Mustadrak al-Hakim — Hadith 2811

حدثنا أبو العباس محمد بن يعقوب، حدثنا الحسن بن علي بن عفّان العامري، حدثنا يحيى بن فَصِيل، حدثنا الحسن بن صالح، عن السُّدِّي، عن عَدي بن ثابت، عن البراء بن عازب، قال: لَقِيتُ خالي ومعه الرايةُ، قلت: أين تريدُ؟ قال: بَعَثَني النبيُّ ﷺ إلى رجلٍ تَزوّج امرأةَ أبيه من بعدِه، فأمرني أن أضربَ عُنقَه (2)
هذا حديث صحيح على شرط مسلم، ولم يُخرجاه. وله شواهد عن عَدِيّ بن ثابت، وعن البراء مِن غير حديث عَدِيِّ بن ثابت:
It is narrated from Sayyiduna al-Bara' bin Azib (may Allah be pleased with him) that he said: I met my maternal uncle (Sayyiduna Abu Burdah bin Niyar, may Allah be pleased with him) while he was carrying a banner. I asked: "Where do you intend to go?" He said: "The Prophet (peace and blessings be upon him) has sent me to a man who, after his father's death, married his father's wife (his stepmother), and he (peace and blessings be upon him) has commanded me to strike off his head."
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it. It also has other supporting reports from Adi bin Thabit and from al-Bara'.

(2) حديث صحيح إن شاء الله، وهذا إسناد لا بأس برجاله غير يحيى بن فَصيل - وهو الغَنوي الكوفي - فحسن في المتابعات والشواهد، وقد توبع. وقد اختُلف على عدي بن ثابت فيه اختلافًا لا يضرُّ كما أشار ابن القيم في "حاشيته على سنن أبي داود" 6/ 266، وسنذكر هذه الخلافات، ليتضح حال الحديث. ومع ذلك فقد ثبت الحديثُ من غير طريق عدي بن ثابت كما سيأتي. وكان قد تقدَّم منا تضعيف هذا الحديث في "مسند أحمد" وغيره بالاضطراب، فيُستدرك من هنا، والله تعالى أعلم. ¤ ¤ قلنا: قد اختلف الرواة على عدي بن ثابت في هذا الحديث؛ فرواه زيد بن أبي أنيسة عند أبي داود (4457)، والنسائي (5465)، والحاكم في الرواية الآتية برقم (8255)، ومحمد بن إسحاق فيما ذكر الترمذي بإثر الحديث (1362)، وعبد الغفار بن القاسم عند أحمد 30/ (18610)، ثلاثتهم عن عدي بن ثابت، عن يزيد بن البراء، عن أبيه البراء. لكن عبد الغفار متروك.
Grading: This hadith is "sahih", in sha' Allah. There is no harm in the narrators of this chain except Yahya bin Fusayl (al-Ghanawi al-Kufi), who is "hasan" in corroborations and supporting reports (mutaba'at and shawahid), and he has been corroborated.
Technical note / Defect ('illah): There is a disagreement over 'Adi bin Thabit in this hadith that does not harm it, as Ibn al-Qayyim indicated in his "Hashiyah 'ala Sunan Abi Dawud" (6/ 266); we will mention these disagreements so that the status of the hadith becomes clear. Moreover, this hadith is also established through routes other than that of 'Adi bin Thabit, as will come. We had earlier declared this hadith weak in "Musnad Ahmad" and elsewhere because of inconsistency (idtirab), so let that be corrected (istidrak) from here, and Allah knows best. The narrators' disagreement over 'Adi bin Thabit is as follows: Zayd bin Abi Unaysah (Abu Dawud 4457, al-Nasa'i 5465, al-Hakim 8255), Muhammad bin Ishaq (mentioned by al-Tirmidhi after 1362), and Abd al-Ghaffar bin al-Qasim (Ahmad 30/ 18610) narrated it from 'Adi bin Thabit, from Yazid bin al-Bara', from his father al-Bara'. But Abd al-Ghaffar is "matruk" (abandoned).
ورواه الربيع بن الركين عند أحمد (18578)، والنسائي (7183)، والحاكم (2812)، والسديُّ عند أحمد (18557)، والنسائي (5464) و (7184)، وابن حبان (4112)، والحاكم كما في هذه الرواية والرواية الآتية برقم (6799)، وسفيان الثَّوري عند البزار في "مسنده" (3795)، وحجاج بن أرطاة عند الروياني في "مسنده" (381)، أربعتهم عن عدي، عن البراء. لم يذكروا فيه يزيد بن البراء. ووقع في رواية حجاج التصريح بسماعه من عدي، وبسماع عدي من البراء، لكن حجاج بن أرطاة ليس بذاك القوي.
Details of the narration: And al-Rabi' bin al-Rukayn (Ahmad 18578, al-Nasa'i 7183, al-Hakim 2812), al-Suddi (Ahmad 18557, al-Nasa'i 5464 and 7184, Ibn Hibban 4112, al-Hakim in the present narration and the coming narration 6799), Sufyan al-Thawri (al-Bazzar 3795) and Hajjaj bin Artah (al-Ruyani 381) narrated it from 'Adi, from al-Bara'. These four did not mention "Yazid bin al-Bara'" in it. In Hajjaj's narration there is an explicit statement of his hearing from 'Adi and of 'Adi's hearing from al-Bara', but Hajjaj bin Artah is not that strong.

Technical note / Defect ('illah): And Ash'ath bin Sawwar narrated it from 'Adi bin Thabit, and there was disagreement over him in it:
فرواه معمر عند أحمد (18626)، والنسائي (7185)، وأبو خالد الأحمر سليمان بن حيان عند الترمذي في "العلل الكبير" (372)، والبيهقي 8/ 237، والفضل بن العلاء عند الطبري في مسند ابن عباس من "تهذيب الآثار" (893)، وأبي نعيم في "معرفة الصحابة" (2047)، ثلاثتهم عن أشعث، عن عدي، عن يزيد، عن أبيه البراء.
Details of the narration: Thus Ma'mar (Ahmad 18626, al-Nasa'i 7185), Abu Khalid al-Ahmar (al-Tirmidhi, al-'Ilal al-Kabir 372, al-Bayhaqi 8/ 237) and al-Fadl bin al-'Ala' (al-Tabari, Tahdhib al-Athar 893, Abu Nu'aym, Ma'rifat al-Sahabah 2047) narrated it from Ash'ath, from 'Adi, from Yazid, from his father al-Bara'.
ورواه هُشَيم عند أحمد (18579)، وابن ماجه (2607)، وحفص بن غياث عند ابن ماجه (2607)، والترمذي (1362)، كلاهما عن أشعث، عن عدي، عن البراء. ليس فيه يزيد، قال الترمذي: حسن غريب.
Details of the narration: And Hushaym (Ahmad 18579, Ibn Majah 2607) and Hafs bin Ghiyath (Ibn Majah 2607, al-Tirmidhi 1362) narrated it from Ash'ath, from 'Adi, from al-Bara' (Yazid is not mentioned in it). Al-Tirmidhi said: it is "hasan gharib".
ورواه خالد الواسطي فيما ذكر الدارقطني في "العلل" 6/ 21 عن أشعث، عن عدي بن ثابت، عن يزيد بن البراء، عن خاله. ليس فيه البراء، وهذا من سوء حفظ أشعث بن سوار.
Technical note / Defect ('illah): And Khalid al-Wasiti narrated it (as cited by al-Daraqutni, al-'Ilal 6/ 21) from Ash'ath, from 'Adi, from Yazid bin al-Bara', from his "maternal uncle" (al-Bara' is not mentioned in it). This is due to the "poor memory" (su' al-hifz) of Ash'ath bin Sawwar.
وقد رجح أبو حاتم الرازي كما في "العلل" لابنه (1207) الرواية التي فيها يزيد بن البراء، ولم يرجح البخاري أيًّا من الروايتين، فيما نقل عنه الترمذي في "العلل الكبير" ص 209 قال: سألت محمدًا عن هذا الحديث فقال: إن معمرًا روى هذا الحديث فقال: عن عدي بن ثابت عن يزيد بن البراء عن أبيه، ولم يذكر فيه أيَّ الروايات أصح. وكذا لم يرجح شيئًا أبو زرعة كما في "العلل" لابن أبي حاتم (1277)، والدارقطني في "العلل" (951).
Technical note / Defect ('illah): Abu Hatim al-Razi (al-'Ilal 1207) preferred the narration that mentions "Yazid bin al-Bara'". Imam al-Bukhari did not prefer either narration, as al-Tirmidhi reported in "al-'Ilal al-Kabir" (p. 209). Likewise, neither Abu Zur'ah (al-'Ilal of Ibn Abi Hatim 1277) nor al-Daraqutni (al-'Ilal 951) preferred either one.
وذهب ابنُ حزم في "المحلى" 11/ 253 إلى أن كلا الطريقين صحيح، فقال: هذه آثار صحاح تجب بها الحجة، ولا يضرُّها أن يكون عدي بن ثابت حدث به مرة عن البراء، ومرة عن يزيد بن البراء عن أبيه، فقد يسمعه من البراء ويسمعه من يزيد بن البراء، فيحدث به مرةً عن هذا، ومرةً ¤ ¤ عن هذا. انتهى، وهذا صحيح لو ثبت في رواية صحيحة تصريح عدي بن ثابت بسماعه من البراء، مع أن سماعه من البراء وروايته عنه في "الصحيحين" في غير هذا الحديث، والله تعالى أعلم.
Grading: Ibn Hazm held in "al-Muhalla" (11/ 253) that both routes are sahih. He said that these are sahih reports by which proof is established, and it does no harm that 'Adi bin Thabit narrated it once from al-Bara' and once from Yazid bin al-Bara'; he may have heard it from both. This would be correct if 'Adi bin Thabit's explicit hearing from al-Bara' were established in a sahih narration, although his hearing from al-Bara' and his narrating from him are found in the two Sahihs in hadiths other than this one. And Allah knows best.
واختُلف فيه أيضًا اختلاف آخر لا يقدح في صحة الحديث، وهو أنَّ بعضهم يقول فيه: عمي، بدل خالي، ورجّح أبو زرعة الرازي أنَّ الصحيح فيه ذكر خاله، وهو أبو بُردة بن نِيار، كما نقله عنه ابن أبي حاتم في "العلل" (1277)، وقال العُقيلي في "الضعفاء" 2/ 257: روي عن البراء بن عازب عن عمِّه أبي بُردة بن نِيار: قال: بعثني النبي ﷺ إلى رجل أَعْرَسَ بامرأة أبيه أن أضرب عنقه، بإسناد صالح.
Technical note / Defect ('illah): There is also another disagreement in it that does not affect the authenticity of the hadith, namely that some say "my paternal uncle" ('ammi) instead of "my maternal uncle" (khali). Abu Zur'ah al-Razi preferred that the correct version mentions the "maternal uncle", and he is "Abu Burdah bin Niyar". Al-'Uqayli said in "al-Du'afa'": It is narrated from al-Bara' bin 'Azib from his paternal uncle Abu Burdah bin Niyar that the Prophet (peace and blessings be upon him) sent me to a man who had married his father's wife, to strike his neck; and its chain is "salih" (fair).
وسيأتي عند المصنف برقم (2813) و (8254) من طريق أبي الجهم سليمان بن الجهم عن البراء. وإسناده حسن.
Details of the narration: This narration will come later with the author (al-Hakim) at nos. (2813) and (8254) via Abu al-Jahm Sulayman bin al-Jahm from al-Bara' (may Allah be pleased with him). And its chain is "hasan".
وفي الباب عن معاوية بن قرة بن إياس المزني عن أبيه: أنَّ رسول الله ﷺ بعث أباه إلى رجل عرّس بامرأة أبيه فضرب عنقه وخمّس مالَه. أخرجه ابن ماجه (2608)، والنسائي (7186)، واللفظُ له. والظاهر أنَّ قرة إنما كان في هذه الواقعة بصحبة خال البراء، والله تعالى أعلم.
Corroborating chains and supporting reports: And in this chapter there is also the narration of Mu'awiyah bin Qurrah bin Iyas al-Muzani from his father, that the Messenger of Allah (peace and blessings be upon him) sent his father to a man who had married his father's wife, and he struck his neck and took a fifth of his wealth. Ibn Majah (2608) and al-Nasa'i (7186) narrated it, and the wording is al-Nasa'i's. It appears that Qurrah (may Allah be pleased with him) was, in this incident, accompanying al-Bara''s maternal uncle. And Allah knows best.
وقال ابن معين فيما نقله عنه ابن حزم في "المحلى" 11/ 253: هذا الحديث صحيح، ومن رواه فأوقفه على معاوية فليس بشيء، قد كان ابن إدريس - يعني أحد رواته - أرسله لِقوم وأسنده لآخرين.
Grading: Ibn Ma'in said (as cited in Ibn Hazm's al-Muhalla 11/ 253): This hadith is "sahih", and whoever narrated it as "mawquf" on Mu'awiyah, his version counts for nothing. Ibn Idris (one of its narrators) narrated it as "mursal" to some people and as "musnad" to others.
