Mustadrak al-Hakim — Hadith 2749

أخبَرَناه أبو بكر أحمد بن سلمان الفقيه، حدثنا الحارث بن محمد، حدثنا الحسن بن قُتيبة (1)، حدثنا يونس بن أبي إسحاق. وأخبرني أبو قُتيبة سَلْم بن الفضل الأَدَمي بمكة، حدثنا القاسم بن زكريا المقرئ، حدثنا الحسن بن محمد بن الصبّاح، حدثنا أسباط بن محمد (2)، حدثنا يونس بن أبي إسحاق، عن أبي بُردة، عن أبي موسى قال: قال رسول الله ﷺ: "لا نِكَاحَ إلّا بوليّ" (1).
It is narrated from Sayyiduna Abu Musa al-Ash'ari (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "There is no marriage without a guardian."

(1) سقط من (ز) و (ص) و (ع) بعد الحسن بن قتيبة ذكرُ يونس بن أبي إسحاق، فصار الإسناد فيهما: حدثنا الحسن بن قتيبة، حدثنا مسلم بن الفضل … فأوهم ذلك اتصال هذا الإسناد بالذي يليه، فصار كأنه إسناد واحد، وقد استدركنا هذا السقط من (ب) و"السنن الكبرى" للبيهقي، حيث رواه عن الحاكم بإسناديه، ومن "إتحاف المهرة" للحافظ (12295).
Technical note / Defect ('illah): In manuscripts (Z), (S) and ('A), the mention of "Yunus bin Abi Ishaq" after "al-Hasan bin Qutaybah" has dropped out (saqt), so that in these manuscripts the chain became "al-Hasan bin Qutaybah narrated to us: Muslim bin al-Fadl narrated to us". Because of this omission, the false impression arose that this chain was joined to the following one, becoming a single chain.
Important point: We have restored this omission from manuscript (B), from al-Bayhaqi's "al-Sunan al-Kubra" (where he narrated it from al-Hakim with both of his chains), and from al-Hafiz Ibn Hajar's "Ithaf al-Maharah" (12295).

(2) وقع في النسخ الخطية و"إتحاف المهرة": أسباط بن نصر، وهو خطأ صوَّبناه من رواية البيهقي في "سننه الكبرى" 7/ 107، حيث رواه عن أبي عبد الله الحاكم بإسناديه المذكورين، ونَصَّ على أنه في كتابه "المستدرك"، وكذلك وقع على الصواب في نسخة ابن القيم من "مستدرك الحاكم"، حيث أشار في "حاشيته على سنن أبي داود" 3/ 31 إلى رواية الحاكم هذه من طريق الحسن بن محمد بن الصبّاح، فقال: عن أسباط بن محمد.
Technical note / Defect ('illah): In the manuscripts and in "Ithaf al-Maharah" the narrator's name is written "Asbat bin Nasr", which is an error. We have corrected it from al-Bayhaqi's "al-Sunan al-Kubra" (7/107), where he narrated it from al-Hakim with both of his chains and stated that it is so in al-Hakim's book "al-Mustadrak".
Important point: In Ibn al-Qayyim's copy of "al-Mustadrak" too the name was correctly "Asbat bin Muhammad", as he made clear in his "Hashiyah 'ala Sunan Abi Dawud" (3/31) when referring to this narration of al-Hakim via al-Hasan bin Muhammad bin al-Sabbah.
وأسباط بن محمد هذا: هو ابن عبد الرحمن القرشي مولاهم، وهو ثقة إلّا في الثَّوري، وأما أسباط بن نصر: فهو الهَمْداني، وهو صدوق حسن الحديث، والحسن بن محمد بن الصبّاح معروف بالرواية عن أسباط بن محمد، وهذا يؤكد على أنَّ ما وقع في الأصلين و"الإتحاف" خطأ، وممّا يزيد الأمر تأكيدًا أنَّ أحمد روى هذا الحديث بعينه عن أسباط بن محمد، فاتضح الأمر وبان، والله الموفق.
Technical note / Defect ('illah): "Asbat bin Muhammad" here is Ibn Abd al-Rahman al-Qurashi, who is "thiqah" (except in his narrations from Sufyan al-Thawri), whereas "Asbat bin Nasr" is al-Hamdani, who is "saduq, hasan al-hadith". Since al-Hasan bin Muhammad bin al-Sabbah is well known for narrating from Asbat bin Muhammad, this confirms that what appears in the base manuscripts and in "al-Ithaf" is an error.
Corroborating chains and supporting reports: This is further confirmed by the fact that Ahmad narrated this very hadith from Asbat bin Muhammad, which makes the matter clear.

Grading: This hadith is "sahih", and this chain is "hasan" because of Yunus bin Abi Ishaq.
Corroborating chains and supporting reports: His father Abu Ishaq and other narrators have corroborated him.
Note / Clarification: The narration of Yunus from his father, and his father from Abu Burdah, has already passed at number (2746), where we mentioned that it is not unlikely that Yunus narrated it both ways (directly and through an intermediary).
وأخرجه أحمد 32/ (19710) عن أسباط بن محمد، بهذا الإسناد.
Reference / Source: Ahmad recorded it in "al-Musnad" (32/19710) from Asbat bin Muhammad (al-Qurashi), with this same chain.
وأخرجه أحمد (19746)، وأبو داود (2085) من طريق أبي عبيدة عبد الواحد بن واصل الحداد، عن يونس بن أبي إسحاق، به.
Reference / Source: Ahmad (19746) and Abu Dawud (2085) recorded it via Abu Ubaydah Abd al-Wahid bin Wasil al-Haddad, from Yunus bin Abi Ishaq.
