(1) غريب من حديث أبي حَصين عن أبي بُردة، فقد انفرد بروايته عن أبي حَصين أبو بكر بن عياش، وانفرد عنه خالد بن يزيد، وعن خالد انفرد أبو شيبة، وهؤلاء الثلاثة الذين رووه عن أبي شيبة كلهم مُتكلَّم فيه بكلام لا يصحُّ معه الاعتماد على روايتهم، أما صالح بن أحمد فيَسرق الحديث، وأما أبو العباس الأزهري - وهو أحمد بن محمد بن الأزهر - فقد اتهمه ابن حبان وضعَّفه الدارقطني وقال عنه: منكر الحديث، وأما يعقوب بن خليفة بن حسان الأُبُلّي فقد روى عنه الطبراني وابن عدي وأبو علي الحافظ، ولم يُؤثَر فيه توثيق.
Grading: This narration is "gharib" via Abu Hasin from Abu Burdah.
Technical note / Defect ('illah): Its chain has successive solitary transmission (infirad): only Abu Bakr bin Ayyash narrated it from Abu Hasin, only Khalid bin Yazid from him, and only Abu Shaybah from Khalid.
Important point: The three narrators who narrate it from Abu Shaybah have all been criticised: Salih bin Ahmad is known for stealing hadith (sariqah); Abu al-Abbas al-Azhari (Ahmad bin Muhammad) was accused by Ibn Hibban and declared weak by al-Daraqutni, who called him "munkar al-hadith"; and for Ya'qub bin Khalifah no declaration of trustworthiness is found.
(2) أخرجه عبد الرزاق (10476)، وابن المنذر في "الأوسط" (7182)، وهو عن عليٍّ من قوله، موقوفًا عليه.
Reference / Source: Abd al-Razzaq (10476) and Ibn al-Mundhir in "al-Awsat" (7182) recorded it, and it is the statement of Ali (may Allah be pleased with him) himself (i.e. the narration is "mawquf").
(3) أخرجه أحمد 4/ (2260)، وابن ماجه (1880) وغيرهما من حديث ابن عباس مرفوعًا. وهو صحيح.
Grading: This hadith of Ibn Abbas (may Allah be pleased with them both) is narrated as "marfu'" and is "sahih", as found in Ahmad (4/2260), Ibn Majah (1880) and others.
(4) أخرجه الخطيب في "تاريخ بغداد" 3/ 541، ومن طريقه ابن الجوزي في "التحقيق" (1700)، وفي "العلل المتناهية" (1024) من حديث معاذ بن جبل، رفعه: "أيما امرأة زوَّجَتْ نفسها من غير إذن وليٍّ فهي زانية". وفيه أبو عصمة نوح بن أبي مريم، وهو متهم بالكذب.
Reference / Source: Al-Khatib al-Baghdadi recorded it in "Tarikh Baghdad" (3/541), and via him Ibn al-Jawzi in "al-Tahqiq" (1700) and in "al-'Ilal al-Mutanahiyah" (1024), from Mu'adh bin Jabal (may Allah be pleased with him) as "marfu'", with the wording: "Any woman who marries herself off without her guardian's permission is a fornicator."
Technical note / Defect ('illah): Its chain contains "Nuh bin Abi Maryam" (Abu Ismah), who is accused of lying.
(1) تحرَّف في (ز) إلى: عمرو. ويؤيد كونه تحريفًا أنه سيأتي ذكر عبد الله بن عمرو بعد قليل.
Technical note / Defect ('illah): In manuscript (Z) this name has been distorted into "Amr"; that it is a distortion is supported by the fact that "Abd Allah bin Amr" is mentioned shortly afterwards.
وأخرج حديثه العقيلي في "الضعفاء" (1255)، وابن عدي في "الكامل" 1/ 365، وتمّام في "فوائده" (1437)، وابن الأعرابي في "معجمه" (1171)، والدارقطني (3532)، وابن عدي 2/ 94، وابن الجوزي في "التحقيق" (1696) من طريقين عن نافع عن ابن عمر، مرفوعًا. والإسنادان فيهما ضعف.
Reference / Source: This marfu' narration of Ibn Umar was recorded by al-Uqayli in "al-Du'afa'" (1255), Ibn Adi in "al-Kamil" (1/365 and 2/94), Tammam al-Razi in his "Fawa'id" (1437), Ibn al-A'rabi in his "Mu'jam" (1171), al-Daraqutni (3532) and Ibn al-Jawzi in "al-Tahqiq" (1696), via two routes from Nafi'.
Grading: Both of these chains contain weakness.
(2) نسبه السيوطي في "الجامع الكبير" 2/ 646 لابن عساكر ضمن حديث مطوّل لأبي ذر في عدة وصايا الرسول ﷺ، وذكر منها: "يا أبا ذر إنه لا يحل فرج إلّا من وجهين: نكاح المسلمين بولي وشاهدي عدل، أو فرجٌ تملك رقبته". ولم نقف عليه عند ابن عساكر في "تاريخ دمشق" مسندًا.
Reference / Source: Al-Suyuti in "al-Jami' al-Kabir" (2/646) attributed it to Ibn Asakir, as part of a lengthy hadith of Abu Dharr (may Allah be pleased with him) containing counsels, in which it is mentioned: "O Abu Dharr, private parts become lawful only in two ways: the marriage of the Muslims with a guardian and two upright witnesses, or a slave-woman whom you come to own."
Note / Clarification: We could not find this narration with a chain in Ibn Asakir's "Tarikh Dimashq".
(3) أخرجه ابن عساكر في "تاريخ دمشق"، كما في "مختصره" لابن منظور 27/ 5 في ترجمة هارون الرشيد، من طريقه عن جده المنصور، عن أبيه محمد بن علي، عن أبي هاشم عبد الله بن محمد بن علي بن أبي طالب، عن المقداد.
Reference / Source: Ibn Asakir recorded it in "Tarikh Dimashq", as mentioned in Ibn Manzur's "Mukhtasar Tarikh Dimashq" (27/5) in the biography of Harun al-Rashid, where Harun al-Rashid narrates from his grandfather al-Mansur, he from his father Muhammad bin Ali, he from Abu Hashim Abd Allah, and he from al-Miqdad (may Allah be pleased with him).
(4) أخرجه ابن عدي 4/ 134، والدارقطني (3531)، وإسناده ضعيف جدًّا.
Reference / Source: Ibn Adi (4/134) and al-Daraqutni (3531) recorded it,
Grading: and its chain is "very weak" (da'if jiddan).
(5) أخرجه أبو يعلى في "مسنده الكبير" كما في "إتحاف الخيرة المهرة" للبوصيري (3306/ 7) و (3354/ 3)، وعنه ابن عدي في "الكامل" 6/ 18 عن محمد بن المنهال الضرير، عن أبي بكر الحنفي، عن ابن أبي ذئب، عن عطاء، عن جابر، وإسناده صحيح، لكن قال أبو يعلى فيما نقله عنه ابن عدي: هذا الحديث في كتابي في موضعين، في موضع ليس فيه: "ولا نكاح إلّا بولي".
Reference / Source: Abu Ya'la recorded it in his "al-Musnad al-Kabir" (as in al-Busiri's "Ithaf al-Khiyarah al-Maharah" 3306/7 and 3354/3), and from him Ibn Adi in "al-Kamil" (6/18), from Muhammad bin al-Minhal al-Darir, from Abu Bakr al-Hanafi, from Ibn Abi Dhi'b, from Ata', from Jabir.
Grading: Its chain is "sahih".
Technical note / Defect ('illah): Abu Ya'la said (as Ibn Adi quoted from him): "This hadith is in my book in two places, and in one of them the words 'there is no marriage without a guardian' are absent."
(6) أخرجه ابن حبان (4076) من طريق أبي عامر الخزاز، عن محمد بن سيرين، عن أبي هريرة، رفعه بلفظ: "لا نكاح إلّا بولي"، وأخرجه ابن ماجه (1882) من طريق هشام بن حسان، عن محمد بن سيرين، عن أبي هريرة، رفعه، بلفظ: "لا تُزوِّج المرأةُ المرأةَ، ولا تُزوّج المرأةُ نفسها … "، وهو صحيح بهذا اللفظ الثاني.
Reference / Source: Ibn Hibban (4076) recorded it via Abu Amir al-Khazzaz, from Muhammad bin Sirin, from Abu Hurayrah as "marfu'" with the wording: "There is no marriage without a guardian." Also Ibn Majah (1882) recorded it via Hisham bin Hassan, from Muhammad bin Sirin, from Abu Hurayrah as marfu', with the wording: "A woman may not give another woman in marriage, nor may a woman give herself in marriage."
Grading: This hadith is "sahih" with this second wording.
(7) أخرجه عبد الرزاق (10473)، والرُّوياني في "مسنده" (83)، والعقيلي في "الضعفاء" (863)، والطبراني في "الكبير" 18/ (299)، وتمام في "فوائده" (1476)، والبيهقي في "معرفة السنن والآثار" (13633)، وفي "السنن الكبرى" 7/ 125، وإسناده ضعيف جدًّا.
Reference / Source: Abd al-Razzaq (10473), al-Ruyani in his "Musnad" (83), al-Uqayli in "al-Du'afa'" (863), al-Tabarani in "al-Mu'jam al-Kabir" (18/299), Tammam al-Razi in his "Fawa'id" (1476), and al-Bayhaqi in "Ma'rifat al-Sunan wa al-Athar" (13633) and "al-Sunan al-Kubra" (7/125) recorded it.
Grading: Its chain is "very weak".
(8) أخرجه الطبراني في "الكبير" (14334)، وأبو نعيم في "الحلية" 3/ 321. ولفظه كلفظ حديث عائشة المتقدم برقم (2742)، وإسناده ضعيف جدًّا.
Reference / Source: Al-Tabarani recorded it in "al-Mu'jam al-Kabir" (14334) and Abu Nu'aym in "al-Hilyah" (3/321).
Details of the narration: Its wording is like that of the earlier hadith of Aishah (may Allah be pleased with her) (number 2742).
Grading: Its chain is "very weak".
(1) ذكره الدارقطني في "علله" 13/ 250، وأشار إلى أن المحفوظ في إسناده حديث عائشة؛ يشير إلى حديثها الذي تقدم برقم (2742).
Technical note / Defect ('illah): Al-Daraqutni mentioned it in "al-'Ilal" (13/250) and indicated that what is "mahfuz" (preserved) in its chain is the hadith of Aishah (may Allah be pleased with her), i.e. the one that passed at number 2742.
(2) أخرجه ابن عدي في "الكامل" 1/ 527 و 4/ 9 و 8/ 408 بإسنادين ضعيفين جدًّا.
Reference / Source: Ibn Adi recorded it in "al-Kamil" (1/527, 4/9 and 8/408) with two different chains.
Grading: Both of these chains are "very weak".
(3) تقدم حديثها قريبًا برقم (2742).
Note / Clarification: Her (Aishah's, may Allah be pleased with her) hadith passed just recently at number (2742).
(4) لم نقف عليه، ولعله يريد قصة تزويج عمر بن أبي سلمة أمَّه برسول الله ﷺ، وسيأتي برقم (2769)، وعمر كان رجلًا كما بيَّنه ابن عبد الهادي في "التنقيح" 4/ 320 بإثر (2708)، وكذلك قال الذهبي في "تنقيحه" 2/ 177.
Technical note / Defect ('illah): We could not find this narration; perhaps it refers to the story of Umar bin Abi Salamah (may Allah be pleased with him) giving his mother (Umm Salamah) in marriage to the Messenger of Allah (peace and blessings be upon him), which will come at number (2769).
Important point: Umar bin Abi Salamah was a man (an adult) at that time, as Ibn Abd al-Hadi made clear in "al-Tanqih" (4/320) and al-Dhahabi in his "Tanqih" (2/177).
(5) يشير إلى حديث أنس بن مالك الذي أخرجه البخاري برقم (7421) وفيه: فكانت تفخر على نساء النبي ﷺ، وكانت تقول: إنَّ الله أنكحني في السماء. قال البيهقي في "المعرفة" (13558): في قصة تزويج زينب بنت جحش ونزول الآية فيها دلالة على صحة ذلك، والله أعلم. قلنا: يعني صحة القول باشتراط الولي.
Reference / Source: This refers to the hadith of Anas bin Malik (may Allah be pleased with him) recorded by al-Bukhari at (7421), which mentions that Zaynab bint Jahsh (may Allah be pleased with her) used to take pride over the other wives of the Prophet (peace and blessings be upon him), saying: "Allah married me off in the heavens."
General principle: Al-Bayhaqi says in "al-Ma'rifah" (13558) that the story of the marriage of Zaynab (may Allah be pleased with her) and the verse revealed about it contain evidence for the soundness of this (i.e. the requirement of a guardian).
