Mustadrak al-Hakim — Hadith 2744

حدثنا أبو بكر أحمد بن كامل القاضي وأبو أحمد بكر بن محمد الصَّيرَفي، قالا: حدثنا أبو قِلابة بن عبد الملك بن محمد الرَّقَاشي. وأخبرني مَخْلَد بن جعفر الباقَرْحِي، حدثنا إبراهيم بن هاشم البَغَوي؛ قالا: حدثنا سليمان بن داود، حدثنا النعمان بن عبد السلام، عن شعبة وسفيان الثَّوْري، عن أبي إسحاق، عن أبي بُرْدة، عن أبي موسى، أنَّ رسول الله ﷺ قال: "لا نِكاحَ إلّا بَوليٍّ" (1). وقد جمع النعمانُ بن عبد السلام بين الثَّوْري وشعبة في إسناد هذا الحديث، ووَصَلَه عنهما، والنعمان بن عبد السلام ثقة مأمون (1). وقد رواه جماعة من الثقات عن الثَّوْري على حِدَة، وعن شعبة على حِدَة، فوصلوه، وكل ذلك مَخرَجُه في الباب الذي سمعه مني أصحابي، فأغنى ذلك عن إعادتها. فأما إسرائيل بن يونس بن أبي إسحاق الثقة الحُجَّة في حديث جده أبي إسحاق، فلم يُختلَف عنه في وصل هذا الحديث:
It is narrated from Sayyiduna Abu Musa al-Ash'ari (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "There is no marriage without a guardian."
Al-Nu'man bin Abd al-Salam combined both Sufyan al-Thawri and Shu'bah in the chain of this hadith and narrated it from them as connected (muttasil), and al-Nu'man bin Abd al-Salam is trustworthy and reliable. Moreover, a large group of trustworthy narrators have also narrated it as connected from Sufyan al-Thawri and from Shu'bah separately. My companions have heard all these routes from me, so there is no need to repeat them here. As for Isra'il bin Yunus bin Abi Ishaq, who is trustworthy and an authority in the hadith of his grandfather Abu Ishaq, there is no disagreement from him regarding his narrating this hadith as connected.

(1) إسناده ضعيف جدًّا من أجل سليمان بن داود - وهو الشاذَكُوني - فهو متروك الحديث، وقد اتهمه بعضهم. لكنه لم ينفرد به، فقد روي من غير وجه عن شعبة وعن سفيان، كما نبَّه عليه الحاكم بإثره، ومن قبله نبَّه عليه البزار، وصحَّحا وصله من طريق شعبة وسفيان.
Grading: This chain is "very weak" (da'if jiddan) because of Sulayman bin Dawud (al-Shadhakuni), since he is "matruk al-hadith", and some hadith scholars have even accused him (of lying).
Technical note / Defect ('illah): However, he is not alone in this narration; it has also been narrated via several routes from Shu'bah bin al-Hajjaj and Sufyan al-Thawri, as al-Hakim pointed out right after it, and al-Bazzar before him; and both of them held its connected ("mawsul") form via Shu'bah and Sufyan to be sound.
لكن ذكر الترمذي بإثر (1102) أنَّ رواية من رواه عن شعبة وسفيان مرسلًا دون ذكر أبي موسى أصح، وأنَّ وصله من طريقهما لا يصح، ونحوه قال الدارقطني في "العلل" (1295)، والبيهقي 7/ 19.
Technical note / Defect ('illah): But al-Tirmidhi mentioned after hadith (1102) that the narration of those who narrated it from Shu'bah and Sufyan al-Thawri as "mursal" (i.e. without mentioning Abu Musa al-Ash'ari) is more correct, and that its connected form via these two is not sound. Al-Daraqutni said similarly in "al-'Ilal" (1295), as did al-Bayhaqi (7/19).
وعلى أي حال فإنَّ الحديث صحَّ موصولًا من غير طريقهما، كما سيأتي عند الحاكم، وكما بيَّناه مفصّلًا في تعليقنا على "المسند" 32/ (19518).
Important point: In any case, this hadith is authentically established as "mawsul" via routes other than Shu'bah and Sufyan, as will come in al-Hakim, and as we explained in detail in our commentary on "Musnad Ahmad" (32/19518).
وأخرجه البيهقي 7/ 109 عن أبي زكريا بن أبي إسحاق المزكّي، عن أبي بكر أحمد بن كامل وحده، به.
Reference / Source: Al-Bayhaqi (7/109) recorded it from Abu Zakariyya bin Abi Ishaq al-Muzakki, from Abu Bakr Ahmad bin Kamil alone.
وأخرجه ابن عدي في "الكامل" 3/ 298، وابن المقرئ في "معجمه" (304)، وتمّام في "فوائده" (1432) من طرق عن أبي قلابة عبد الملك بن محمد، به.
Reference / Source: Ibn Adi in "al-Kamil" (3/298), Ibn al-Muqri' in his "Mu'jam" (304) and Tammam al-Razi in his "Fawa'id" (1432) recorded it via various routes from Abu Qilabah Abd al-Malik bin Muhammad.
وأخرجه البزار (3111)، وأبو علي الصوّاف في "فوائده" (12)، والدارقطني (3518) من طريق محمد بن موسى الحرشي، والبزار (3111) عن محمد بن الحصين الجزري، كلاهما عن يزيد بن زريع، وأخرجه ابن المقرئ (584) من طريق أبي العباس الفضل بن عبد الله اليشكري، عن مالك بن سليمان، كلاهما (يزيد بن زريع ومالك بن سليمان) عن شعبة وحده، به موصولًا.
Reference / Source: Al-Bazzar (3111), Abu Ali al-Sawwaf in his "Fawa'id" (12) and al-Daraqutni (3518) recorded it via Muhammad bin Musa al-Harashi, and al-Bazzar (3111) from Muhammad bin al-Husayn al-Jazari, both of them from Yazid bin Zuray'; and Ibn al-Muqri' (584) via Abu al-Abbas al-Fadl bin Abd Allah al-Yashkuri, from Malik bin Sulayman. Both of them (Yazid bin Zuray' and Malik bin Sulayman) narrate it from Shu'bah bin al-Hajjaj alone, as "mawsul".
ومالك بن سليمان والراوي عنه ضعيفان.
Technical note / Defect ('illah): Malik bin Sulayman and the narrator from him are both "da'if".
وأخرجه البزار (3110) عن عمرو بن علي الفلّاس، عن يزيد بن زريع، عن شعبة، فأرسله.
Reference / Source: Al-Bazzar (3110) recorded it from Amr bin Ali al-Fallas, from Yazid bin Zuray', from Shu'bah, but he narrated it as "mursal".
وأخرجه الطحاوي في "شرح معاني الآثار" 3/ 9 من طريق وهب بن جرير، والخطيب في ¤ ¤ "الكفاية" ص 413 من طريق محمد بن جعفر، كلاهما عن شعبة، مرسلًا.
Reference / Source: Al-Tahawi recorded it in "Sharh Ma'ani al-Athar" (3/9) via Wahb bin Jarir, and al-Khatib al-Baghdadi in "al-Kifayah" (p. 413) via Muhammad bin Ja'far (Ghundar); both of them narrate it from Shu'bah as "mursal".
وكذلك أخرجه الترمذي في "جامعه" بإثر الحديث (1102) من طريق أبي داود الطيالسي، عن شعبة، قال: سمعت الثَّوري يسأل أبا إسحاق: أسمعتَ أبا بردة عن النبي ﷺ: "لا نكاح إلّا بولي"، قال: نعم.
Reference / Source: Likewise al-Tirmidhi recorded it in his "Jami'" after hadith (1102) via Abu Dawud al-Tayalisi, from Shu'bah, who said: I heard Sufyan al-Thawri ask Abu Ishaq (al-Sabi'i): "Did you hear Abu Burdah narrate from the Prophet (peace and blessings be upon him): 'There is no marriage without a guardian'?" He replied: "Yes."
وأخرجه البزار (3108)، وابن الجارود (704)، والطحاوي 3/ 9 وتمام (1433) من طريق بشر بن منصور، والبزار (3106)، وأبو علي الطُّوسي في "مختصر الأحكام" (1000)، والإسماعيلي في "معجمه" 2/ 609 من طريق جعفر بن عون، والرُّوياني في "مسنده" (448) من طريق مؤمّل بن إسماعيل، وتمّام (1431) من طريق عبد الله بن وهب، أربعتهم عن سفيان الثَّوري وحده، به موصولًا.
Reference / Source: Al-Bazzar (3108), Ibn al-Jarud (704), al-Tahawi (3/9) and Tammam (1433) recorded it via Bishr bin Mansur; al-Bazzar (3106), Abu Ali al-Tusi in "Mukhtasar al-Ahkam" (1000) and al-Isma'ili in his "Mu'jam" (2/609) via Ja'far bin Awn; al-Ruyani in his "Musnad" (448) via Mu'ammal bin Isma'il; and Tammam (1431) via Abd Allah bin Wahb. All four of them (Bishr, Ja'far, Mu'ammal and Ibn Wahb) narrated it from Sufyan al-Thawri alone, as "mawsul".
وأخرجه عبد الرزاق (10475)، والطحاوي 3/ 9 من طريق أبي عامر العقدي، والخطيب في "الكفاية" ص 410 من طريق الحسين بن حفص الأصبهاني، والترمذي في "العلل" (265) من طريق عبد الرحمن بن مهدي، أربعتهم (عبد الرزاق والعقدي والحسين الأصبهاني وابن مهدي) عن سفيان الثَّوري، به مرسلًا.
Reference / Source: Abd al-Razzaq (10475) recorded it, as did al-Tahawi (3/9) via Abu Amir al-Aqadi, al-Khatib in "al-Kifayah" (p. 410) via al-Husayn bin Hafs al-Asbahani, and al-Tirmidhi in "al-'Ilal" (265) via Abd al-Rahman bin Mahdi. All four (Abd al-Razzaq, al-Aqadi, al-Husayn al-Asbahani and Ibn Mahdi) narrate it from Sufyan al-Thawri as "mursal".
وممَّن رواه موصولًا كذلك: شريك بن عبد الله النخعي عند الدارمي (2229)، والترمذي في "جامعه" (1101)، وابن حبان (4078) و (4090)، والطبراني في "الأوسط" (681).
Corroborating chains and supporting reports: Among those who narrated it as "mawsul" (from Abu Ishaq al-Sabi'i) is Sharik bin Abd Allah al-Nakha'i, whose narration is in Sunan al-Darimi (2229), al-Tirmidhi's "Jami'" (1101), Sahih Ibn Hibban (4078 and 4090) and al-Tabarani's "al-Mu'jam al-Awsat" (681).
ورَقَبة بن مَصْقَلة عند الخطيب في "موضح أوهام الجمع والتفريق" 1/ 389.
Reference / Source: Also Raqabah bin Masqalah narrated it as mawsul, as found in al-Khatib al-Baghdadi's "Mudih Awham al-Jam' wa al-Tafriq" (1/389).
وعبد الحميد بن الحسن الهلالي عند البزار (3115).
Reference / Source: And Abd al-Hamid bin al-Hasan al-Hilali narrated it as mawsul, in al-Bazzar's "Musnad" (3115).
ثلاثتهم عن أبي إسحاق، به.
Technical note / Defect ('illah): All three of these narrators (Sharik, Raqabah and Abd al-Hamid) narrate it from Abu Ishaq al-Sabi'i with the aforementioned chain.
وممَّن رواه مرسلًا عن أبي إسحاق: أبو الأحوص عند ابن أبي شيبة 4/ 131 و 14/ 168.
Technical note / Defect ('illah): Whereas Abu al-Ahwas (Sallam bin Sulaym) narrated it from Abu Ishaq al-Sabi'i as "mursal", as found in the "Musannaf" of Ibn Abi Shaybah (4/131 and 14/168).
وانظر الروايات التالية عن أبي إسحاق، وكلها موصولة، فالحديث صحيح موصولًا بذكر أبي موسى الأشعري فيه.
Grading: See all the following narrations from Abu Ishaq al-Sabi'i, which are "mawsul"; hence this hadith is "sahih" and "mawsul" with the mention of Abu Musa al-Ash'ari (may Allah be pleased with him) in it.

(1) هو ثقة كما قال الحاكم، لكن الراوي عنه سليمان بن داود الشاذَكُوني، وهو متروك، وقد اتهمه بعضهم، ولم يروه عنه غيره، فلا اعتبار بثقة من فوقه حينئذٍ.
Technical note / Defect ('illah): Although the narrator above is trustworthy (thiqah), as al-Hakim said, the one narrating from him is Sulayman bin Dawud al-Shadhakuni, who is "matruk al-hadith", and some have accused him (of lying). Since no one else narrated it from him, the trustworthiness of those above him carries no weight in this case.
