Mustadrak al-Hakim — Hadith 2617

حدثنا أبو العباس محمد بن يعقوب، حدثنا هارون بن سليمان الأصبهاني، حدثنا عبد الرحمن بن مَهدي، حدثنا سفيان الثَّوْري، عن قيس بن مُسلم (1)، قال: سألت الحسن بن محمد عن قول الله ﵎: ﴿وَاعْلَمُوا أَنَّمَا غَنِمْتُمْ مِنْ شَيْءٍ فَأَنَّ لِلَّهِ خُمُسَهُ وَلِلرَّسُولِ﴾ [الأنفال: 41]، قال: هذا مِفتاحُ كلامٍ، للهِ (2) تعالى ما في الدنيا والآخرة، قال: اختلف الناسُ في هذين السهمَين بعد وفاة رسول الله ﷺ، فقال قائلون: سَهْمُ القُربَى لقَرابة النبي ﷺ، وقال قائلون: لقَرابة الخليفة، وقال قائلون: سهمُ النبي ﷺ للخليفة مِن بعده، فاجتمع رأيُهم على أن يجعلوا هذين السهمَين في الخيل والعُدَّة في سبيل الله، فكانا على ذلك في خلافة أبي بكر وعمر ﵄ (3).
Qays bin Muslim says: I asked Hasan bin Muhammad about this saying of Allah, the Mighty and Majestic: "And know that whatever you obtain as spoils of war, a fifth of it is for Allah and for the Messenger" [Al-Anfal: 41]. He said: This is the opening of the speech; to Allah alone belongs everything in this world and the Hereafter. He related that after the death of the Messenger of Allah (peace and blessings be upon him), the people differed about these two shares (the share of the Prophet (peace and blessings be upon him) and the share of the near relatives). Some said: The share of "the near relatives" is for the relatives of the Prophet (peace and blessings be upon him). Some said: It is for the relatives of the caliph. And some said that the share of the Prophet (peace and blessings be upon him) belongs to the caliph after him. Then they all agreed that these two shares should be spent on horses and war equipment in the way of Allah, and this was acted upon during the caliphates of Abu Bakr and Umar (may Allah be pleased with them both).

(1) تحرَّف في النسخ الخطية إلى: محمد، والمثبت على الصواب من رواية البيهقي في "سننه الكبرى" 6/ 338 عن أبي عبد الله الحاكم، وفاقًا لسائر مصادر التخريج التي خرَّجت هذا الخبر.
Technical note / Defect ('illah): In the handwritten manuscripts the name is distorted into "Muhammad", whereas the reading adopted in the text is correct, according to the narration of al-Bayhaqi in "al-Sunan al-Kubra" (6/ 338) from Abu 'Abd Allah al-Hakim, in agreement with all the other sources that cite this report.

(2) وقع في (ص) و (ع): مفتاح كلام الله، بإضافة لفظ الجلالة إلى لفظة "كلام"، والمثبت من (ز) و (ب) وهو الصحيح، كما جاء في رواية البيهقي عن أبي عبد الله الحاكم، على الاستئناف.
Note / Clarification: Manuscripts (S) and ('A) have "kalam Allah", but the text of (Z) and (B), "kalamun" (without the addition of "Allah"), is more correct and agrees with al-Bayhaqi's narration.

(3) إسناده صحيح إلى الحسن بن محمد: وهو ابن علي بن أبي طالب، المعروف أبوه بابن الحنفية، لأنَّ أمَّه من بني حنيفة.
Grading: Its chain up to al-Hasan bin Muhammad is sahih.
Identification of names: Al-Hasan bin Muhammad refers to the son of Muhammad bin al-Hanafiyyah (his father was called Ibn al-Hanafiyyah because his mother was from Banu Hanifah).
وأخرجه النسائي (4429) من طريق أبي إسحاق الفَزَاري، عن سفيان الثَّوري، به.
Reference / Source: Imam al-Nasa'i (4429) narrated it from Abu Ishaq al-Fazari, from Sufyan al-Thawri.
وقد جاء في رواية النسائي بيان المراد بالسهمين المذكورين بأنهما سهم الرسول ﷺ وسهم ذوي القُربى.
Note / Clarification: Al-Nasa'i's narration makes explicit that the "two shares" (sahmayn) mean the share of the Prophet (peace and blessings be upon him) and the share of the near relatives (dhawu al-qurba).
