Mustadrak al-Hakim — Hadith 2205

حدثنا أبو العباس محمد بن يعقوب، حدثنا أحمد بن عيسى اللَّخْمي، حدثنا عمرو بن أبي سلمة، حدثنا أبو مُعَيد حفص بن غَيلان، حدثنا سليمان بن موسى، عن نافع، عن ابن عُمر، وعن عطاء بن أبي رَبَاح، عن ابن عبّاس؛ أنهما كانا يقولان: عن رسول الله ﷺ: "مَن اشترى بَيعًا فوَجَبَ له، فهو بالخيار ما لم يُفارِقْه صاحبُه، إن شاء أخذَه، فإن فارقَه فلا خِيارَ له" (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه بهذا اللفظ.

It is narrated from Sayyiduna Abdullah bin Umar and Sayyiduna Abdullah bin Abbas (may Allah be pleased with them) that they both used to report from the Messenger of Allah (peace and blessings be upon him): "Whoever buys something and the sale becomes binding for him, he has the option as long as he has not parted from his companion (the seller); if he wishes, he may take it. But once he has parted from him, he no longer has the option (to cancel)."
The chain of this hadith is sahih (authentic), but the two Shaykhs did not record it with these words.

Grading: The hadith is
sahih; although this chain is da'if because of Ahmad bin 'Isa al-Lakhmi, it has corroboration (mutaba'ah).
وأخرجه ابن حبان (4914) و (4915) من طريق زيد بن يحيى بن عُبيد، عن أبي مُعَيد حفص بن غيلان، بهذا الإسناد.
Reference / Source: Ibn Hibban narrated it via the chain of Hafs bin Ghaylan through the same intermediaries.
وأخرجه بنحوه أحمد 9/ (5418) و 10/ (6006)، والبخاري (2107) و (2109) و (2111) و (2112)، ومسلم (1531)، وأبو داود (3154)، وابن ماجه (2181)، والترمذي (1245)، والنسائي (6014 - 6022)، وابن حبان (4912) و (4916) من طرق عن نافع، عن ابن عمر. زادوا "إلّا بيع الخيار" ولفظ بعضهم: "أو يقول أحدهما لصاحبه: اختر" وبعضهم يقول: "أو يكون بيع خيار"، وكلها بمعنًى.
Sahih hadith: Ahmad, al-Bukhari, Muslim, Abu Dawud and all the books of Sunan narrated it through Ibn 'Umar (may Allah be pleased with him). With the words "khiyar" (the right to cancel the sale), these are
the most authentic narrations.
وأخرجه أحمد 8/ (4566) و 9/ (5130)، والبخاري (2113)، ومسلم (1531)، والنسائي (6023 - 6028)، وابن حبان (4913) من طريق عبد الله بن دينار، عن ابن عمر، بلفظ: "كل بَيِّعين لا بيع بينهما حتى يتفرقا، إلّا بيع الخيار".
Reference / Source: The wording of the narration of al-Bukhari and Muslim is: "The sale between the seller and the buyer is not complete until they separate from one another, except in a sale with an option (bay' al-khiyar)".
قال الترمذي: معنى قوله ﷺ: "إلّا بيع الخيار" معناه: أن يُخيِّر البائعُ المشتري بعد إيجاب البيع، فإذا خيّره فاختار البيع فليس له خِيار بعد ذلك في فسخ البيع، وإن لم يتفرقا.
Juristic explanation: According to Imam al-Tirmidhi it means that after the sale has been concluded, if one gives the other the option and he accepts it, then the sale cannot be cancelled even before they separate.
قلنا: وقد جاء بيان ذلك في رواية الليث بن سعد عن نافع عن ابن عمر عند أحمد 10/ (6006)، والبخاري (2112)، ومسلم (1531)، وابن ماجه (2181)، والنسائي (6020).
