولا أباه، وبعضهم يقول فيه عن الزُّهْري: أنه بلغه عن عثمان بن محمد بن أبي سُويد مرسلًا أيضًا، وقد صحَّح الإرسال جماعةٌ منهم البخاريُّ وأبو حاتم وأبو زرعة وغيرهم، وصحَّح الوصل جماعةٌ غير المصنف، منهم ابن حبان وابن حزم والبيهقي وابنُ القطان الفاسي، ومال إليه الحافظ ابن حجر في "التلخيص"، وذكر الدارقطني والبيهقي وابن القطان له متابعةً من طريق سيف بن عُبيد الله الجرمي عن سرَّار بن مجشِّر عن أيوب عن نافع وسالم عن ابن عمر، وسيف وسرار ثقتان، كما قال الذهبي في "الرد على ابن القطان" 1/ 40، وقال: هو غريب جدًّا. قلنا: ونقل البيهقي عن أبي علي النيسابوري أنه رواه أيضًا السُّمَيدع بن واهب عن سرَّار، والسُّميدع هذا ثقة. وقال ابن القيم في "أحكام أهل الذمة" 3/ 376: وبالجملة فشهرة القصة تغني عن إسنادها. وانظر تمام الكلام عليه في "مسند أحمد" 8/ (4609).
Grading: This hadith is "sahih" by virtue of its routes, its supporting reports and the scholars' acting upon it, as al-Tirmidhi said. The narrators of this chain are trustworthy (thiqat), but it has been criticised for "connection versus disconnection (wasl and irsal)", as the author (al-Hakim) pointed out right after it.
Technical note / Defect ('illah): Because Ma'mar bin Rashid is alone in narrating it as "connected" (mawsul), and the companions of al-Zuhri contradicted him, narrating it from him as "mursal" (without mentioning Salim, i.e. Ibn Abd Allah bin 'Umar bin al-Khattab, or his father). Some of them narrate it from al-Zuhri saying that "it reached him from 'Uthman bin Muhammad bin Abi Suwayd", also mursal. A group including al-Bukhari, Abu Hatim and Abu Zur'ah declared the "mursal" version correct, while a group besides the author, including Ibn Hibban, Ibn Hazm, al-Bayhaqi and Ibn al-Qattan al-Fasi, declared the "connected" version correct, and al-Hafiz Ibn Hajar inclined towards it in "al-Talkhis". Al-Daraqutni, al-Bayhaqi and Ibn al-Qattan mentioned a corroboration for it via Sayf bin 'Ubayd Allah al-Jarmi, from Sarrar bin Mujashshir, from Ayyub, from Nafi' and Salim, from Ibn 'Umar. Sayf and Sarrar are both thiqah, as al-Dhahabi said in "al-Radd 'ala Ibn al-Qattan" (1/ 40), and he said: it is very gharib. We say: al-Bayhaqi reported from Abu 'Ali al-Naysaburi that al-Sumayda' bin Wahb also narrated it from Sarrar, and this al-Sumayda' is thiqah. Ibn al-Qayyim said in "Ahkam Ahl al-Dhimmah" (3/ 376): In short, the fame of the story makes its chain unnecessary. See the full discussion of it in "Musnad Ahmad" (8/ 4609).
وأخرجه أحمد 9/ (5558) عن يزيد بن هارون، بهذا الإسناد.

All three narrate it from Ma'mar bin Rashid, likewise.
