أخبرنا أبو عبد الله محمد بن علي الجَوهَري ببغداد، حدثنا أبو الوليد محمد بن أحمد بن بُرْد، حدثنا محمد بن كثير المِصِّيصي، حدثنا الأوزاعي. وحدثنا أبو علي الحسين بن علي الحافظ، حدثنا جُماهر بن محمد الغَسّاني بدمشق، حدثنا محمود بن خالد الدمشقي، حدثنا الفِرْيابي، عن الأوزاعي، عن الزُّهْري، عن حَرام بن محَيِّصةَ الأنصاري، عن البراء بن عازب، قال: كانت له ناقةٌ ضاريةٌ، فدخلت حائطًا، فأفسدَتْ فيه، فكُلِّم رسولُ الله ﷺ فيها، فقضى أنَّ حِفْظَ الحوائط بالنهار على أهلها، وأنَّ حِفْظَ الماشية بالليل على أهلها، وأنَّ على أهل الماشية ما أصابت ماشِيتُهم (1). هذا حديث صحيح الإسناد، على خلاف فيه بين معمر والأوزاعي، فإنَّ معمرًا قال: عن الزُّهْري، عن حرام بن مُحَيِّصة، عن أبيه. It is narrated from Sayyiduna al-Bara' bin Azib (may Allah be pleased with him) that he had a very unruly she-camel. It entered someone's garden and caused damage there. The case was brought before the Messenger of Allah (peace and blessings be upon him), and he (peace and blessings be upon him) ruled that guarding the gardens by day is the responsibility of their owners, that guarding the livestock by night is the responsibility of their owners, and that compensation for the damage done by the livestock is due from the owners of the livestock.
This hadith has a sahih (authentic) chain of narration, although there is a disagreement between Ma'mar and al-Awza'i regarding its chain.

(1) صحيح بطرقه، وهذا إسنادٌ الصحيح أنه مرسلٌ، لأنَّ حرام بن مُحيّصة - وهو حرام بن سعد، ويقال: ساعدة بن مُحيّصة - لم يسمع من البراء، والكبار من أصحاب الزُّهْري يقولون فيه: عن حرام: أنَّ ناقة للبراء، وهذا هو الصحيح. على أنه قد رواه بعضهم عن الأوزاعي بموافقة كبار أصحاب الزُّهْري على الإرسال، كما جاء عند الطحاوي في "شرح مشكل الآثار" (6157) و (6158) والبيهقي 8/ 341. Grading: On the strength of its various routes this hadith is sahih, but the correct view about this particular chain is that it is "mursal". Technical note: Haram bin Muhayyisah did not hear from al-Bara' (may Allah be pleased with him) (a meeting is not established). The senior students of Imam al-Zuhri narrate it with the words "from Haram: that a she-camel of al-Bara'", and this is the correct (mursal) form. Imam al-Tahawi (6157) and al-Bayhaqi (8/ 341) also support its being mursal. وأخرجه أبو داود (3570) عن محمود بن خالد، بهذا الإسناد. Reference / Source: Abu Dawud (3570) recorded it through Mahmud bin Khalid with this same chain. وأخرجه أحمد 30/ (18606) عن محمد بن مصعب، والنسائي (5753) من طريق الوليد بن مسلم، كلاهما عن الأوزاعي، به. Reference / Source: Imam Ahmad (30/ 18606) and al-Nasa'i (5753) recorded it through al-Awza'i. وأخرجه ابن ماجه (2332 م)، والنسائي (5752) من طريق معاوية بن هشام القصار، عن سفيان الثَّوري، عن عبد الله بن عيسى - وقرن به النسائي إسماعيل بن أمية - عن الزُّهْري، به. ومعاوية بن هشام حسن الحديث لكنه يُغرب عن الثَّوري بأشياء كما قال ابن عدي. Reference / Source: Ibn Majah (2332) and al-Nasa'i (5752) recorded it through Mu'awiyah bin Hisham, from Sufyan al-Thawri, from 'Abd Allah bin 'Isa. Although Mu'awiyah bin Hisham is hasan al-hadith, he brings unusual things (gharib) in his narrations from Sufyan al-Thawri. وأخرجه النسائي (5754) عن العباس بن عبد الله بن العباس الأنطاكي، عن محمد بن كثير المِصِّيصي، عن الأوزاعي، عن الزُّهْري، عن حرام بن محيصة، عن أبيه: أنَّ ناقة للبراء. فوصله بذكر محيصة بدل البراء. ومحمد بن كثير المصيصي كثير الخطأ. ¤ ¤ وكذلك أخرجه أحمد 39/ (23697)، وأبو داود (3569)، وابن حبان (6008) من طريق عبد الرزاق، عن معمر، عن الزُّهْري، عن حرام، عن أبيه: أنَّ ناقة للبراء، لكن ذكر الدارقطني في "سننه" بإثر (3313)، وكذا البيهقي 8/ 342 أنَّ وهيب بن خالد وأبا مسعود الزجاج قد خالفا عبد الرزاق، فروياه عن معمر فلم يقولا: عن أبيه، يعني أنهما أرسلاه. Reference / Source: In al-Nasa'i (5754) it is given as connected through Haram bin Muhayyisah from "his father", but the narrator Muhammad bin Kathir makes many mistakes. 'Abd al-Razzaq (Ahmad 39/ 23697) also narrated it with "from his father", but according to al-Daraqutni (3313) and al-Bayhaqi, other trustworthy narrators contradicted 'Abd al-Razzaq and narrated it as mursal. وأخرجه أحمد (23691) من طريق مالك بن أنس، و (23694) عن سفيان بن عيينة، وابن ماجه (2332) من طريق الليث بن سعد، ثلاثتهم عن الزُّهْري عن حرام بن محيصة: أنَّ ناقة للبراء. هكذا رووه مرسلًا، ووافقهم على إرساله يونس بن يزيد الأيلى عند الدارقطني (3319). Reference / Source: Imam Malik, Sufyan bin 'Uyaynah and al-Layth bin Sa'd (Ibn Majah 2332), all three, narrated it from Imam al-Zuhri as "mursal". Yunus bin Yazid also agreed with them. وأخرجه أحمد (23694) عن سفيان بن عيينة، عن الزُّهْري، عن سعيد بن المسيب: أنَّ ناقة للبراء. ومراسيل سعيد بن المسيب تُعدّ من أقوى المراسيل عند أهل العلم. Reference / Source: Sufyan bin 'Uyaynah narrated it as mursal through al-Zuhri from Sa'id bin al-Musayyib, and the mursal reports of Sa'id bin al-Musayyib are among the strongest mursal reports according to the scholars. وله طريق ثالثة مرسلة عند الرزاق (18438) عن ابن جُرَيج، قال: قال ابن شهاب: أخبرني أبو أمامة بن سهل: أنَّ ناقةً دخلت في حائط، فذكره. Reference / Source: 'Abd al-Razzaq (18438) also narrated a third mursal route through Ibn Jurayj from Abu Umamah bin Sahl. ولا يضر أن يكون مدارُ هذه المراسيل على الزُّهْري، فقد كان واسع الرواية، وباجتماع هذه المراسيل الثلاثة يصح الحديث إن شاء الله تعالى. قال ابن عبد البر في "التمهيد" 11/ 82: هذا الحديث وإن كان مرسلًا، فهو حديث مشهور أرسله الأئمة، وحدّث به الثقات، واستعمله فقهاء الحجاز وتلقَّوه بالقبول، وجرى في المدينة به العملُ. Summary of the research: That all these mursal reports revolve around Imam al-Zuhri does no harm, since the breadth of his knowledge is acknowledged, and by the combination of these three different mursal routes the hadith becomes sahih. Ibn 'Abd al-Barr (al-Tamhid 11/ 82) says that although this hadith is mursal it is well known: the imams narrated it, the jurists of the Hijaz accepted it, and practice in Madinah continued on it.
