Mustadrak al-Hakim — Hadith 2259

أخبرنا أبو بكر بن إسحاق الفقيه، أخبرنا علي بن عبد العزيز، حدثنا القَعْنبي، حدثنا عبد العزيز بن محمد، عن عمرو بن أبي عمرو، عن عِكْرمة، عن ابن عباس: أنَّ رجلًا لَزِمَ غَريمًا له بعشرة دنانير، فقال له: والله ما عندي قضاءٌ أَقْضِيكَهُ اليومَ، قال: فواللهِ لا أُفارِقُكَ حتَّى تَقضِيَ أو تأتيَ بحَمِيلٍ يَحمِلُ عنك، قال: واللهِ ما عندي قضاءٌ، وما أجدُ أحدًا يَحمِلُ عني، قال: فَجَرَّه إلى رسول الله ﷺ، فقال: يا رسول الله، هذا لازِمي واستَنْظرتُه شهرًا واحدًا، فأَبى حتَّى أقضيَه أو آتيَه بحَمِيل، فقلتُ: والله ما أجدُ حَمِيلًا، ولا عندي قضاءٌ اليومَ. فقال له رسولُ الله ﷺ: "هل تَستَنظِرُه إِلّا شهرًا واحدًا؟ " قال: لا، قال: "فأنا أتحمَّل بها عنكَ" قال: فتحمَّلها رسولُ الله ﷺ عنه، فذهب الرجلُ فأتى بقَدْر ما وَعَدَه، فقال له رسولُ الله ﷺ: "من أين أصبتَ هذا الذَّهَب؟ " قال: من مَعْدِنٍ، قال: "فاذهبْ، فلا حاجةَ لنا فيها، ليس فيها خَيرٌ"، فقضاها عنه رسولُ الله ﷺ (2).
هذا حديث صحيح على شرط البخاري لعمرو بن أبي عمرو، والدَّرَاوَرْدِي على شرط مسلم، ولم يُخرجاه.

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that a man held on to a debtor of his over ten dinars. The debtor said to him: "By Allah, I have nothing with which to pay you today." He said: "By Allah, I will not leave you until you pay or bring a guarantor who will take responsibility on your behalf." He said: "By Allah, I have nothing to pay with, and I cannot find anyone to take responsibility for me." The narrator said: So he dragged him to the Messenger of Allah (peace and blessings be upon him). He (the debtor) said: "O Messenger of Allah, this man is clinging to me. I asked him for respite of a single month, but he refused unless I pay him or bring him a guarantor. I said: By Allah, I cannot find a guarantor, and I have nothing to pay with today." The Messenger of Allah (peace and blessings be upon him) said to him: "Are you asking him for more than a single month's respite?" He said: "No." He (peace and blessings be upon him) said: "Then I will stand as guarantor for it on your behalf." So the Messenger of Allah (peace and blessings be upon him) took responsibility for it on his behalf. The man went and brought the amount he had promised. The Messenger of Allah (peace and blessings be upon him) asked him: "Where did you get this gold?" He said: "From a mine." He (peace and blessings be upon him) said: "Go, we have no need of it; there is no good in it." Then the Messenger of Allah (peace and blessings be upon him) paid it off on his behalf himself.
This hadith is sahih (authentic) on the condition of Bukhari on account of Amr bin Abi Amr, and on the condition of Muslim on account of al-Darawardi, but the two Shaykhs did not record it.

Grading: Its chain is "jayyid" (very good)
Note / Clarification: Al-Qa'nabi is Abd Allah bin Maslamah, and Amr bin Abi Amr is the freed slave of al-Muttalib bin Abd Allah.
وأخرجه أبو داود (3328) عن عبد الله بن مسلمة القعنبي، بهذا الإسناد.

وأخرجه ابن ماجه (2406) عن محمد بن الصبّاح، عن عبد العزيز بن محمد، به.

والحَميل: الكفيل.
Note / Clarification: "Al-hamil" means a guarantor or surety.
والمَعدِن: هو الموضع الذي يستخرج منه شيء من جواهر الأرض كالذهب والفضة والنحاس، وغير ذلك، وهو ما يُسمَّى أيضًا بالمنجم.
Note / Clarification: "Al-ma'din" is the place from which the minerals of the earth, such as gold, silver, copper and the like, are extracted, which today is called a "mine".
وقوله: "لا حاجة لنا فيها، ليس فيها خير" قال الخطابي: يشبه أن يكون ذلك لسبب عَلِمَه فيه النبيُّ ﷺ خاصة، لا من جهة أنَّ الذهب المستخرج من المعدن لا يباح تملكه وتموُّله، فإنَّ عامة الذهب والورِق مستخرجة من المعادن …
Main discussion: His (peace and blessings be upon him) saying "We have no need of it, there is no good in it": Imam al-Khattabi says that this was because of that person's particular situation, not because gold extracted from a mine is forbidden, since gold and silver generally come from mines.
قال: ويُحتمل أن يكون ذلك من أجل أنَّ أصحاب المعادن يبيعون ترابها ممن يُعالجه فيحصّل ¤ ¤ ما فيه من ذهب أو فضة، وهو غرر، لأنه لا يُدرى هل يوجد فيه شيء أم لا؟
Juristic point: One possibility is that the owners of the mines used to sell its soil, from which gold was extracted; this is "gharar" (deception/an uncertain transaction), because it is not known whether anything will come out of the soil or not.
قال: وفيه وجه آخر، وهو أنَّ معناه: ليس لها رَواجٌ، ولا لحاجتنا فيها نجاح، وذلك أنَّ الذي جاء به تَبْرٌ غير مضروب، وليس بحضرته من يضربه دنانير.
Juristic point: A second possibility is that at that time this gold was not in circulation, because it was in the form of "tibr" (nuggets) and there was no one present there to cast it into dinars.
قال: ويحتمل أن يكون إنما كرهه لما يقع فيه من الشبهة ويدخله من الغرر عند استخراجه من المعدن، وذلك أنهم استخرجوه بالعشر أو الخمس أو الثلث مما يصيبونه، وهو غرر لا يُدرى هل يُصيبُ العاملُ فيه شيئًا أم لا؟
Juristic point: It is also possible that it was disliked because of the doubt or deception involved in extracting it, for example employing workers for a tenth or a fifth of the yield, while it is not known whether anything will come out or not.
قال: وفيه أيضًا نوع من الخطر والتغرير بالأنفس، لأنَّ المعدن ربما انهار على من يعمل فيه، فكره من أجل ذلك معالجته واستخراج ما فيه.
Juristic point: There is also a risk to life in it, as the mine may collapse on those working in it; for this reason too this work was disliked.
قلنا: وحمله الطحاوي في "شرح المشكل" 12/ 228 على وجهٍ استحسنه، وهو أنه لما كان هذا الذهب تبرًا غير مضروب، وهو عند الناس دون الدنانير المضروبة، وكان من شريعته ﷺ أنَّ خيار الناس أحسنهم قضاءً، وكان هو أولى الناس بذلك، فلو دفع إليه النبي ﷺ ذلك التبر لم يُحسِن قضاؤه، وهو ﷺ أبعدُ الناس من ذلك، فكره أخذها لذلك وأدّى للذي تحمّل له بها من ماله دنانير لا نقص فيها.
Important point: Imam al-Tahawi gave a fine explanation: since that gold was not minted (it was raw gold) and people preferred minted dinars, and he (peace and blessings be upon him) was the best of people in repaying, he (peace and blessings be upon him) did not like to take that raw gold, but paid full-weight minted dinars from his own wealth.
