Mustadrak al-Hakim — Hadith 2729

أخبرني أبو بكر محمد بن عبد الله بن قريش، حدثنا الحسن بنُ سفيان، حدثنا محمد بن أبي بكر المُقدَّمي، أخبرني عُمَرُ بنُ علي بن مُقدَّم، حدثنا محمد بن إسحاق، عن داود بن الحُصين، عن واقِد بن عمرو بن معاذ، عن جابر قال: قال رسول الله ﷺ: "إِذا خَطَبَ أحدُكم امرأةً، فإنِ استطاعَ أن يَنظُرَ إِلى بعضِ ما يَدعُو إلى نِكاحِها فليَفعَلْ"، فخطبتُ امرأةً من بني سُلَيم، فكنت أتخبّأُ لها في أُصولِ النخل، حتى رأيتُ منها ما دعاني إلى نِكاحها فتزوجتُها (1).
هذا حديث صحيح على شرط مسلم، ولم يُخرجاه، وإنما أخرج مسلم في هذا الباب حديث يزيد بن كَيْسان عن أبي حازم (2) مختصرًا.

It is narrated from Sayyiduna Jabir (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "When one of you proposes marriage to a woman, then if he is able to look at that part of her which draws him to marry her, let him do so." (Jabir said:) I proposed marriage to a woman of Banu Sulaym, and I kept trying to see her while hiding behind the date palms, until I saw in her that which drew me to marry her, and then I married her.
This hadith is sahih (authentic) on the condition of Imam Muslim, but they (the two Shaykhs, Bukhari and Muslim) did not record it. Imam Muslim recorded in this chapter the narration of Yazid bin Kaysan from Abu Hazim in abridged form.

(1) المرفوع منه صحيح لغيره، وهذا إسناد حسن، وقد صرَّح محمد بن إسحاق بسماعه من داود بن الحصين عند أحمد (14869).
Grading: The "marfu'" part of this narration is "sahih li-ghayrihi", and this chain is "hasan".
Technical note / Defect ('illah): Muhammad bin Ishaq (who is a mudallis) explicitly stated his hearing from Dawud bin al-Husayn in Ahmad's "Musnad" (14869), which removes the concern over his 'an'anah.
وأخرجه أحمد 22/ (14586)، وأبو داود (2082) من طريق عبد الواحد بن زياد، وأحمد 23/ (14869) من طريق إبراهيم بن سعد، كلاهما عن محمد بن إسحاق، بهذا الإسناد.
Reference / Source: Ahmad (22/14586) and Abu Dawud (2082) recorded it via Abd al-Wahid bin Ziyad, and Ahmad (23/14869) via Ibrahim bin Sa'd; both of them from Muhammad bin Ishaq, with this same chain.
وقوله في رواية الحاكم: امرأة من بني سُليم، وهمٌ، صوابه: امرأة من بني سَلِمة، كذلك جاء في رواية غير الحاكم، وكذلك جاء في رواية البيهقي في "السنن الكبرى" 7/ 84 من طريق أحمد بن خالد الوهبي عن محمد بن إسحاق.
Technical note / Defect ('illah): In al-Hakim's narration the words "a woman from Banu Sulaym" are an error (wahm); the correct reading is "a woman from Banu Salimah", as it appears in the narrations of others besides al-Hakim, and likewise in al-Bayhaqi's "al-Sunan al-Kubra" (7/84) via Ahmad bin Khalid al-Wahbi, from Muhammad bin Ishaq.
ويشهد له حديث أنس بن مالك الذي بعده.
Corroborating chains and supporting reports: The following hadith of Anas bin Malik (may Allah be pleased with him) is a shahid (supporting report) for it.
