Mustadrak al-Hakim — Hadith 2331

أخبرنا الحسن بن يعقوب بن يوسف العَدْل، حدثنا يحيى بن أبي طالب، حدثنا يزيد بن هارون، أخبرنا شريك، عن عبد العزيز بن رُفَيع، عن أُميّة بن صفوان بن أميّة، عن أبيه: أنَّ النبي ﷺ استعار منه أَدرُعًا يوم حُنين، فقال: أَغَصْبٌ يا محمد؟ قال: "لا، بل عاريَّةٌ مَضْمونةٌ" (1). وله شاهدٌ عن ابن عباس:
It is narrated from Sayyiduna Safwan bin Umayyah (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) asked to borrow some coats of mail from him on the day of the Battle of Hunayn. He asked: O Muhammad (peace and blessings be upon him)! Is this ghasb (taking by force)? He (peace and blessings be upon him) said: "No, rather it is a loan whose return is guaranteed."
There is a supporting narration (shahid) for it from Sayyiduna Ibn Abbas (may Allah be pleased with them both) as well.

Grading: On the strength of its supporting reports this hadith is "hasan li-ghayrihi", but this particular chain is da'if (weak) because of "idtirab" (disagreement among the narrators). Imam al-Tahawi (Sharh al-Mushkil 4459) and Ibn 'Abd al-Barr (al-Tamhid 12/ 41) pointed out this idtirab.
Technical note: The narrators disagree sharply in reporting this narration from 'Abd al-'Aziz bin Rufay'; sometimes it is given as connected (mawsul, naming the Companion) and sometimes as mursal (without naming the Companion).
وقد صحَّ من طريق أخرى عن عطاء بن أبي رباح أنَّ المُعير كان يعلى بنَ أُمية، لا صفوان بن أمية، وأنَّ النبي ﷺ قال له: "عاريّة مؤدّاة"، ولم يقل له: "عاريّة مضمونة". ولهذا قال ابن حزم في "المحلى" 9/ 173: ليس في شيء مما رُوي في العارية خبر يصح غيره. يعني خبر يعلى بن أمية، وقال عبد الحق الإشبيلي في "أحكامه الوسطى" 3/ 319: حديث يعلى أصح.
Research note: Another sahih route from 'Ata' bin Abi Rabah establishes that the lender was not "Safwan bin Umayyah" but "Ya'la bin Umayyah", and that the Prophet (peace and blessings be upon him) said to him: "A loan to be returned" ('ariyah mu'addah), not "a loan with guaranteed compensation" ('ariyah madmunah). For this reason Ibn Hazm and 'Abd al-Haqq al-Ishbili considered the narration of Ya'la bin Umayyah more authentic.
قلنا: لكن ثبت من طريق أخرى ستأتي عند الحاكم (4417) من حديث جابر: أنَّ المُعير كان صفوانَ بنَ أمية، وأنَّ النبي ﷺ قال له: "عاريّة مضمونة"، وهذا هو المعروف المشهور عند أهل المغازي، فقد أسنده البيهقي في "السنن الكبرى" 7/ 19، وفي "دلائل النبوة" 5/ 119 - 121 من عدة روايات مرسلة عن موسى بن عقبة والزُّهْري وعروة بن الزُّبَير وغيرهم، وأسنده البيهقي أيضًا 6/ 89 عن محمد بن علي الباقر مرسلًا. وقال بإثره: بعض هذه الأخبار وإن كان مرسلًا فإنه يقوى بشواهده مع ما تقدم من الموصول؛ يعني حديث جابر الآتي برقم (4417).
Corroborating chains and supporting reports: We say: a narration of Jabir (may Allah be pleased with him), which will come in al-Hakim (4417), establishes that the lender was indeed Safwan bin Umayyah and that the words were "'ariyah madmunah" (a guaranteed loan). Imam al-Bayhaqi also cites several mursal narrations (from al-Zuhri, 'Urwah and others) which strengthen one another and, together with Jabir's connected narration, become strong.
قلنا: فلا يبعد أن يكون النبي ﷺ قد استعار من كلا الرجلين في حنين، ولكنه قال لأحدهما: "عاريّة مؤداة"، وهو يعلى بن أمية، وقال لصفوان: "عاريّة مضمونة". وقد احتمل الزيلعي في "نصب الراية" 4/ 117 أن تكونا واقعتين، إلّا أنه جعلهما لرجل واحد منهما، والأقرب أن تكونا واقعتين لكلا الرجلين، والله أعلم بالصواب.
General principle: It is not unlikely that at the time of the Battle of Hunayn the Prophet (peace and blessings be upon him) borrowed equipment from both men (Safwan and Ya'la), saying the word "returned" (mu'addah) to one and "guaranteed" (madmunah) to the other. Al-Zayla'i (Nasb al-Rayah 4/ 117) also considered the possibility of these being two separate incidents.
وأخرجه أبو داود (3562)، والنسائي (5747) من طرق عن يزيد بن هارون، بهذا الإسناد.
Reference / Source: Abu Dawud (3562) and al-Nasa'i (5747) recorded it through routes from Yazid bin Harun with this same chain.
وأخرجه أبو داود (3563) من طريق جرير بن عبد الحميد، عن عبد العزيز بن رفيع، عن أناس من آل عبد الله بن صفوان، مرسلًا.
Reference / Source: Abu Dawud (3563) recorded it through Jarir bin 'Abd al-Hamid as "mursal" (that is, without naming the Companion).
وأخرجه كذلك (3564) من طريق أبي الأحوص، عن عبد العزيز بن رفيع، عن عطاء بن أبي ¤ ¤ رباح، عن ناس من آل صفوان، مرسلًا أيضًا.
Reference / Source: Abu Dawud (3564) also recorded it through Abu al-Ahwas, likewise as "mursal".
وأخرجه النسائي أيضًا (5748) من طريق إسرائيل، عن عبد العزيز بن رفيع، عن ابن أبي مُلَيكة، عن عبد الرحمن بن صفوان بن أمية، مرسلًا كذلك.
Reference / Source: Al-Nasa'i (5748) recorded it through Isra'il, from 'Abd al-'Aziz bin Rufay', as "mursal".
وأخرجه النسائي (5746) من طريق هُشَيم، عن حجاج بن أرطاة، عن عطاء بن أبي رباح، مرسلًا. وفيه مع الإرسال عنعنة هُشَيم وحجاج.
Reference / Source: Al-Nasa'i (5746) recorded it through Hushaym as mursal, and it is further weakened by the "'an'anah" (not stating explicit hearing) of Hushaym and Hajjaj.
وأصح من هذه الطريق طريق قتادة، عن عطاء بن أبي رباح، عن صفوان بن يعلى بن أمية، غير أبيه، وهي عند أحمد 29/ (17950)، وأبي داود (3566)، والنسائي (5744) و (5745) من طريق همام بن يحيى، عن قتادة، به. بلفظ: "عاريّة مؤدّاة"، بدلٌ "عاريّة مضمونة".
Preferred view: The most authentic of all these routes is that of Qatadah (Ahmad 29/ 17950, Abu Dawud 3566, al-Nasa'i 5744), which has the words "'ariyah mu'addah" (a loan to be returned) instead of "'ariyah madmunah".
وقال محمد بن إسماعيل الصنعاني في "سبل السلام" 2/ 99: المضمونة التي تُضمن إن تلفت بالقيمة، والمؤداة التي تجب تأديتها مع بقاء عينها، فإن تلفت لم تُضمن بالقيمة.
Juristic definition: Al-San'ani (Subul al-Salam 2/ 99) says that "madmunah" is a loan whose value must be paid if it perishes, while "mu'addah" is one that must be returned in its original state, but if it perishes (without any transgression) its value is not owed.
قلنا: فبين لفظ "مضمونة" ولفظ "مؤداة" اختلاف، إلّا إن حُمل لفظ "مضمونة" على معنى ضمانة الردِّ، كما قال أبو بكر الجصاص في "أحكام القرآن" 3/ 174، وابن القيم في "الزاد" 3/ 422، فلا يكون بمعنى ضمان القيمة عند التلف، وذلك أنَّ لفظة "مضمونة"، تحتمل معنيين: إما ضمانة الرد، أو ضمانة التلف، ويُجعل لفظ "مؤداة" مُرجِّحًا للمعنى الأول للفظ "مضمونة"، فلا يتعارض اللفظان، بل يُحملان على مَحملٍ واحدٍ.
Reconciliation (harmonisation): There is an apparent difference between "madmunah" and "mu'addah", but if "madmunah" is taken to mean "a guarantee of return" (as al-Jassas and Ibn al-Qayyim said) rather than "a guarantee of its value if it perishes", then no conflict remains between the two words and both carry one meaning.
وإذا صرنا إلى الترجيح بين اللفظين على أساس افتراقهما في المعنى فلفظ "مُؤداة" أرجح، لحديث أبي أمامة الذي أخرجه أبو داود (3565)، وابن ماجه (2398)، والترمذي (2120)، والنسائي (5749) و (5750)، وصحَّحه الترمذي: "العاريّة مؤداة، والمِنحة مردودة، والدَّين مقضيٌّ، والزعيم غارم"، وإذا صحَّ ذلك كان قوله: "العارية مؤداة" غير مدفوع باتفاق بين أهل العلم، لأنّها مؤداة عند الجميع ما كانت باقية، فإذا تلفت فلا سبيل إلى أدائها، وإذا لم يكن إلى أدائها سبيل فغير جائز تضمينها بغير حجة، كما نبَّه عليه ابن المنذر في "الأوسط" بإثر (8630) و (8631)، وأبو بكر الجصاص في "أحكام القرآن" 3/ 174.
Preference (tarjih): If one of the two must be preferred, the word "mu'addah" is weightier, because it is the word that occurs in the well-known hadith of Abu Umamah (Abu Dawud 3565, al-Tirmidhi 2120 and others), which al-Tirmidhi declared sahih: "A loan is to be returned, a lent milch-animal (minhah) is to be given back, a debt is to be repaid, and the guarantor is liable." According to Ibn al-Mundhir, all agree that the item must be returned as long as it exists, but imposing liability (daman) once it has perished, without evidence, is not correct.
