Mustadrak al-Hakim — Hadith 2750

حدَّثَناه أبو علي الحافظ، أخبرنا أبو جعفر محمد بن أحمد (2) الضُّبَعي ببغداد، حدثنا محمد بن سهل بن عَسكَر، حدثنا قَبيصة بن عُقْبة، حدثنا يونس بن أبي إسحاق، عن أبي بُرْدة، عن أبي موسى، عن النبي ﷺ قال: "لا نَكَاحَ إلّا بوليّ" (3). قال ابنُ عَسكَر: فقال لي قَبيصة بن عُقبة: جاءني علي بن المَديني، فسألني عن هذا الحديث، فحدثتُه به، فقال علي بن المديني: قد استرحْنا مِن خلاف أبي إسحاق. قال الحاكم: ليس أعلمُ بين أئمة هذا العلم خلافًا على عدالة يونس بن أبي إسحاق، وأنَّ سماعه من أبي بردة مع أبيه صحيح، ثم لم يُختلَف على يونس في وَصْل هذا الحديث، ففيه الدليل الواضحُ أنَّ الخلاف الذي وقع على أبيه فيه من جهة أصحابه، لا من جهة أبي إسحاق، والله أعلم. وممَّن وَصَلَ هذا الحديث عن أبي بُرْدة نفسِه أبو حَصِين عثمان بن عاصم الثقفي:
It is narrated from Sayyiduna Abu Musa al-Ash'ari (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: "There is no marriage without a guardian."
Qabisah bin Uqbah narrates that Ali bin al-Madini asked him about this hadith, so he narrated it to him, whereupon he said: "We are now relieved of the disagreement over Abu Ishaq (the debate over whether it is mursal or connected)." Imam al-Hakim says: There is no disagreement among the experts of this field about the integrity ('adalah) of Yunus bin Abi Ishaq, and his hearing from Abu Burdah together with his father is sound; this is therefore clear evidence that the disagreement came from the side of Abu Ishaq's students, not from Abu Ishaq himself.

(2) وقع اسم هذا الرجل في النسخ الخطية: أبو جعفر بن محمد بن أحمد الضبعي، بزيادة لفظة "ابن" بين أبي جعفر ومحمد وهي مُقحمة، لم ترد في رواية البيهقي في "سننه الكبرى" 7/ 109 فقد رواه عن الحاكم من كتاب "المستدرك"، ونقله كذلك عن البيهقي ابنُ عبد الهادي في "تنقيح التحقيق" (2673). وهذا الرجل لم نتبين من هو على اليقين.
Technical note / Defect ('illah): In the manuscripts this man's name is written "Abu Ja'far bin Muhammad bin Ahmad al-Dab'i", i.e. with the word "Ibn" added between "Abu Ja'far" and "Muhammad", which is an interpolation (muqham).
Important point: This word is absent in al-Bayhaqi's "al-Sunan al-Kubra" (7/109) and in Ibn Abd al-Hadi's "Tanqih al-Tahqiq" (2673), and we have not been able to establish with certainty who this man is.
(3) حديث صحيح، وهذا إسناد حسن كسابقه.
Grading: This hadith is "sahih", and this chain too is "hasan", like the previous one.
وأخرجه البيهقي 7/ 109 عن أبي عبد الله الحاكم، بهذا الإسناد.
Reference / Source: Al-Bayhaqi (7/109) recorded it from Abu Abd Allah al-Hakim, with this same chain.
