Note / Clarification: Humayd is Humayd bin Abi Humayd al-Tawil.
وأخرجه أحمد 21/ (13613)، والترمذي (1228) من طريق عفان بن مسلم، بهذا الإسناد. لكنه قال: نهى عن بيع الثمرة حتى تَزْهُو، بدل قوله: عن بيع التمر حتى يحمرّ ويصفرَّ. ولم يذكر ¤ ¤ الترمذي هذا الحرف فيه، وحسّن الحديث.
Reference / Source: Imam Ahmad (21/ 13613) and al-Tirmidhi (1228) narrated it through the route of Affan bin Muslim with this same chain, but its wording is: "He forbade selling fruit until it ripens (tazhu)", instead of "until the dates turn red or yellow"; and al-Tirmidhi did not mention this phrase
Grading: Imam al-Tirmidhi called this hadith "hasan".
وأخرجه أحمد (13314)، وأبو داود (3371)، وابن ماجه (2217)، والترمذي (1228)، وابن حبان (4993) من طرق عن حماد بن سلمة، به. وعند أحمد وابن ماجه في روايتهما: نهى عن بيع الثمرة حتى تَزهُو، وعند ابن حبان: عن بيع النخل حتى يزهُو، بدل قوله: عن بيع التمر حتَّى يحمرَّ ويصفر. ولم يذكر أبو داود والترمذي هذا الحرف.
Reference / Source: Imam Ahmad (13314), Abu Dawud (3371), Ibn Majah (2217), al-Tirmidhi (1228) and Ibn Hibban (4993) narrated it through the route of Hammad bin Salamah; Ahmad and Ibn Majah have the word "tazhu" (ripens) and Ibn Hibban has "the palm until it ripens", rather than the change of colour, while Abu Dawud and al-Tirmidhi did not mention this phrase.
وأخرجه أحمد 19/ (12138) عن يحيى بن سعيد القطان، والبخاري (2208)، ومسلم (1555) من طريق إسماعيل بن جعفر، والبخاري (2195) من طريق عبد الله المبارك، و (2197) من طريق هُشَيم بن بشير، والبخاري (1488)، ومسلم (1555)، والنسائي (6072)، وابن حبان (4990) من طريق مالك، خمستهم عن حميد الطويل، عن أنس، بالاقتصار على النهي عن بيع الثمر حتى يزهو. زاد بعضهم: قيل لأنس: ما زَهوُها؟ قال: تحمرّ وتصفرّ، وعند بعضهم: تحمرّ، فقط.
Reference / Source: Imam Ahmad, al-Bukhari (2208, 2195, 2197, 1488), Muslim (1555), al-Nasa'i (6072) and Ibn Hibban (4990) narrated it through five different teachers, through the chain of Humayd al-Tawil from Anas, in which the meaning of "zahw" is given as "turning red or yellow".
ولا خلاف بين ذكر التمر - بالمثناة - وبين ذكر الثمرة أو الثمر - بالمثلثة - فقد قال ابن الأثير في "النهاية" في مادة (ثمر): الثمر: الرُّطب ما دام في رأس النخلة، فإذا قُطع فهو الرُّطب، فإذا كُنز فهو التمر. قلنا: وعليه تكون الرواية التي بالتاء المثناة مجازًا باعتبار ما سيؤول إليه ثمر النخل بعد قطعِه.
Note / Clarification: There is no contradiction between the words "tamr" (dates) and "thamar" (fruit)
Reference / Source: According to Ibn al-Athir (al-Nihayah), dates are called "thamar" while they are on the tree, "rutab" after they are cut, and "tamr" after they are stored; so the word "tamr" has been used figuratively with regard to their future state.
وروى شعبة عند ابن أبي شيبة في "المصنف" 7/ 116 قصة العنب منه عن حميد، فوقفه على أنس.
Reference / Source: Imam Shu'bah narrated it from Humayd with Ibn Abi Shaybah (7/ 116), but made it the saying of Anas himself (mawquf).
(1) كذا جزم الحاكم بأنهما لم يخرجاه، وهو ليس على إطلاقه، فقد أخرجا منه قطعةً كما بيّناه.
Important point: Al-Hakim's firm statement that "al-Bukhari and Muslim did not narrate it" is not correct without qualification, because they narrated a part of it, as we have made clear.
(2) أخرجه البخاري (2194)، ومسلم (1534) من طريق نافع، عن ابن عمر، لكن لفظه عند البخاري وبعض روايات مسلم: أنَّ رسول الله ﷺ نهى عن بيع الثمر حتى يبدو صلاحُه. زاد مسلم في رواية: قال: يبدو صلاحُه: حُمرته وصُفرته.
Reference / Source: Al-Bukhari (2194) and Muslim (1534) narrated it through the route of Nafi' from Ibn Umar, in which selling fruit is forbidden until its soundness (ripeness) appears, and in a narration of Muslim the soundness is explained as "its redness or yellowness".
واقتصار الحاكم على أنهما اتفقا على إخراجه من حديث نافع عن ابن عمر، فيه نظر، فقد اتفقا أيضًا على إخراجه باللفظ الذي أشرنا إليه من حديث عبد الله بن دينار عن ابن عمر، أخرجه البخاري (1486)، ومسلم (1535) (52). ¤ ¤ واتفقا كذلك على إخراجه باللفظ المذكور من حديث سالم بن عبد الله بن عمر عن أبيه، أخرجه البخاري (2183)، ومسلم (1538) (57).
Technical note / Defect ('illah): Al-Hakim's restricting it to the narration of Nafi' alone is open to question, because al-Bukhari and Muslim also narrated it through the routes of Abd Allah bin Dinar from Ibn Umar and Salim bin Abd Allah from his father.
