Mustadrak al-Hakim — Hadith 169

أخبرناه أبو زكريا يحيى بن محمد العنبري، حدثنا إبراهيم بن أبي طالب، حدثنا محمد بن يحيى، حدثنا عبد الرزاق، أخبرنا سفيان، عن أبيه والأعمش ومنصور، عن سعد بن عُبيدة، ابن عمر قال: كان عمرُ يحلِفُ: وأَبي، فنهاه النبيُّ ﷺ، فقال: "مَن حَلَفَ بشيءٍ من دون الله، فقد أشرك"، وقال الآخرُ: "فهو شركٌ" (1).
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that Sayyiduna Umar (may Allah be pleased with him) used to swear saying "By my father", so the Prophet (peace and blessings be upon him) forbade him and said: "Whoever swears by anything other than Allah has committed shirk", or he said: "It is shirk."

(1) رجاله ثقات إلّا أنَّ فيه علَّةً وهي الانقطاع بين سعد بن عبيدة وابن عمر، فإنَّ سعدًا لم يسمع هذا الحديث من ابن عمر، بينهما فيه راوٍ اسمه محمد الكندي كما بيَّنه منصورٌ -وهو ابن المعتمر- في رواية غير سفيان الثوري عنه كما عند أحمد 9/ (5375) و (5593)، ولعلَّ هذا أصحُّ من صنيع الأعمش وغيره حيث اختصروه فأوهموا أنه من مسموعات سعد بن عبيدة عن ابن عمر، ومحمد الكندي هذا لا يعرف، وانظر تتمة هذا البيان في التعليق على "مسند أحمد" 8/ (4904) - حيث رواه عن عبد الرزاق بهذا الإسناد - والله تعالى أعلم.
Technical note / Defect ('illah): The main defect in it is the "inqita'" (break) between Sa'd bin Ubaydah and Ibn Umar. According to the narration of Mansur bin al-Mu'tamir, there is an intermediary narrator between them named "Muhammad al-Kindi", who is majhul (unknown).
Important point: Al-A'mash and others narrated it in abridged form, creating the false impression that Sa'd heard it directly from Ibn Umar, whereas the correct account is the one Mansur gave. And Allah knows best.
