أخبرنا حمزة بن العباس العَقَبي، حدثنا العباس بن محمد الدُّوْري، حدثنا يعقوب بن إسحاق الحَضْرمي، حدثنا حماد بن سَلَمة، عن سِماك بن حَرْب، عن سعيد بن جُبير، عن ابن عمر، قال: كنت أبيعُ الإبل بالبقيع، فأبيعُ بالدنانير وآخذُ الدراهمَ، وأبيع بالدراهم وآخذ الدنانيرَ، فوقع في نفسي مِن ذلك، فأتيتُ رسولَ الله ﷺ وهو في بيت حفصة - أو قال: حين خرج من بيت حفصة - فقلتُ: يا رسول الله، رُوَيدَك أسألْك، إني أبيعُ الإبلَ بالبَقيع، فأبيعُ بالدنانير وآخذ الدراهمَ، وأبيعُ بالدراهم وآخذ الدنانير، فقال: "لا بأسَ أن تأخذَهُما بسعر يومِهما ما لم تتفرّقا وبينكما شيءٌ" (1). هذا حديث صحيح على شرط مسلم، ولم يُخرجاه. It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both): I used to sell camels at al-Baqi'. I would make the sale in dinars but receive payment in dirhams, and sometimes sell in dirhams and receive dinars. Some unease arose in my heart about this, so I came to the Messenger of Allah (peace and blessings be upon him) while he (peace and blessings be upon him) was in the house of Sayyidah Hafsah (may Allah be pleased with her) (or was coming out of it). I said: O Messenger of Allah! Wait a moment, I wish to ask you a question. I sell camels at al-Baqi'; I sell for dinars and take dirhams, and I sell for dirhams and take dinars. He (peace and blessings be upon him) said: "There is no harm in your taking payment at that day's market rate, as long as you complete the account before you part from one another and nothing remains (outstanding) between you."
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it.

Grading: Its chain is hasan because of Simak bin Harb. Besides the author (al-Hakim), Ibn al-Jarud (655), Ibn Hibban (4920), Ibn 'Abd al-Barr (al-Tamhid 6/ 292), Ibn Taymiyyah (al-Fatawa 29/ 510) and Ibn al-Qayyim (Hashiyah on Abu Dawud 5/ 153) also declared it sahih. وما أُعِلّ به هذا الحديثُ من تفرد سماك بن حرب برفعه، فلا يُعد عِلَّةً، لأنَّ الذين رووه ممن ذكرهم شعبة فيما نقله عنه البيهقي في "المعرفة" (11322) إنما رَوَوا فعلَه بمقتضى ما ورد في رواية سماكٍ هذه، وفي رواية سماكٍ قصةٌ في مجيء ابن عمر إلى بيت أخته حفصة وسؤاله النبيَّ ﷺ لدى خروجه من بيتها، فيبعد أن يكون سماك وهم برفعه الحديث وبذكر القصة فيه، وهذا مما يُستبعد مثلُه، فالأَولى أن يُقال: إنَّ ابن عمر عمل بمقتضى ما رواه هو نفسه عن النبي ﷺ مرشدًا إياه إلى ما التزم ابنُ عمر القيام به امتثالًا لأمره ﷺ، والله أعلم بالصواب. Technical note: The objection raised against this hadith on account of Simak bin Harb being alone in narrating it is not valid, because it contains a complete incident (story): Ibn 'Umar came to the house of his sister Hafsah and asked the Prophet (peace and blessings be upon him). It is unlikely that a narrator like Simak would err in such a detailed incident. Important point: The correct view is that Ibn 'Umar acted upon the very instruction of the Prophet (peace and blessings be upon him) that he himself narrated. وكنا قد ضعفنا إسناد الحديث في "مسند أحمد"، و"سنن أبي داود" فيستدرك من هنا. Note / Clarification: We had earlier called it weak in our editions of "Musnad Ahmad" and "Sunan Abi Dawud", but here we correct that (istidrak) and declare it authentic. وأخرجه أحمد 9/ (5559) و 10/ (6239)، وأبو داود (3354)، وابن ماجه (2262 م)، والترمذي (1242)، والنسائي (6136)، وابن حبان (4920) من طرق عن حماد بن سلمة، بهذا الإسناد. Reference / Source: Imam Ahmad, Abu Dawud, Ibn Majah, al-Tirmidhi, al-Nasa'i and Ibn Hibban recorded it through various routes from Hammad bin Salamah with this same chain. وأخرجه ابن ماجه (2262) من طريق عمر بن عُبيد الطنافسي، والنسائي (6131) من طريق أبي الأحوص، كلاهما عن سماك، به. إلّا أنَّ عمر الطنافسي قال: حدثنا عطاء بن السائب أو سماك، ولا أعلمه إلّا سماك. Reference / Source: Ibn Majah recorded it through 'Umar bin 'Ubayd al-Tanafisi and al-Nasa'i through Abu al-Ahwas, both from Simak. وممَّن كان يفتي بمقتضى هذا الحديث عمر بن الخطاب، فيما رواه عنه ابن المنذر في "الأوسط" ¤ ¤ (8048) بسند حسن. ثم ذكره ابن المنذر عن جماهير أهل العلم من التابعين فمن بعدهم غير ابن عباس وأبي سلمة بن عبد الرحمن بن عوف وابن شُبرمة. Important point: 'Umar bin al-Khattab (may Allah be pleased with him) used to give fatwas in accordance with this hadith (al-Awsat 8048, with a hasan chain). According to Ibn al-Mundhir, this is the position of the majority of scholars among the Successors and those after them, except Ibn 'Abbas and a few others. وقال ابن القيم في "حاشية السنن" 5/ 153: فجوَّز النبي ﷺ ذلك بشرطين: General principle: Ibn al-Qayyim (may Allah have mercy on him) says that the Prophet (peace and blessings be upon him) permitted (exchanging dirhams for dinars) with two conditions: أحدهما: أن يأخذ بسعر يوم الصرف، لئلا يربح فيها، وليستقر ضمانه.
1⃣ The first condition: that the deal be at that same day's rate (si'r yawm al-sarf), so that no (undue) profit is made and liability remains fixed. والثاني: أن لا يتفرقا إلّا عن تقابض، لأنه شرطٌ في صحة الصرف، لئلا يدخله النسيئة.
2⃣ The second condition: that the exchange (taqabud) be completed before parting, since this is a condition for the validity of a currency exchange (bay' al-sarf), so that usury (deferment) does not enter it.
