Mustadrak al-Hakim — Hadith 1743

حدثنا أبو بكر بن إسحاق الفقيه، أخبرنا إسماعيل بن قُتيبة، حدثنا يحيى بن يحيى، أخبرنا مروان بن معاوية الفَزَاري، حدثنا الحجّاج بن أبي عثمان الصوّاف، عن يحيى بن أبي كثير، عن عِكرِمةَ قال: حدّثني الحجّاج بنُ عمرو الأنصاريُّ قال: قال رسولُ الله ﷺ: "مَن كُسِرَ أو عَرَجَ فقد حَلَّ، وعليه الحجُّ من قابلٍ". قال عكرمة: فسألتُ أبا هريرةَ وابنَ عباسٍ، فقالا: صَدَق (1).
هذا حديث صحيح على شرط البخاري، ولم يُخرجاه.
It is narrated from Sayyiduna al-Hajjaj bin Amr al-Ansari (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever suffers a broken bone or becomes lame has become free (he may leave the state of ihram), and he must perform Hajj again the following year." Ikrimah (may Allah have mercy on him) said: I asked Sayyiduna Abu Hurayrah and Sayyiduna Ibn Abbas (may Allah be pleased with them) about this, and they said that al-Hajjaj bin Amr had spoken the truth.
This hadith is sahih (authentic) on the condition of Imam Bukhari, but the two Shaykhs did not record it.

Grading: Its chain is sahih.
Technical note: Abu Bakr bin Ishaq's name is Ahmad, and Yahya bin Yahya is al-Naysaburi.
Reference / Source: Imam Ahmad, Abu Dawud (1862), Ibn Majah (3077), al-Tirmidhi (940) and al-Nasa'i (3829) narrated it through various routes from Hajjaj al-Sawwaf with this same chain. Imam al-Tirmidhi called it "hasan".
وسيأتي برقم (1795) من طريق عبد الوارث بن سعيد، عن الحجاج الصواف، به، وبرقم (1796) من طريق عبد الرزاق عن معمر، عن يحيى بن أبي كثير، عن عكرمة، عن عبد الله بن رافع، عن الحجاج بن عمرو الأنصاري، فزاد معمر - وتابعه معاوية بن سلام - بين عكرمة والحجاج بن عمرو: عبدَ الله بن رافع، ورجح البخاري رواية معمر ومعاوية بن سلام، فيما نقله عنه الترمذي في "الجامع" وفي "العلل الكبير" (238)، ثم تعقبه الترمذي بقوله: وحجاج الصواف ثقة حافظ عند أهل الحديث. ونقل البيهقي 5/ 220 عن علي بن المديني قوله: الحجاج الصواف عن يحيى بن أبي كثير أثبت. وقال الإمام أحمد كما في "مسائله - رواية أبي داود السجستاني" (1882): ما أدري ما مخرجه، وبعضهم يقول: عن عبد الله بن رافع. قلنا: لا يمنع أن يكون عكرمة رواه أولًا عن الحجاج بن عمرو بواسطة عبد الله بن رافع، ثم لقي الحجاج فسمعه منه بلا واسطة، فيكون حينئذ من المزيد في متصل الأسانيد، والله تعالى أعلم.
Defect / Technical note: It has been transmitted via Hajjaj al-Sawwaf, whereas Ma'mar and Mu'awiyah bin Sallam added 'Abdullah bin Rafi' between 'Ikrimah and al-Hajjaj bin 'Amr. Imam al-Bukhari preferred this narration with the addition.
Important point / Summary: (The editors say that) it is possible that 'Ikrimah first heard it through an intermediary and then heard it directly from the Companion (al-Hajjaj bin 'Amr) himself; in that case it would be of the type "al-mazid fi muttasil al-asanid" (an added narrator in an otherwise connected chain), and the chain would remain muttasil (connected).
قوله: "أو عَرَج" قال ابن الأثير في "النهاية": يقال: عَرَجَ يَعرُجُ عَرَجانًا: إذا غمز من شيء أصابه، وعَرِجَ يَعرَجُ عَرَجًا: إذا صار أعرَجَ أو كان خِلقةً فيه.
Note / Clarification: On the words "aw 'araj", Ibn al-Athir says: if it is "'araja" (with fathah) it means limping because of some injury, and if it is "'arija" (with kasrah) it means being lame from birth.
