Mustadrak al-Hakim — Hadith 2282

أخبرنا أبو بكر بن إسحاق الفقيه، أخبرنا العباس بن الفضل الأسفاطي، حدثنا إسماعيل بن يزيد الأصبهاني، حدثنا يحيى بن الضُّرَيس، عن إبراهيم بن طَهْمان، عن الحجّاج بن الحجّاج، عن قَتَادة، عن الحسن، عن سَمُرة: أنَّ النبي ﷺ نهى عن بيع الشاةِ باللَّحْم (1)
هذا حديث صحيح الإسناد، رواتُه عن آخرهم أئمةٌ حفاظٌ ثقاتٌ، ولم يُخرجاه، وقد احتجَّ البخاريُّ بالحسن عن سمرة. وله شاهدٌ مرسلٌ في "موطأ مالك":

It is narrated from Sayyiduna Samurah bin Jundub (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) forbade selling a goat in exchange for meat.
This hadith has an authentic chain (sahih al-isnad), and all its narrators are reliable imams and hadith masters, but the two Shaykhs (Bukhari and Muslim) did not record it; Imam Bukhari has used the narration of al-Hasan al-Basri from Samurah as evidence. It also has a mursal supporting report (shahid) in the Muwatta of Imam Malik.

(1) إسناده قوي، وصحَّحه البيهقي في "السنن الكبرى"، وسماع الحسن من سمرة صحيح كما بينّاه عند الحديث المتقدم برقم (151).
Grading: Its chain is "qawi" (strong), and al-Bayhaqi declared it sahih; the hearing of al-Hasan al-Basri from Samurah is authentic, as has passed in the explanation at number (151).
وأخرجه البيهقي 5/ 296 عن أبي عبد الله الحاكم، عن يحيى بن منصور القاضي، عن أبي بكر بن خزيمة، عن أحمد بن حفص السَّلَمي، عن أبيه، عن إبراهيم بن طهمان، بهذا الإسناد. وهذه الطريق ليست عند الحاكم في "المستدرك"، وهي متابعة قوية جدًّا للطريق التي هنا عن ابن طهمان.
Reference / Source: Al-Bayhaqi (5/ 296) narrated it through the chain of Imam al-Hakim by way of Ibn Khuzaymah; this route is not found in al-Mustadrak, but it is a very strong corroboration for Ibrahim bin Tahman.
ويشهد له مرسلُ سعيد بن المسيب الذي بعده، كما قال الحاكم.
Corroborating chains and supporting reports: The "mursal" narration of Sa'id bin al-Musayyab, which comes after it, is a supporting report (shahid) for it.
وأخرج الشافعي في القديم كما في "معرفة السنن والآثار" للبيهقي (11144) عن سعيد بن سالم القداح، عن ابن أبي الزِّناد، عن أبيه، عن القاسم بن محمد وسعيد بن المسيب وعروة بن الزُّبَير وأبي بكر بن عبد الرحمن: أنهم كانوا يُحرِّمون بيع اللحم الموضوع بالحيوان عاجلًا وآجلًا، يعظّمون ذلك ولا يرخّصون فيه.
Reference / Source: Imam al-Shafi'i narrated in "al-Qadim" that al-Qasim bin Muhammad, Sa'id bin al-Musayyab, Urwah and Abu Bakr bin Abd al-Rahman considered the sale of a live animal in exchange for meat to be unlawful and gave no concession in it.
وقال أبو الزِّناد فيما نقله عنه مالك 2/ 655: كل من أدركتُ من الناس ينهون عن بيع الحيوان باللحم، قال أبو الزِّناد: وكان ذلك يُكتب في عهود العُمّال في زمان أبان بن عثمان وهشام بن إسماعيل، ينهون عن ذلك.
Historical testimony: Abu al-Zinad says that in the time he witnessed, people used to forbid the sale of an animal in exchange for meat, and this prohibition was formally written in the official orders of the governors.
وقد روي من طرق عن قتادة، عن الحسن البصري، عن سمرة، قال: نهى رسول الله ﷺ عن بيع الحيوان بالحيوان نسيئة. أخرجه أحمد 33/ (20143)، وأبو داود (3356)، وابن ماجه (2270)، والترمذي (1237)، والنسائي (6170). وقال الترمذي حديث حسن صحيح.
Reference / Source: It is narrated from Samurah bin Jundub that the Prophet (peace and blessings be upon him) forbade selling an animal for an animal on credit (nasi'ah); Abu Dawud (3356), al-Tirmidhi (1237) and al-Nasa'i narrated it, and al-Tirmidhi called it "hasan sahih".
ولكن هذا يختلف عن مسألة بيع اللحم بالحيوان، لأنَّ بيع اللحم بالحيوان بيع ميت بحيٍّ، وبيع الحيوان بالحيوان بيع حيٍّ بحيّ، وقد روي ما يدل على جواز بيع الحي بالحي متفاضلًا، ومن ذلك: أنَّ رسول الله ﷺ اشترى عبدًا بعبدين. أخرجه أحمد 23/ (14772)، ومسلم (1602) من حديث جابر بن عبد الله.
Juristic point: There is a difference between selling an animal for meat and selling an animal for an animal, because meat is dead (slaughtered) while the animal is alive; whereas selling a live animal for a live animal with unequal quantity (tafadul) is permissible, as the Prophet (peace and blessings be upon him) bought one slave for two slaves (Sahih Muslim 1602).
ومنه: أنَّ النبي ﷺ اشترى صفية بنت حيي من دحية الكلبي بسبعة أرؤس. أخرجه أحمد 19/ (12240)، ومسلم (1427) (87) من حديث أنس بن مالك.
Corroborating chains and supporting reports: Also, the Prophet (peace and blessings be upon him) bought Safiyyah from Dihyah al-Kalbi in exchange for seven persons (slaves/captives) (Sahih Muslim 1427).
ومنه أنَّ ابن عباس سئل: بعير ببعيرين، فقال: قد يكون البعير خيرًا من البعيرين. أخرجه ¤ ¤ الشافعي في "الأم" 3/ 119، وعبد الرزاق في "المصنف" (14140)، وعلَّقه البخاري بين يدي الحديث (2228).
Corroborating chains and supporting reports: Ibn Abbas was asked about selling one camel for two camels, and he said: "One camel may be better than two"; Imam al-Shafi'i narrated it in "al-Umm", and al-Bukhari mentioned it in suspended form (ta'liqan).
ولم ير جابر بن عبد الله بأسًا بالبعير بالبعيرين. أخرجه ابن أبي شيبة 6/ 114.
Corroborating chains and supporting reports: Jabir bin Abd Allah also saw no harm in selling one camel for two camels (on the spot).
وقال عبد الله بن عمر: من يبيعني بعيرًا ببعيرين، من يبيعني ناقة بناقتين. أخرجه ابن أبي شيبة 6/ 118.
Corroborating chains and supporting reports: Abd Allah bin Umar also used to say openly: who will buy from me two camels in exchange for one camel or she-camel?
ووردت آثار أخرى تدل على جواز اجتماع النسيئة إلى الفضل في بيع الحي بالحي، ومن ذلك: أنَّ رسول الله ﷺ أمر عبد الله بن عمرو بن العاص أن يجهز جيشًا، فنفدت الإبل، فأمره أن يأخذ على قلائص الصدقة، فكان يأخذ البعير بالبعيرين إلى إبل الصدقة. أخرجه أبو داود (3357)، وصحَّحه البيهقي 5/ 287 من طريق أخرى أوردها غير طريق أبي داود عن عبد الله بن عمرو.
Juristic point: The evidence for permitting inequality together with credit is that the Prophet (peace and blessings be upon him) ordered Abd Allah bin Amr to equip an army; when the camels ran out, he (peace and blessings be upon him) told him to take two camels for one camel on credit until the camels of charity (sadaqah) arrived (Abu Dawud 3357).
واشترى عبد الله بن عُمر راحلةً بأربعة أبعرةٍ مضمونة عليه، يوفيها صاحبها بالربذة. أخرجه مالك 2/ 652، وعلقه البخاري بين يدي الحديث (2228).
Corroborating chains and supporting reports: Abd Allah bin Umar bought a riding camel for four camels on credit (Muwatta' Malik 2/ 652).
واشترى رافع بن خديج بعيرًا ببعيرين، فأعطاه أحدَهما، وقال: آتيك بالآخر غدًا رهوًا إن شاء الله. والرهو بفتح الراء وسكون الهاء، أي: سهلًا، والمراد يأتيه به سريعًا من غير مطل كما قال الحافظ ابن حجر في "الفتح" 7/ (263). أخرجه عبد الرزاق (14141)، وعلَّقه البخاري.
Corroborating chains and supporting reports: Rafi' bin Khadij bought two camels in exchange for one camel; he gave one on the spot and promised to bring the other the next day; Imam al-Bukhari mentioned it in suspended form (ta'liqan).
وقال سعيد بن المسيب: لا ربا في الحيوان، البعير بالبعيرين، والشاة بالشاتين إلى أجل. أخرجه مالك 2/ 654، وعلَّقه البخاري.
Juristic point: Sa'id bin al-Musayyab used to say that there is no usury (riba) in animals: two camels for one, or two goats for one, on credit, are permissible.
ووردت آثار أخرى تدل على منع النسيئة دون الفضل في بيع الحي بالحي، ومن ذلك حديث قَتَادة، عن الحسن، عن سمرة: أنَّ رسول الله ﷺ نهى عن بيع الحيوان بالحيوان نسيئةً، وقد تقدم تخريجه قريبًا في هذا التعليق.
Variation in the chain: In contrast, some narrations, such as the hadith of Samurah bin Jundub, prohibit credit (nasi'ah).
ومنه عن عمر بن الخطاب: أنه سئل عن الشاة بالشاتين إلى الخِصب، فكره ذلك. أخرجه ابن أبي شيبة 6/ 117.
Corroborating chains and supporting reports: Umar bin al-Khattab was asked about selling one goat for two goats on credit, and he disliked it.
وسأل أنس بن سيرين ابنَ عُمر عن البعير بالبعيرين إلى أجل، فقال: يدًا بيد؟ فقلت: لا، قال: فكرهه. أخرجه ابن أبي شيبة 6/ 115. ولكن هذا من ابن عمر يعارض رأيه الذي قدمناه من تجويزه ذلك، لكن قال الحافظ ابن حجر في "التلخيص الحبير" 3/ 33: يمكن الجمع بأنه كان يرى فيه الجواز، وإن كان مكروهًا على التنزيه، لا على التحريم.
Technical note / Defect ('illah): Anas bin Sirin asked Ibn Umar about selling one camel for two camels on credit, and he disliked it; according to al-Hafiz Ibn Hajar, this dislike means "karahat tanzih" (mild dislike), not "prohibition", because Ibn Umar's own practice contrary to it is also established.
وقال سويد بن غَفَلة: لا بأس بالفرس بالفرسين، والدابة بالدابتين، يدًا بيد. أخرجه ابن أبي شيبة 6/ 117. ¤ ¤ وقد ذكر الحافظ في "فتح الباري" 7/ 520 أنَّ الشافعي وجماعة قد جمعوا بين هذه الآثار بحمل النهي على ما إذا كان نسيئةً من الجانبين، قال: ويتعين المصير إلى ذلك، لأنَّ الجمع بين الحديثين أولى من إلغاء أحدهما، وإذا كان ذلك المراد من الحديث، بقيت الدلالة على جواز استقراض الحيوان والسَّلَم فيه.
Important point: Imam al-Shafi'i and other jurists reconciled all these reports by saying that the prohibition applies when there is credit on both sides; in this way all the hadiths are acted upon, and room remains for credit or loans in animals.
قلنا: وأما بيع اللحم بالشاة، يعني بيع الميت بالحي، فلا توجد نصوص تعارض النهي عنه، فيبقى النهي على أصلِه، والله تعالى أعلم.
Juristic point: As for selling meat in exchange for a live animal (for example, a goat), there is no text against its prohibition; hence it remains on its original ruling (prohibition).
