Mustadrak al-Hakim — Hadith 2222

أخبرَناه أبو نصر أحمد بن سهل الفقيه ببُخارى، حدثنا أبو عِصمة سهل بن المتوكِّل، حدثنا عبد الله بن مسلمة القَعْنبي، حدثنا أبو بكر بن أبي سَبْرة، عن حُسين بن عبد الله، عن عِكْرمة، عن ابن عباس: أنَّ رسول الله ﷺ قال لأم إبراهيم حين وَلَدتْه: "أعتقَها ولدُها" (1).
It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said concerning the mother of Ibrahim (his (peace and blessings be upon him) son, Sayyidah Mariyah al-Qibtiyyah) when he was born: "Her son has set her free."

Grading: Its chain is "extremely weak" on account of Abu Bakr bin Abi Sabrah, because he was accused of fabricating hadith (wad'); moreover Husayn bin Abd Allah is also weak
Corroborating chains and supporting reports: There are corroborating narrations for both of them, but they are not taken into account, as will come
Technical note / Defect ('illah): This narration has also been declared defective (ma'lul) because of the narrations that Ikrimah reported from Umar and Ata from Ibn Abbas as mawquf (their own saying), as we will make clear, if Allah wills.
وأخرجه ابن سعد في "الطبقات" 10/ 204، وإسحاق بن راهويه في "مسنده" قسم مسند ابن عباس (955)، وابن ماجه (2516)، وابن أبي عاصم في "الآحاد والمثاني" (3132)، وابن حبان في "المجروحين" 1/ 242، وابن عدي في "الكامل في الضعفاء" 7/ 297، والدارقطني (4233) و (4237 - 4239)، والبيهقي 10/ 346 من طرق عن أبي بكر بن أبي سَبْرة، بهذا الإسناد.
Reference / Source: Ibn Sa'd in "al-Tabaqat" (10/ 204), Ishaq bin Rahawayh in his "Musnad" (955), Ibn Majah (2516), Ibn Abi Asim in "al-Ahad wa al-Mathani" (3132), Ibn Hibban in "al-Majruhin" (1/ 242), Ibn Adi in "al-Kamil" (7/ 297), al-Daraqutni (4233, 4237-4239) and al-Bayhaqi (10/ 346) narrated it through various routes from Abu Bakr bin Abi Sabrah, with this same chain.
ووقع عند ابن ماجه: أبو بكر النَّهْشَلي: بدل ابن سَبْرة، وهو خطأ نبَّه عليه المزي في "تهذيب الكمال" 33/ 108.
Technical note / Defect ('illah): In Ibn Majah "Abu Bakr al-Nahshali" occurs instead of "Abu Bakr bin Abi Sabrah", which is an error, as Imam al-Mizzi pointed out in "Tahdhib al-Kamal" (33/ 108).
وأخرجه الدارقطني (4234) من طريق محمد بن إسماعيل الجعفري، عن عبد الله بن سلمة بن أسلم، عن حسين بن عبد الله الهاشمي، به. والجعفري وعبد الله وحسين ضعفاء.
Reference / Source: Al-Daraqutni narrated it at (4234) through the chain of Muhammad bin Isma'il al-Ja'fari from Abd Allah bin Salamah from Husayn bin Abd Allah al-Hashimi
Criticism of a narrator: Al-Ja'fari, Abd Allah and Husayn are all three weak narrators.
وأخرجه البيهقي 10/ 346 من طريق أبي أويس، عن حسين بن عبد الله، عن عكرمة مولى ابن عباس، مرسلًا. ووقع في المطبوع: عن ابن عباس، وهو خطأ، وأبو أويس - وهو عَبد الله بن عبد الله الأصبحي - فيه لِين، وحسين ضعيف. ¤ ¤ وقد تابع حُسينًا الهاشمي عبدُ الكريم الجزري عند ابن حزم في "المحلى" 9/ 18، لكن في الإسناد إليه مصعب بن سعيد أبو خيثمة المصيصي، وهو صاحب مناكير وبلايا، وكان يصحف ويدلس وكُفَّ في آخر عمره، فلا اعتداد بمتابعته هذه.
Reference / Source: Al-Bayhaqi (10/ 346) narrated it as "mursal" through the route of Abu Uways from Husayn bin Abd Allah from Ikrimah
Technical note / Defect ('illah): In the printed edition it is written "from Ibn Abbas", which is wrong
Criticism of a narrator: Abu Uways (Abd Allah al-Asbahi) has some weakness and Husayn is weak
Corroborating chains and supporting reports: Husayn al-Hashimi is corroborated by Abd al-Karim al-Jazari (al-Muhalla 9/ 18), but its chain contains Mus'ab bin Sa'id al-Missisi, who brings munkar and calamitous narrations and used to commit misreadings (tashif) and tadlis, so his corroboration carries no weight.
وتابع حسينًا كذلك عبدُ الله بن عبد الرحمن بن أبي حسين الهاشمي عند الدارقطني (4235)، ومن طريقه البيهقي 10/ 346، من طريق علي بن أبي سارة عنه. وابن أبي سارة هذا ضعيف جدًّا، فلا اعتداد بهذه المتابعة أيضًا.
Corroborating chains and supporting reports: Husayn is corroborated by Abd Allah bin Abd al-Rahman al-Hashimi with al-Daraqutni (4235) and al-Bayhaqi (10/ 346), through Ali bin Abi Sarah
Criticism of a narrator: Ibn Abi Sarah is "extremely weak", so this corroboration also carries no weight.
وقد أُعِلَّ هذا الحديث بعلتين أخريين:
Technical note / Defect ('illah): This hadith also has two further defects (hidden flaws):
أولاهما: أنَّ المحفوظ فيه عن عكرمة روايته عن عمر بن الخطاب مرسلًا، كما أخرجه ابن أبي شيبة 6/ 406، وأبو القاسم البَغَوي في "الجعديات" (1748)، والبيهقي 10/ 346 من طريق سفيان الثَّوري، عن أبيه، عن عكرمة قال: قال عمر بن الخطاب في أم الولد: أعتقها ولدها وإن كان سقطًا. وعند البَغَوي ومن طريقه البيهقي: عن عكرمة عن عمر. وعكرمة لم يدرك عمر، ولكنه على إرساله أصح من المرفوع. وقد روي عن عمر من وجوه أخرى صحاح من فتواه، كما تقدَّم برقم (2219).
Technical note / Defect ('illah): The first defect is that the preserved narration from Ikrimah is a mursal saying of Umar bin al-Khattab, as Ibn Abi Shaybah (6/ 406) and al-Bayhaqi (10/ 346) narrated through the route of Sufyan al-Thawri that Umar bin al-Khattab said about the umm walad: Her child sets her free, even if it was a miscarriage
Important point: Ikrimah did not meet Umar, but this mursal saying of his is more authentic than the "marfu'" (attributed to the Prophet, peace and blessings be upon him) narration; and fatwas of Umar are reported through other authentic routes.
والعلة الثانية: أنَّ المحفوظ عن ابن عباس فتواه بخلاف برواية حسين الهاشمي عن عكرمة عن ابن عباس مرفوعًا، كما أخرجه سفيان بن عيينة في "جزئه" برواية زكريا بن يحيى المروَزي (19) عن عمرو بن دينار، عن عطاء بن أبي رباح، عن ابن عباس، قال: والله ما أمُّ ولدك إلّا بمنزلة شاتِك أو بعيرِك. قال البخاري في "التاريخ الكبير" 2/ 388: هذا المعروف من فتيا ابن عباس. قلنا: لكن قد يُحمل قول ابن عباس على مَحملٍ لا يُخالف ما نُقل عن عمر بن الخطاب وغيره من الصحابة كما أوضحناه عند الحديث (2219)، والله تعالى أعلم.
Technical note / Defect ('illah): The second defect is that the preserved report from Ibn Abbas is his own fatwa, which goes against the marfu' narration of Husayn al-Hashimi, as Sufyan bin Uyaynah reported from Ibn Abbas: "By Allah! Your umm walad is only like your sheep or your camel"
Reference / Source: According to Imam al-Bukhari (al-Tarikh al-Kabir 2/ 388), this is the well-known fatwa of Ibn Abbas
Note / Clarification: However, the saying of Ibn Abbas can be interpreted in a way that does not contradict the saying of Umar, as we made clear under hadith (2219).
