Mustadrak al-Hakim — Hadith 1642

حدثنا أبو جعفر أحمد بن عُبيد الحافظ بهَمَذان، حدثنا إبراهيم بن الحسين، حدثنا شَبَابةُ بن سَوَّار، حدثنا الليث بن سعد، عن يزيد بن أبي حَبِيب، عن [سَهْل بن] (2) معاذ بن أنس، عن أبيه - وكان من أصحاب النبي ﷺ أنَّ النبيَّ ﷺ قال: "اركَبُوا هذه الدَّوابَّ سالمةً، وايْتَدِعوها سالمةً، ولا تتَّخِذوها كراسيَّ" (1).
It is narrated from Sayyiduna Mu'adh bin Anas (may Allah be pleased with him), who was one of the Companions of the Prophet (peace and blessings be upon him), that the Prophet (peace and blessings be upon him) said: "Ride these animals while they are sound, leave them while they are still sound, and do not make them into chairs (that is, do not keep sitting on their backs without need)."

(2) ما بين معقوفين سقط من النسخ الخطية، واستدركناه من "السنن الكبرى" للبيهقي 5/ 255 حيث رواه عن المصنف بإسناده ومتنه بذكر سهل بن معاذ بن أنس عن أبيه، ونَصَّ البيهقي على أنه وجده هكذا في "المستدرك".
Clarification: The bracketed portion had dropped out of the manuscripts, and it has been restored from al-Bayhaqi's "al-Sunan al-Kubra", where, narrating via the chain of Imam al-Hakim, he makes clear that it is the narration of "Sahl bin Mu'adh bin Anas from his father".
ومما يؤكد أنَّ ما وقع في نسخنا الخطية هنا إنما هو سقط وليس روايةً، أنَّ الدارمي (2710)، ¤ ¤وابن خزيمة (2544) قد أخرجاه من طريق شبابة بن سوار عن الليث بإسناد الحاكم هنا، وعندهما: ابن معاذ بن أنس، بل عند الدارمي: سهل بن معاذ.
Technical note / Defect ('illah): The narrations of al-Darimi and Ibn Khuzaymah also confirm that the words "Ibn Mu'adh" had dropped out here (a scribal omission, not a variant narration), since both of them narrated it via Shababah bin Sawwar from al-Layth with al-Hakim's chain and have "Ibn Mu'adh bin Anas", and al-Darimi even has "Sahl bin Mu'adh".
