Mustadrak al-Hakim — Hadith 2382

حدثنا أبو عبد الله محمد بن أحمد بن موسى القاضي، حدثنا إبراهيم بن يوسف بن خالد الرازي، حدثنا الحارث بن مِسكين وأحمد بن عمرو، قالا: حدثنا ابن وهب، حدثنا جَرير بن حازم، عن سليمان بن مِهْران، عن أبي ظَبْيان، عن ابن عباس، قال: مُرَّ على عليٍّ بمجنونة بني فلان قد زَنَتْ، وأَمَر عمرُ بن الخطّاب برَجْمِها، فردَّها عليُّ بن أبي طالب وقال لعمر: يا أميرَ المؤمنين، أمرتَ برَجْمِ هذه؟ قال: نعم، قال: أما تذكُرُ أنَّ رسول الله ﷺ قال: "رُفِعَ القلمُ عن ثلاثةٍ: عن المجنونِ المغلوبِ على عَقْله، وعن النائم حتى يَستيقِظ، وعن الصبيِّ حتى يَحتَلِم"؟ قال: صدقتَ، فخلَّى عنها (1). قال عبد الله (2): فالحَجْر على المجنون والمجنونة ممّا لا أعلمُ فيه خلافًا بين العلماء.
It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that a madwoman from the tribe of so-and-so, who had committed adultery, was passed before Sayyiduna Ali (may Allah be pleased with him), while Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) had ordered that she be stoned. Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) sent her back and said to Sayyiduna Umar (may Allah be pleased with him): "O Commander of the Believers, did you order this woman to be stoned?" He said: "Yes." Sayyiduna Ali (may Allah be pleased with him) said: "Do you not remember that the Messenger of Allah (peace and blessings be upon him) said: 'The pen has been lifted from three people: from the insane person whose mind has been overcome (by madness), from one who is asleep until he wakes up, and from a child until he reaches puberty'?" Sayyiduna Umar (may Allah be pleased with him) said: "You have spoken the truth." So he let her go. Abdullah said: Restricting (the handling of property by) an insane man or an insane woman is among the matters in which I know of no disagreement among the scholars.

(1) حديث صحيح، وهذا إسناد رجاله ثقات إلا أنه قد اختُلف فيه على الأعمش في رفعه ووقفه، كما سلف بيانه برقم (962). أحمد بن عمرو: هو ابن عبد الله بن السَّرْح، وأبو ظَبْيان: هو حُصين بن جُندب الجَنْبي.
Grading: It is a "sahih hadith"; the narrators are thiqah, but there is the same disagreement over al-A'mash as to whether it is marfu' or mawquf that was discussed at hadith number 962.
وأخرجه أبو داود (4401)، والنسائي (7303) عن أحمد بن عمرو بن السَّرْح، بهذا الإسناد.
Reference / Source: Abu Dawud and al-Nasa'i narrated it via Ahmad bin Amr.

(2) جاء في (ز) و (ص): قال عبد الله، بدل: أبو عبد الله، وجاء بعد هذا فيهما بياض بينه وبين المقول. ويغلب على ظننا صحة ما وقع في المطبوع، ويكون المقصود بأبي عبد الله هو الحاكم نفسه أو شيخه الذي هو أحد كبار فقهاء الحنفية، وإن صحَّ ما في (ز) و (ص) فعسى أن يكون المراد به عبد الله بن وهب، فليس في الإسناد من اسمه عبد الله غيره، والله تعالى أعلم.
Note / Clarification: Despite the difference between the manuscripts, it is most likely that "Abu Abd Allah" refers to al-Hakim himself or to his shaykh, who was a Hanafi jurist.
