Mustadrak al-Hakim — Hadith 168

أخبرنا أبو جعفر محمد بن علي بن دُحَيم الشَّيباني بالكوفة، حدثنا أحمد بن حازم بن أبي غَرَزَة (3) الغفاري، حدثنا عبيد الله بن موسى، أخبرنا إسرائيل، عن سعيد بن مسروق، عن سعد بن عُبيدة، عن ابن عمر قال: قال عمر: لا وأبي، فقال رسول الله ﷺ: "لا تحلفوا بآبائكم، مَن حَلَفَ بِشيءٍ دونَ الله فقد أشرك" (4).
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that Sayyiduna Umar (may Allah be pleased with him) said (in the course of speaking): "No, by my father!" So the Messenger of Allah (peace and blessings be upon him) said: "Do not swear by your fathers. Whoever swears by anything other than Allah has committed shirk."

(3) تحرَّف هذا الاسم في المطبوع إلى: أحمد بن حازم عن أبي عروة.
Technical note / Defect ('illah): In the printed edition this name has been distorted and printed as "Ahmad bin Hazim from Abu Urwah" (which is wrong).

(4) رجاله ثقات إلّا أنَّ فيه علَّة الانقطاع بين سعد بن عبيدة وابن عمر كما سيأتي بيانه في الحديث التالي. إسرائيل: هو ابن يونس بن أبي إسحاق السَّبيعي.
Grading: All its narrators are thiqah, but it has the defect of "inqita'" (a break in the chain), because Sa'd bin Ubaydah's hearing from Ibn Umar (may Allah be pleased with them both) is not established.
Note / Clarification: The narrator Isra'il is "Isra'il bin Yunus bin Abi Ishaq al-Sabi'i".
وأخرجه أحمد 1/ (329) عن أبي سعيد مولى بني هشام، عن إسرائيل، بهذا الإسناد.
Reference / Source: Ahmad narrated it in his Musnad (1/329) via Abu Sa'id (the client of Banu Hashim), with the same chain of Isra'il.
