Mustadrak al-Hakim — Hadith 1620

أخبرنا أبو الحسن أحمد بن محبوب الرَّمْلي بمكة، حدثنا عبد الله بن محمد بن نصر الرَّمْلي، حدثنا محمد بن أبي عمر العَدَني، حدثنا عبد العزيز بن محمد، عن أبي سُهيل بن مالك، عن طاووس، عن ابن عباس، أنَّ النبي ﷺ قال: "ليس على المُعتكِفِ صيامٌ إلَّا أن يَجعَلَه على نفسِه" (1).
هذا حديثٌ صحيح الإسناد على شرط مسلم، ولم يُخرجاه. ولفُقهاء أهل الكوفة في ضِدِّ
هذا حديثان أَذكُرُهما، وإن كانا لا يقاومان هذا الخبر في عدالة الرُّواة: الحديث الأول:
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Prophet (peace and blessings be upon him) said: "Fasting is not obligatory upon the one in i'tikaf (merely because of the i'tikaf), unless he makes it binding upon himself (by a vow)."
The chain of this hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs did not record it. Although the jurists of Kufa have narrated two hadiths to the contrary, which I shall mention, they cannot match this report by the measure of the narrators' integrity.

Grading: The chain is strong (qawi) on account of 'Abd al-'Aziz bin Muhammad al-Darawardi,
Technical note / Defect ('illah): but the correct view is that it is mawquf; 'Abd Allah bin Muhammad al-Ramli erred in narrating it as marfu', as al-Bayhaqi and others said.
Criticism of a narrator: Abu Suhayl bin Malik is the paternal uncle of Imam Malik, and his name is Nafi' al-Asbahi.
وأخرجه البيهقي 4/ 318 - ومن طريقه ابن عساكر في "تاريخ دمشق" 5/ 489 - 490 - عن أبي عبد الله الحاكم، بهذا الإسناد. قال البيهقي: تفرد به عبد الله بن محمد بن نصر الرملي هذا.
Reference / Source: Al-Bayhaqi (4/ 318) and Ibn 'Asakir narrated it through the route of Imam al-Hakim. Al-Bayhaqi says that 'Abd Allah bin Muhammad al-Ramli is alone in this (marfu' narration).
وأخرجه الدارقطني (2355) - ومن طريقه ابن الجوزي في "التحقيق" (1187) - عن محمد بن إسحاق السوسي، عن عبد الله بن محمد بن نصر، به. قال الدارقطني: رفعه هذا الشيخ، وغيره لا يرفعه، وتعقبه ابن الجوزي بقوله: السوسي ثقة، ونقل عن الخطيب قوله: دخل بغداد وحدث أحاديث مستقيمة. قلنا: الوهم ليس من السوسي، لأنه متابع على رفعه، وإنما الوهم ممن هو فوقه، والله أعلم.
Variation in the chain: Al-Daraqutni (2355) transmitted it via Muhammad bin Ishaq al-Susi and said that only this shaykh raised it to the Prophet, while others do not.
Technical note / Defect ('illah): Ibn al-Jawzi objected that al-Susi is thiqah; however, the error came from a narrator above him.
وأخرج الدارمي (164)، والبيهقي 4/ 319 من طريق عمرو بن زرارة - وقرن الدارمي بعمرو بن زرارة: إبراهيم بن موسى - والطحاوي في "أحكام القرآن" (1072)، وابن حزم في "المحلى" 3/ 414 من طريق أبي بكر الحميدي، والطحاوي في "شرح مشكل الآثار" 10/ 350 عن عبد الملك بن أبي الحواري، أربعتهم عن عبد العزيز بن محمد الدراوردي، عن أبي سهيل قال: كان على امرأتي اعتكاف ثلاثة أيام في المسجد الحرام، فسألت عمر بن عبد العزيز وعنده ابن شهاب، قال: قلت: عليها صيام؟ قال ابن شهاب: لا يكون اعتكاف إلّا بصيام، فقال له عمر بن عبد العزيز: عن النبي ﷺ؟ قال: لا، قال: فعن أبي بكر؟ قال: لا، قال: فعن عمر؟ قال: لا، قال: فعن عثمان؟ قال: لا، قال عمر - يعني ابن عبد العزيز -: ما أرى عليها صيامًا. فخرجتُ فوجدت طاووسًا وعطاء بن أبي رباح، فسألتهما، فقال طاووس: كان ابن عباس لا يرى عليها صيامًا إلّا أن تجعله على نفسها، وقال عطاء: ذلك رأيي - وفي بعض المصادر: ذلك رأيٌ -. قال البيهقي: هذا هو الصحيح موقوف، رفعه وهمٌ.
Details of the narration: Al-Darimi, al-Bayhaqi, al-Tahawi and Ibn Hazm narrated through the route of al-Darawardi from Abu Suhayl, who said: My wife had vowed a three-day i'tikaf in al-Masjid al-Haram. I asked 'Umar bin 'Abd al-'Aziz (al-Zuhri was also there) whether she had to fast. Ibn Shihab (al-Zuhri) said: "There is no i'tikaf without fasting." 'Umar bin 'Abd al-'Aziz asked: "Is this narrated from the Prophet (peace and blessings be upon him)?" He said: "No." He asked: "From Abu Bakr, 'Umar or 'Uthman?" He said: "No." Then 'Umar bin 'Abd al-'Aziz said: "I do not think that fasting is (obligatory) upon her." Then I asked Tawus and 'Ata', and Tawus said that Ibn 'Abbas (may Allah be pleased with him) did not consider fasting necessary unless she made it binding upon herself.
Grading: Al-Bayhaqi says that the correct view is that it is mawquf, and its being marfu' is an error.
