حدثنا أبو العباس محمد بن يعقوب، حدثنا محمد بن إسحاق الصَّغَاني، حدثنا سعيد بن عامر وعبد الوهاب بن عطاء، قالا: حدثنا سعيد بن أبي عَروبة، عن قَتَادة، عن الحسن، عن سَمُرة، عن النبي ﷺ قال: "على اليدِ ما أَخَذَت حتى تُؤدِّيَه" (2). ثم إنَّ الحسن نسيَ حديثَه، فقال: هو أمينُك لا ضمان عليه. هذا حديث صحيح الإسناد على شرط البخاري، ولم يُخرجاه. It is narrated from Sayyiduna Samurah bin Jundub (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: "The hand is responsible for what it has taken until it returns it." Later Imam al-Hasan al-Basri forgot this narration of his and began to say that (the one with whom something is deposited) is your trustee and bears no liability.
This hadith has a sahih (authentic) chain of narration on the condition of Imam Bukhari, but the two Shaykhs (Bukhari and Muslim) did not record it.

Technical note: That Imam al-Hasan al-Basri heard from Samurah bin Jundub is sound and established, as we have explained in our study of hadith no. (151). وأخرجه أحمد 33/ (20131) عن عبد الوهاب بن عطاء الخفاف وحده، بهذا الإسناد. Reference / Source: Imam Ahmad (33/ 20131) recorded it through the chain of 'Abd al-Wahhab bin 'Ata' al-Khaffaf alone. وأخرجه أحمد (20086) و (20156)، وأبو داود (3561)، وابن ماجه (2400)، والترمذي (1266)، والنسائي (5751) من طرق عن سعيد بن أبي عروبة، به. وقال الترمذي: حديث حسن. Reference / Source: Imam Ahmad, Abu Dawud (3561), Ibn Majah (2400), al-Tirmidhi (1266) and al-Nasa'i (5751) recorded it through routes from Sa'id bin Abi 'Arubah. Imam al-Tirmidhi declared it "hasan". وقال ابن المنذر في "الأوسط" بإثر: (8632): ظاهره يُوجب أن تُؤدي إليه ما أخذت، وإذا تلفت بغير جناية من المستعير لم يَجُز إلزام المستعير قيمتَها بغير حُجَّة. Juristic principle: Ibn al-Mundhir (al-Awsat 8632) says that the apparent meaning of the hadith requires returning what was taken, but if it perishes without any fault or transgression by the one using it, obliging him to pay its value without solid evidence is not permissible. قلنا: صحَّ عن الحسن البصري أنه يُضمِّن العاريّة إذا خالف المستعيرُ صاحبَ العاريّة، كما أخرجه ابن أبي شيبة أيضًا 6/ 142، ومثَّل الحسنُ البصري لذلك بأن يستعير دابَّة فيُكريها، كما أخرجه ابن أبي شيبة أيضًا 6/ 143، وذلك لأنه استعارها لينتفع بها هو، فإن أجّرها المستعير لغيره فعطبت ضمنها. Important point: It is authentically reported from al-Hasan al-Basri that he imposed liability when the borrower (musta'ir) violated the terms. For example: someone took an animal for his own riding but then hired it out to another and it perished; in that case he is liable (for compensation). وإذا قلنا بالتفريق بين الأداء والضمان كما بيناه عند الحديث المتقدم برقم (2331) يكون الحسن البصري قد أفتى بمقتضى الرواية وليس بخلافها، لأنَّ معنى حديثه هنا أن يد المستعير يد أمانة ¤ ¤ لا يد ضمان، فلا يضمن ما تلف ما دام لم يخالف صاحبَ العارية فيها. Summary of the discussion: If we distinguish between "returning" (ada') and "liability" (daman), as passed under hadith 2331, then al-Hasan al-Basri's fatwa is exactly in line with his narration: the borrower's hand is a hand of "trust" (amanah), and as long as he does not violate the limits set by the owner, he is not liable for what perishes.
