حدثنا أبو العباس محمد بن يعقوب، أخبرنا الربيع بن سليمان، أخبرنا الشافعي، أخبرنا سعيد بن سالم القدّاح، أخبرنا ابن جُرَيج، أنَّ إسماعيل بن أُميّة أخبره عن عبد الملك بن عُمير، قال: حضرتُ أبا عُبيدة بن عبد الله بن مسعود وأتاه رجلان تَبايَعا سِلعةً، فقال أحدهما: أخذتُ بكذا وكذا، وقال الآخرُ: بعتُ بكذا وكذا، فقال أبو عُبيدة: حدثني عبد الله بن مسعود في مثل هذا قال: حضرتُ رسولَ الله ﷺ في مثل هذا، فأمر البائعَ أن يُستحلَف، ثم يخيَّر المبتاعُ، إن شاء أَخَذ، وإن شاء تَرَك (1). هذا حديث صحيح إن كان سعيد بن سالم حفظ في إسناده عبدَ الملك بن عُمير.
It is narrated from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him): I was present with the Messenger of Allah (peace and blessings be upon him) when a similar matter came up (in which the buyer and the seller disagreed), and he (peace and blessings be upon him) ordered that the seller be made to swear an oath, and then the buyer be given the choice: if he wished he could accept the sale, otherwise he could leave it.
This hadith is sahih (authentic), provided that Sa'id bin Salim preserved it correctly.

(1) حديث صحيح، دون ذكر استحلاف البائع، وهذا إسناد ضعيف لجهالة عبد الملك بن عمير، ¤ ¤ والصواب ابن عُبيد، كما قال هشام بن يوسف في روايته عن ابن جُرَيج، أو عبد الملك بن عُبيدة، بزيادة هاء في آخره، كما قال حجاج بن محمد في روايته عن ابن جُرَيج، فلا يصح ذكر عبد الملك بن عمير في هذا الإسناد. وفي الإسناد أيضًا انقطاع، لأنَّ أبا عبيدة لم يسمع من أبيه. Grading: This hadith is sahih (but without the mention of taking an oath from the seller). This particular chain is da'if (weak) because 'Abd al-Malik bin 'Umayr (the correct name is 'Abd al-Malik bin 'Ubayd) is unknown, and because Abu 'Ubaydah did not hear from his father (inqita'). لكن للحديث طرق أخرى تقدم بيانها عند الطريق السالف برقم (2324)، ويصح بها الحديث إن شاء الله تعالى، إلَّا أنه ليس في شيء منها استِحلاف البائع. Corroborating chains and supporting reports: The other routes of this hadith have passed at no. (2324), on the strength of which it is sahih; however, "taking an oath from the seller" is not found in any sahih route. وانظر ما بعده. Note: See the next narration.
