Mustadrak al-Hakim — Hadith 2313

حدثنا أبو بكر أحمد بن سَلْمان الفقيه، حدثنا الحسن بن مُكْرم، حدثنا رَوْح بن عُبادة، حدثنا حَيّان بن عُبيد الله العَدَوي، قال: سألت أبا مِجلَزٍ عن الصَّرْف، فقال: كان ابنُ عباس لا يرى به بأسًا زمانًا من عمره ما كان منه عَينًا - يعني يدًا بيد - وكان يقول: إنما الربا في النَّسيئة، فلَقِيَه - أبو سعيد الخُدْري، فقال له: يا ابن عباس، ألا تتَّقي اللهَ، إلى متى تُوكِل الناسَ الربا؟! أمَا بَلَغَك أنَّ رسول الله ﷺ قال ذات يوم وهو عند زوجته أم سَلَمة: "إني لأشتَهي تمرَ عَجْوةٍ"، فبعثَتْ صاعَين من تمرٍ إلى رجلٍ من الأنصار، فجاءت بدلَ صاعَينِ صاعًا من تمرِ عَجْوةٍ، فقامت فقدَّمتْه إلى رسول الله ﷺ، فلما رآهُ أعجبَه، فتناولَ تمرةً ثم أمسَكَ، فقال: "من أين لكم هذا؟ " فقالت أم سَلَمة: بعثتُ صاعَين من تمرٍ إلى رجل من الأنصار، فأتانا بدلَ صاعَين هذا الصاعُ الواحدُ، وها هو، كُلْ، فألقى التمر من بين يديه، قال: "رُدُّوه، لا حاجةَ لي فيه: التمرُ بالتمرِ، والحنطةُ بالحنطةِ، والشعيرُ بالشعيرِ، والذهبُ بالذهبِ، والفضةُ بالفضةِ، يدًا بيد، عينًا بعين، مِثلًا بمِثل، فمن زاد فهو رِبًا". ثم قال: "كذلك ما يُكال أو يُوزن أيضًا". فقال ابن عباس: جزاك الله يا أبا سعيدٍ الجنةَ، فإنك ذكَّرتني أمرًا كنت نُسِّيتُه، أستغفرُ اللهَ وأتوبُ إليه. فكان ينهى عنه بعد ذلك أشدَّ النَّهْي (1)
هذا حديث صحيح الإسناد، ولم يُخرجاه بهذه السِّياقة.

Hayyan bin Ubaydullah al-Adawi (may Allah have mercy on him) relates: I asked Abu Mijlaz about sarf (exchanging currency for currency), and he told me that Sayyiduna Ibn Abbas (may Allah be pleased with them both) for a long period of his life saw no harm in it (when the exchange was hand to hand), and he used to say that usury (riba) is only in deferred transactions. Then he met Sayyiduna Abu Sa'id al-Khudri (may Allah be pleased with him), who said: O Ibn Abbas! Do you not fear Allah? How long will you go on making people consume usury? Has it not reached you that the Messenger of Allah (peace and blessings be upon him), while staying one day with his wife Sayyidah Umm Salamah (may Allah be pleased with her), said: "I have a craving for 'ajwah dates"? So she sent two sa' of dates to a man of the Ansar (to exchange them) and in return received one sa' of 'ajwah dates. She presented them to the Messenger of Allah (peace and blessings be upon him), and he liked the dates. He picked up a date to eat, but then held back and asked: "Where did you get this from?" Sayyidah Umm Salamah (may Allah be pleased with her) said: I sent two sa' of dates to a man of the Ansar, and in exchange for the two sa' he brought us this one sa'; here it is, eat. So he (peace and blessings be upon him) pushed the dates away from in front of him and said: "Return it; I have no need of it. Dates for dates, wheat for wheat, barley for barley, gold for gold and silver for silver must be exchanged hand to hand, on the spot and in equal measure; whoever gives more has engaged in usury." Then he (peace and blessings be upon him) said: "The same applies to everything that is measured by volume or by weight." On hearing this, Ibn Abbas (may Allah be pleased with them both) said: O Abu Sa'id! May Allah reward you with Paradise, for you have reminded me of something I had forgotten. I seek Allah's forgiveness and repent to Him. After that he used to forbid it in the strongest terms.
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it with this wording.

Grading: Its chain is hasan because of Hayyan bin 'Ubayd Allah al-'Adawi. Abu Mijlaz's name is Lahiq bin Humayd.
Reference / Source: Al-Marwazi recorded it in "al-Sunnah" (177), Ibn Bishran in his "Amali" (1442) and Ibn Hazm in "al-Muhalla" 8/ 479 through Ishaq bin Rahawayh.
وأخرجه ابن عدي في "الكامل" 2/ 425، ومن طريقه البيهقي 5/ 286 من طريق إبراهيم بن الحجاج، والبيهقي 5/ 286، والخطيب البغدادي في "الفقيه والمتفقه" (372) من طريق يونس بن محمد المؤدِّب، كلاهما عن حيّان بن عبيد الله، به.
Reference / Source: Ibn 'Adi recorded it in "al-Kamil" 2/ 425, al-Bayhaqi 5/ 286, and al-Khatib al-Baghdadi in "al-Faqih wa-l-Mutafaqqih" (372), through Hayyan bin 'Ubayd Allah.
وأخرج منه فتوى ابنِ عباس بنحو ما وقع هنا مسلمٌ (1595) (99) و (100) من طريق أبي نضرة - واسمه المنذر بن مالك بن قِطْعة - عن ابن عباس.
Reference / Source: A similar fatwa of Ibn 'Abbas (may Allah be pleased with him) is reported by Imam Muslim (1595/ 99, 100) through Abu Nadrah (al-Mundhir bin Malik) from Ibn 'Abbas.
وأخرج البخاري (2178)، ومسلم (1596) من طرق عن ابن عباس أنَّ الذي أخبره عن النبي ﷺ: أنَّ الربا إنما يكون في النسيئة؛ وهو أسامة بن زيد.
Reference / Source: In al-Bukhari (2178) and Muslim (1596) it is narrated from Ibn 'Abbas that Usamah bin Zayd (may Allah be pleased with him) informed him that the Prophet (peace and blessings be upon him) said: "Riba (usury) is only in deferment (nasi'ah)."
وأخرج مراجعة أبي سعيد الخُدْري لابن عباس في ذلك البخاريُّ (2178)، ومسلمٌ (1596) (101) من طريق أبي صالح السمان، ومسلم (1596) (104) من طريق عطاء بن أبي رباح، كلاهما عن أبي سعيد الخُدْري.
Reference / Source: Abu Sa'id al-Khudri's (may Allah be pleased with him) debate with Ibn 'Abbas on this issue is recorded by al-Bukhari (2178) and Muslim (1596/ 101, 104) through the routes of Abu Salih al-Samman and 'Ata' bin Abi Rabah.
وأخرج البخاري (2312)، ومسلم (1594) نحو القصة التي بيَّن فيها أبو سعيد حجته في تحريم الفضل من طريق عقبة بن عبد الغافر، عن أبي سعيد الخُدْري. لكن ذكر فيها بلالًا ولم يذكر أم سلمة، ولم يذكر فيها الأصناف الربوية المذكورة هنا، بل اقتصر على ذكر التمر، وقال: "إذا أردتَ أن تشتري فبع التمر ببيع آخر، ثم اشتره".
Reference / Source: Al-Bukhari (2312) and Muslim (1594) narrate something similar to the story in which Abu Sa'id al-Khudri set out his proof for the prohibition of usury. There Bilal is mentioned, and he (peace and blessings be upon him) said: "When you want to buy (good dates), sell your dates in a separate sale, then buy with it."
ونحوه عند مسلم (1595) (100) من طريق أبي نَضْرة، عن أبي سعيد.
Reference / Source: Something similar is narrated in Muslim (1595/ 100) from Abu Nadrah, from Abu Sa'id al-Khudri.
وأخرج البخاري (2201) و (2302) و (7350)، ومسلم (1593) من طريق سعيد بن المسيب عن أبي سعيد وأبي هريرة، قصةً حصلت لعامل النبي ﷺ على خيبر باع منها تمرًا بتمر صاعًا بصاعين، وقال فيها النبي ﷺ نحو ما قال في رواية عقبة بن عبد الغافر المذكورة، وزاد فيها: وكذلك الميزان، وفي رواية: وقال في المِيْزان مثل ذلك.
Reference / Source: Al-Bukhari (2201, 2302, 7350) and Muslim (1593) narrate through Sa'id bin al-Musayyib the story of the governor of Khaybar, mentioning a sa' of dates for two sa's; there he (peace and blessings be upon him) said: "The same applies to what is weighed (al-mizan)."
وهذه الزيادة هي بمعنى قوله في رواية الحاكم هنا: كذلك ما يُكال أو يُوزَن أيضًا.
Important point: This addition (about weighing) has the same meaning as Imam al-Hakim's narration here, which says: "Likewise everything that is measured by volume or by weight."
وقد ذكر البيهقي في "السنن الكبرى" 5/ 286 أنَّ هذه الجملة من جهة أبي سعيد الخُدْري، أي: من قوله استعمل فيها القياس، وليست مرفوعةً، واستدل لذلك برواية داود بن أبي هند، عن أبي نضرة، عن أبي سعيد في احتجاجه على ابن عباس بقصة التمر، وقوله له: فالتمر بالتمر أحق أن يكون ربا أم الفضة بالفضة، قال: فكان هذا قياسًا من أبي سعيد للفضة على التمر الذي روى فيه قصة، إلّا أنَّ بعض الرواة رواه مفسَّرًا مفصولًا، وبعضهم رواه مجملًا موصولًا. ¤ ¤ قلنا: يعني أنه أدرجه بعضُ الرواة في الخبر.
Technical note: Al-Bayhaqi mentioned in "al-Sunan al-Kubra" 5/ 286 that this sentence ("what is measured by volume or weight") is Abu Sa'id al-Khudri's own statement, which he used by way of analogy (qiyas); it is not part of the marfu' hadith, rather some narrators inserted it (idraj) into the hadith.
لكن قال ابن عبد البر في "التمهيد" 20/ 57: هو أمر مُجتَمَعٌ عليه لا خلاف بين أهل العلم فيه كلٌّ يقول على أصله: إن ما داخَلَه الربا في الجنس الواحد من جهة التفاضل والزيادة لم تجز فيه الزيادة والتفاضل لا في كيل ولا في وزن، والكيل والوزن عندهم في ذلك سواء.
General principle: Ibn 'Abd al-Barr says in "al-Tamhid" 20/ 57 that there is consensus on this issue and no disagreement among the scholars: in things where riba occurs within a single kind, excess and inequality are not permitted, whether they are measured by volume or by weight.
وأخرج المرفوع منه في ذكر الأصناف التي يجري فيها الربا: أحمد 18/ (11466)، ومسلم (1587) (81)، والنسائي (6113) من طريق أبي المتوكل الناجي، عن أبي سعيد الخُدْري، بزيادة ذكرُ "الملح بالملح"، وزاد أيضًا: "فمن زاد أو استزاد فقد أربي، الآخِذُ والمعطي فيه سواءٌ".
Reference / Source: The marfu' hadith mentioning these kinds is recorded by Imam Ahmad 18/ (11466), Muslim (1587/ 81) and al-Nasa'i (6113) through Abu al-Mutawakkil al-Naji; it adds "salt for salt", and also that "the taker and the giver are equal in it."
وأخرج منه تراجُع ابن عباس عن قوله أحمد 18/ (11479) من طريق أبي الجوزاء، ومسلم (1595) (100) من طريق أبي الصهباء، كلاهما عن ابن عباس. وفي رواية أبي الجوزاء قال له ابنُ عباس: إنَّ ذلك كان عن رأيي، وهذا أبو سعيد الخُدْري يُحدِّث عن رسول الله ﷺ، فتركت رأيي إلى حديث رسول الله ﷺ.
Reference / Source: Ibn 'Abbas's retraction of his view is recorded by Ahmad 18/ (11479) and Muslim (1595/ 100). In the narration of Abu al-Jawza', Ibn 'Abbas said: "That was my own opinion, and Abu Sa'id narrates a hadith from the Messenger of Allah (peace and blessings be upon him), so I have left my opinion for the hadith."
وتمر العجوة: هو أجود التمر في المدينة، ومن خِياره الصَّيحاني.
Note / Clarification: 'Ajwah dates are the finest dates of Madinah, and among its choicest varieties is "Sayhani".
