Mustadrak al-Hakim — Hadith 2810

أخبرَناه أبو عبد الله محمد بن عبد الله الصَّفّار، حدثنا أبو إسماعيل محمد بن إسماعيل السُّلمي، حدثنا سعيد بن كَثير بن عُفَير وسعيد بن أبي مريم، قالا: حدثنا الليث بن سعد، عن يحيى بن سعيد، عن حُميد بن نافع، عن أم كُلثوم بنت أبي بكر، قالت: كان الرجالُ نُهوا عن ضَرْب النساءِ، ثم شَكَوهُنَّ إِلى رسول الله ﷺ، فخلَّى بينهم وبين ضربِهنَّ (3)، ثم قال: "لقد أطافَ الليلةَ بآل محمد ﷺ سبعونَ امرأةً كلُّهن قد ضُربتْ". قال يحيى: وحسبتُ أنَّ القاسم قال: ثم قيل لهم بعدُ: "ولن يَضربَ خِيارُكم" (1).
It is narrated from Umm Kulthum bint Abi Bakr (may Allah be pleased with her) that men had been forbidden to strike women. Then the men complained about the women to the Messenger of Allah (peace and blessings be upon him), so he (peace and blessings be upon him) allowed them to strike them. Then he (peace and blessings be upon him) said: "Tonight seventy women gathered around the household of Muhammad (peace and blessings be upon him), all of whom had been beaten." Yahya said: I think al-Qasim also said that after this they were told: "The best among you will never strike."

(3) في (ز) و (ص) و (ع): ضربهم، والمثبت من (ب) و"تلخيص الذهبي"، وهو الجادّة.
Note / Clarification: In manuscripts (Z), (S) and ('A) it is "darabahum", while we have established the text from manuscript (B) and al-Dhahabi's "Talkhis", and this is the well-trodden form (jaddah).

(1) رجاله ثقات، وهو مرسل، لأنَّ أم كلثوم بنت أبي بكر - وهو الصدِّيق - ولدت بعد وفاة أبيها الصدّيق ﵁. يحيى بن سعيد: هو الأنصاري.
Grading: Its narrators are trustworthy (thiqat), but it is "mursal".
Technical note / Defect ('illah): Because Umm Kulthum bint Abi Bakr (al-Siddiq) was born after the death of her father Abu Bakr al-Siddiq (may Allah be pleased with him). Yahya bin Sa'id (in the chain) is "al-Ansari".
وأخرجه البيهقي 7/ 304 عن أبي عبد الله الحاكم بهذا الإسناد.
Reference / Source: Al-Bayhaqi (7/ 304) narrated it from Abu Abd Allah al-Hakim with this same chain.

Reference / Source: Al-Bayhaqi (7/ 304) narrated it via Yahya bin Bukayr, from al-Layth bin Sa'd, likewise.
وأخرجه إسحاق بن راهويه في "مسنده" (2217) عن جرير بن عبد الحميد، عن يحيى بن سعيد الأنصاري، به. وزاد في حديثه: فقال رسول الله ﷺ: "ما أُحبُّ أن أَرى الرجلَ ثائرًا غضبُه فريصًا رقبتُه على مُرَيَّتِه يقتلُها".
Reference / Source: Ishaq bin Rahawayh narrated it in his "Musnad" (2217) from Jarir bin Abd al-Hamid, from Yahya bin Sa'id al-Ansari, likewise.
Details of the narration: And in his narration he added that the Messenger of Allah (peace and blessings be upon him) said: "I do not like to see a man with his anger flaring and the veins of his neck swollen, set upon his young wife (murayyah), wanting to kill her."
وأخرجه مقتصرًا على هذه الزيادة الحسن بن سفيان في "مسنده"، كما في "الإصابة" لابن حجر 8/ 296، وأبو نعيم الأصبهاني في "معرفة الصحابة" (8021) من طريق قتيبة بن سعيد، عن الليث بن سعد، به.
Reference / Source: Al-Hasan bin Sufyan narrated it in his "Musnad" (as cited in Ibn Hajar's "al-Isabah": 8/ 296), and Abu Nu'aym al-Asbahani in "Ma'rifat al-Sahabah" (8021), limited to this addition only, via Qutaybah bin Sa'id, from al-Layth bin Sa'd.
وأخرجه مقتصِرًا عليها أيضًا ابن سعد في "الطبقات الكبرى" 10/ 194 من طريق سليمان بن بلال، وابن أبي الدنيا في "النفقة على العيال" (489) من طريق سفيان بن عيينة، كلاهما عن يحيى بن سعيد الأنصاري، به.
Reference / Source: Ibn Sa'd narrated it in "al-Tabaqat al-Kubra" (10/ 194) via Sulayman bin Bilal, and Ibn Abi al-Dunya in "al-Nafaqah 'ala al-'Iyal" (489) via Sufyan bin 'Uyaynah, limited to this addition only. Both of them narrate it from Yahya bin Sa'id al-Ansari, likewise.
