حدثنا علي بن عيسى، حدثنا أحمد بن نَجْدة القرشي، حدثنا سعيد بن منصور، حدثنا عبد العزيز بن محمد، حدثني صالح بن محمد بن زائدة، قال: دخل مَسلَمةُ أرضَ الروم، فأُتي برجل قد غَلّ، فسأل سالمًا عنه، فقال: سمعتُ أبي يحدّث عن عمر بن الخطاب، عن النبي ﷺ، قال: "إذا وجدتُم الرجلَ قد غَلَّ فأحرِقُوا مَتاعَه واضرِبُوه"، قال: فوجدنا في مَتاعِه مُصحفًا، فسُئل سالمٌ عنه، فقال: بِعْهُ وتَصدَّقُ بثمنِه (1). هذا حديث صحيح الإسناد، ولم يُخرجاه. كتاب قَسم الفَيْء والأصلُ فيه من كتاب الله ﷿. وَالْأَصْلُ مِنْ كِتَابِ اللَّهِ عَزَّ وَجَلَّ
It is narrated from Salih bin Muhammad bin Za'idah that Maslamah bin Abd al-Malik entered the land of the Romans. A man was brought to him who had committed treachery with the spoils of war. He asked Salim (bin Abdullah bin Umar) about him, and he said: I heard my father relate from Sayyiduna Umar (may Allah be pleased with him) this saying of the Prophet (peace and blessings be upon him): "When you find a man who has committed treachery with the spoils, burn his belongings and beat him." The narrator says: We found a copy of the Qur'an (mushaf) among his belongings. Salim was asked about it, and he said: "Sell it and give its price in charity (because the Qur'an cannot be burned)."
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) إسناده ضعيف لضعف صالح بن محمد بن زائدة، فقد قال عنه البخاري فيما نقله عنه الترمذي في "جامعه" بإثر الحديث (1461): هو منكر الحديث، وقال الترمذي عن حديثه هذا: حديث غريب. قلنا: ورواه صالح بن محمد هذا بسياقة أخرى عند أبي داود (2714) من طريق أبي إسحاق الفزاري، عنه: أنهم غزوا مع الوليد بن هشام، ومعهم سالم بن عبد الله بن عمر وعمر بن عبد العزيز، فغلَّ رجلٌ متاعًا، فأمر الوليد بمتاعه فأُحرق، وطيفَ به، ولم يُعطه سهمَه. وقال أبو داود بإثره: هذا أصح الحديثين. Grading: The chain is "da'if" because of the weakness of Salih bin Muhammad bin Za'idah. Technical note / Defect ('illah): Imam al-Bukhari called him "munkar al-hadith", and al-Tirmidhi declared this narration "gharib". Salih bin Muhammad narrated it with a different wording in Abu Dawud (2714), in which the order to burn the belongings of the one who embezzled from the spoils is described as the act of "al-Walid bin Hisham". Imam Abu Dawud declared this one to be the more correct. وتابعه الحافظ ابن حجر في "النكت الظراف" (6763)، لكنه جعل الوهم فيه من عبد العزيز بن محمد - وهو الدَّراوَردي - والأليق أن يكون الوهم فيه من صالح بن محمد نفسه كما أشار إليه الدارقطني والمنذري كما في "مختصر سنن أبي داود" 4/ 40، وبيان ذلك أن يكون اضطرب في ذكر القصة. ولم يضبط الرواية، فجعل ذكر الإحراق لمتاع الغالّ مرة مرفوعًا، ومرة مقطوعًا من فعل الوليد بن هشام. ومسلمة المذكور: هو ابن عبد الملك بن مروان. Technical note / Defect ('illah): According to al-Hafiz Ibn Hajar the error came from al-Darawardi, but according to al-Daraqutni and al-Mundhiri the error is Salih bin Muhammad's own, because he is inconsistent in this story; sometimes he narrates it as marfu' (the command of the Prophet (peace and blessings be upon him)) and sometimes as a personal act of al-Walid bin Hisham. Maslamah refers to "Maslamah bin 'Abd al-Malik bin Marwan". وأخرجه أبو داود (2713) عن سعيد بن منصور، بهذا الإسناد. Reference / Source: Abu Dawud (2713) narrated it via Sa'id bin Mansur with this same chain. وأخرجه أبو داود أيضًا (2713) عن عبد الله بن محمد النُّفيلي، والترمذي (1461) عن محمد بن عمرو السَّواق، كلاهما عن عبد العزيز بن محمد الدراوردي، به. Reference / Source: Abu Dawud narrated it from al-Nufayli, and al-Tirmidhi from Muhammad bin 'Amr al-Sawwaq, both via al-Darawardi. وقال البخاري فيما نقله عنه الترمذي: وقد روي في غير حديث عن النبي ﷺ في الغالّ، فلم يأمر فيه بحرق متاعه. Important point: Imam al-Bukhari says that other hadiths are narrated from the Prophet (peace and blessings be upon him) concerning the embezzler (ghall) in which he (peace and blessings be upon him) did not order his belongings to be burned. وانظر لزامًا كلام محمد بن الحسن الشَّيباني في "السير الكبير" 4/ 1206 - 1211. General principle: On this issue, be sure to see the detailed discussion of Imam Muhammad bin al-Hasan al-Shaybani in "al-Siyar al-Kabir" (4/ 1206-1211). وفي الباب عن عمرو بن شعيب، عن أبيه، عن جده: أنَّ رسول الله ﷺ وأبا بكر وعمر حرقوا متاعَ الغالِّ وضربوه. وسيأتي عند المصنف برقم (2624)، وإسناده ضعيف. Corroborating chains and supporting reports: In this chapter there is also the narration of 'Amr bin Shu'ayb from his father from his grandfather that the Prophet (peace and blessings be upon him) and the two Shaykhs burned the belongings of the embezzler, but its chain too is "da'if". It will come later at no. (2624).
