Mustadrak al-Hakim — Hadith 2694

حدَّثَناه أبو العباس محمد بن يعقوب، حدثنا يوسف بن عبد الله الخُوارزمي ببيت المقدس، حدثنا عبد الملك بن عبد العزيز التمَّار. وحدثني أبو بكر محمد بن أحمد بن بالَوَيهِ، حدثنا أحمد بن علي الخزّاز (1)، حدثنا أبو نصر التمّار، حدثنا كَوثَر بن حَكيم، عن نافع، عن ابن عمر، قال: قال رسول الله ﷺ لعبد الله بن مسعود: "يا ابنَ مسعود، أتدري ما حُكم اللهِ فيمن بَغَى مِن هذه الأُمة؟ " من قال ابن مسعود: الله ورسوله أعلم، قال: "فإنَّ حُكم الله فيهم أن لا يُتبَعَ مُدبِرُهم، ولا يُقتَلَ أسِيرُهم، ولا يُذفَّفَ على جَريحِهم" (2).

It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) asked Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him): "O Ibn Mas'ud, do you know what the ruling of Allah is concerning those of this Ummah who rebel?" He said: Allah and His Messenger know best. He (peace and blessings be upon him) said: "The ruling of Allah concerning them is that those of them who turn and flee are not to be pursued, their captives are not to be killed, and their wounded are not to be finished off."
A musnad (connected) hadith has also been narrated on this subject.

(1) تصحف في (ز) إلى: الجزار، ولم تعجم في بقية النسخ، وهو بخاء وزايين، وهو أحمد بن علي بن الفُضيل الخزاز المقرئ، وهو مترجم في "تاريخ بغداد" 5/ 496، وفي "تلخيص المتشابه" 1/ 582.
Technical note / Defect ('illah): In manuscript (Z) this word is miswritten (tashif) as "al-Jazzar", while in the other manuscripts it had no dots. The correct word is "al-Khazzaz" (with kha' and two za's).
Important point: He is Ahmad bin 'Ali bin al-Fudayl al-Khazzaz al-Muqri', whose biography is recorded in "Tarikh Baghdad" (5/496) and "Talkhis al-Mutashabih" (1/582).

(2) إسناده ضعيف جدًّا من أجل كوثر بن حكيم، فهو متروك كما قال الذهبي في "تلخيصه".
Grading: This chain is "very weak" because it contains the narrator "Kawthar bin Hakim".
Technical note / Defect ('illah): Kawthar bin Hakim is a "matruk" (abandoned) narrator, as Imam al-Dhahabi stated in his "Talkhis".
وأخرجه البيهقي 8/ 182 عن أبي عبد الله الحاكم، بهذا الإسناد.
Reference / Source: Imam al-Bayhaqi (8/182) narrated it through Imam al-Hakim with this same chain.
وأخرجه أحمد بن منيع في "مسنده" كما في "المطالب العالية" للحافظ ابن حجر (4395)، والحارث بن أبي أسامة في "مسنده" كما في "بغية الباحث" للهيثمي (705)، والرُّوياني في "مسنده" (1437)، والبيهقي 8/ 182 من طرق عن كوثر بن حكيم، به.
Reference / Source: Ahmad bin Mani' narrated it in his "Musnad" (as in "al-Matalib al-'Aliyah" 4395), al-Harith bin Abi Usamah in his "Musnad" (as in "Bughyat al-Bahith" 705), al-Ruyani in his "Musnad" (1437) and al-Bayhaqi (8/182) through various routes from Kawthar bin Hakim.
يُذفَّف، أي: يُجهَز.
Note / Clarification: The word "yudhaffaf" means: to finish off (a wounded person by killing him).
