أخبرنا عبد الله بن محمد بن موسى، حدثنا محمد بن أيوب، أخبرنا يحيى بن المغيرة، حدثنا جرير، عن الحسن بن عُبيد الله، عن سعد بن عُبيدة، عن ابن عمر، عن النبي ﷺ قال: "مَن حَلَفَ بغير الله فقد كَفَرَ" (2). هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه بهذا اللفظ، وإنما أودعتُه كتاب الإيمان للفظ الشِّرك فيه، وفي حديث مُصعب بن المِقدام عن إسرائيل: "فقد كفر" (3). فأما الشيخان فإنما أخرجاه من حديث سالم ونافع وعبد الله بن دينار عن ابن عمر: أنَّ النبي ﷺ قال لعمر: "إنَّ الله ينهاكم أن تحلفوا بآبائكم" (4) فقط، وهذا غيرُ ذاك (5).
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that the Prophet (peace and blessings be upon him) said: "Whoever swears by other than Allah has committed kufr (disbelief)."
This hadith is sahih on the condition of the two Shaykhs, but they did not record it with this wording. I placed it in the Book of Faith (Kitab al-Iman) because of the word 'shirk' in it; and in the hadith of Mus'ab bin al-Miqdam from Isra'il it reads: "has committed kufr." As for the two Shaykhs, they recorded it only from the hadith of Salim, Nafi' and Abdullah bin Dinar from Ibn Umar, that the Prophet (peace and blessings be upon him) said to Umar: "Indeed Allah forbids you from swearing by your fathers", and that is all; this narration is different from that one.

(2) رجاله ثقات كسابقه. جرير: هو ابن عبد الحميد، وقد سلف من طريقه برقم (45). Grading: Like the previous narration, its narrators are also thiqah. Note / Clarification: Jarir is "Jarir bin Abd al-Hamid", through whose route this narration has already passed at number (45).
(3) لم نقف علي هذه الرواية مسندةً فيما بين أيدينا من المصادر، وانظر ما سبق برقم (168) من طريق عبيد الله بن موسى عن إسرائيل، وقد سلف برقم (45) بلفظ: "فقد كفر" في حديث الحسن بن عبيد الله النخعي عن سعد بن عبيدة. Reference / Source: We did not find this narration with a connected chain in the sources available to us. Note / Clarification: On this subject see numbers (168) and (45), where the wording "فقد كفر" (then he has committed disbelief) is narrated.

Reference / Source: This narration is in Sahih al-Bukhari through the routes of Salim bin Abd Allah (6647), Nafi' the client of Ibn Umar (6108) and Abd Allah bin Dinar (3836), while Muslim narrated it from all three of them under number (1646).
(5) بل هما واحد والقصة واحدة، إذ لا يُتصوّر في عمر ﵁ أن يكون سمع نهي النبي ﷺ عن الحلِفِ بالآباء، ثم يعود فيحلف بأبيه، وقد ثبت عنه في الحديث نفسه أنه قال - كما في حديث سالم-: والله ما حلفتُ بها منذ سمعت النبيَّ ﷺ ذاكرًا ولا آثرًا. Important point: In fact this is one story and one incident; it is inconceivable that Umar (may Allah be pleased with him) would hear the Prophet (peace and blessings be upon him) forbid swearing by one's forefathers and then swear such an oath again. Note / Clarification: It is authentically narrated from Umar himself that he said: "By Allah! Since I heard the Prophet (peace and blessings be upon him) forbid it, I have never sworn such an oath."
