Mustadrak al-Hakim — Hadith 2743

فحدَّثَناه أبو بكر بن إسحاق الفقيه، أخبرنا إسماعيلُ بنُ قُتيبة. وأخبرني أبو يحيى أحمد بن محمد السَّمرْقَنْدي، حدثنا أبو عبد الله محمد بن نصر. وأخبرني أبو عمرو بن جعفر العَدْلُ، حدثنا إبراهيم بن علي الذُّهلي، قالوا: حدثنا يحيى بن يحيى، أخبرنا حجّاج بن محمد، عن ابن جُرَيج، أخبرني سليمان بن موسى، أنَّ ابن شِهاب أخبره، أنَّ عُرْوة أخبره، أنَّ عائشة أخبرته، أنَّ النبي ﷺ قال: "أيُّما امرأةٍ نَكَحتْ بغير إذن وليّها، فنكاحُها باطلٌ، نكاحُها باطلٌ، ولها مَهرُها بما أصاب منها، فإن اشتَجَروا فالسلطان وَليُّ من لا وَليَّ له" (1). فقد صحَّ وثبت بروايات الأئمة الأثبات سماعُ الرواة بعضِهم من بعض، فلا تُعلَّل هذه الروايات بحديثِ ابن عُليّة وسؤالِه ابنَ جُرَيج عنه، وقولِه: إني سألتُ الزُّهْري عنه فلم يعرفه، فقد ينسى الثقةُ الحافظُ الحديثَ بعد أن حدّث به، وقد فَعلَه غيرُ واحد من حفّاظ الحديث.
It is narrated from Sayyidah Aishah (may Allah be pleased with her) that the Prophet (peace and blessings be upon him) said: "Any woman who marries without the permission of her guardian, her marriage is void, her marriage is void, and she will receive her dowry (mahr) because of the intercourse. And if they differ among themselves, then the ruler (sultan) is the guardian of the one who has no guardian."
Through the narrations of reliable Imams, the narrators' hearing from one another has been established. Therefore these narrations cannot be faulted on the basis of Ibn Ulayyah's report that he asked Ibn Jurayj about it, and that he said: I asked al-Zuhri and he did not recognize it. For at times a trustworthy hafiz forgets a hadith after having narrated it, and this has happened with several of the huffaz of hadith.
