Mustadrak al-Hakim — Hadith 1509

حدثنا أبو العباس محمد بن يعقوب، حدثنا محمد بن علي الوَرَّاق - ولقبه حَمْدان - حدثنا داودُ بن شَبِيب، حدثنا يحيى بن عبَّاد - وكان من خيار الناس - حدثنا ابن جُرَيج، عن عطاء، عن ابن عباس: أنَّ رسول الله ﷺ أَمَر صارخًا ببطن مكةَ ينادي: "إنَّ صدقةَ الفِطْر حقٌّ واجبٌ على كلِّ مسلمٍ صغيرٍ أو كبيرٍ، ذكرٍ أو أنثى، حُرٍّ أو مملوك، حاضرٍ أو بادٍ، صاعٌ من شعيرٍ أو تمرٍ" (1).
هذا حديثٌ صحيح الإسناد، ولم يُخرجاه بهذه الألفاظ (1).
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) ordered a caller in the middle of Makkah to announce: "Indeed, Sadaqat al-Fitr is an obligatory right upon every Muslim, whether young or old, male or female, free or slave, town-dweller or desert-dweller, and it is one sa' of barley or one sa' of dates."
The chain of this hadith is sahih, but they did not record it with these words.

Grading: It is sahih on the basis of its supporting reports, but this chain is weak.
Criticism of a narrator: Al-Hafiz Ibn Hajar called Yahya bin Abbad al-Sa'di weak (layyanahu) in "Mukhtasar Zawa'id al-Bazzar" (659), and he has also been contradicted. Ibn Jurayj is Abd al-Malik bin Abd al-Aziz, and Ata' is Ibn Abi Rabah.
وأخرجه البيهقي 4/ 172 عن أبي عبد الله الحاكم، بهذا الإسناد.
Reference / Source: Al-Bayhaqi (4/ 172) narrated it via Abu Abdullah al-Hakim with this same chain.
وأخرجه الدارقطني (2084) عن ابن مخلد، عن حمدان، به.
Reference / Source: Al-Daraqutni (2084) narrated it through Ibn Makhlad, from Hamdan.
وأخرجه بهذه الزيادة البزار (5187)، والعقيلي في "الضعفاء" (1983)، والدارقطني (2084) من طرق عن داود بن شبيب، به. قال البزار: وقد روي أكثر كلام هذا الحديث من غير وجه إلّا "حاضر أو باد" فإنَّ هذا اللفظ لا يروى عن النبي ﷺ إلّا من هذا الوجه.
Details of the narration: Al-Bazzar (5187), al-Uqayli (1983) and al-Daraqutni (2084) narrated it with this addition through Dawud bin Shabib. Al-Bazzar says that most of the words of this hadith are also narrated through other routes, except the words "resident or Bedouin" (hadir aw bad), which are narrated only through this one chain.
وخالف يحيى بنَ عباد فيه علي بن صالح أبو الحسن المكي، وهو أحسن حالًا منه، فرواه عند العقيلي في "الضعفاء" (1984)، والدارقطني (2083)، والبيهقي 4/ 173 عن ابن جريج، عن عمرو بن شعيب، عن أبيه، عن جده عبد الله بن عمرو بن العاص. ورواية ابن جريج عن عمرو بن شعيب منقطعة، فإنه لم يسمع منه فيما قاله البخاري.
Variation in the chain: Yahya bin Abbad was contradicted by Ali bin Salih Abu al-Hasan al-Makki (who is in a better condition than him).
Defect / Technical note: He narrated it through Ibn Jurayj, from Amr bin Shu'ayb, from his father, from his grandfather; but according to Imam al-Bukhari the narration of Ibn Jurayj from Amr bin Shu'ayb is munqati', because his hearing from him is not established.
ورواه عن ابن جريج أيضًا عبدُ الرزاق عند العقيلي بإثر (1983)، والدارقطني (2081)، وعبدُ الوهاب بن عطاء الخفاف عند الدارقطني (2082)، كلاهما عن ابن جريج، عن عمرو بن شعيب، عن النبي ﷺ مرسلًا. قال العقيلي: وحديث عبد الرزاق أَولى.
Variation in the chain: Abd al-Razzaq and Abd al-Wahhab al-Khaffaf narrated it through Ibn Jurayj, from Amr bin Shu'ayb, as "mursal" (without mentioning the Companion). Al-Uqayli says that the mursal narration of Abd al-Razzaq is better.
وأخرج أحمد 5/ (3291)، وأبو داود (1622)، والنسائي (1815) و (2299) و (2306) من طريق حميد الطويل، عن الحسن البصري قال: خطب ابن عباس وهو أمير البصرة في آخر الشهر فقال: أخرجوا زكاة صوكم، فنظر الناس بعضهم إلى بعض، فقال: مَن ها هنا من أهل المدينة؟ قوموا فعلموا إخوانكم، فإنهم لا يعلمون أنَّ هذه الزكاة فرضها رسول الله ﷺ على كل ¤ ¤ ذكر وأنثى … فذكر نحوه دون قوله: "حاضر أو باد". وهذا إسناد -على ثقة رجاله - منقطع، فإنَّ الحسن البصري لم يسمع من ابن عباس، كما قال غير واحد من أهل العلم.
Reference / Source: Ahmad (5/ 3291), Abu Dawud (1622) and al-Nasa'i (1815, 2299, 2306) narrated through Humayd al-Tawil, from al-Hasan al-Basri, that Ibn Abbas (may Allah be pleased with him), while he was the governor of Basrah, gave a sermon at the end of the month and said: "Pay the zakah of your fasting." Then he called the people of Madinah and told them to teach the people, because the people did not know that the Messenger of Allah (peace and blessings be upon him) had made it obligatory on every male and female.
Defect / Technical note: Despite its narrators being thiqah, this chain is munqati', because al-Hasan al-Basri did not hear from Ibn Abbas (may Allah be pleased with him).
وأخرج الدارقطني (2087) من طريق محمد بن عمر الواقدي، عن عبد الحميد بن عمران، عن ابن أبي أنس، عن أبيه، عن أبي سلمة بن عبد الرحمن، عن ابن عباس، عن رسول الله ﷺ: أنه أمر بزكاة الفطر، صاعًا من تمر، أو صاعًا من شعير، أو مدَّين من قمح، على كل حاضر وبادٍ، صغير وكبير، حر وعبد. وهذا إسناد ضعيف جدًّا، فيه الواقدي وهو متروك.
Grading: This chain is very weak; al-Daraqutni (2087) narrated it through al-Waqidi.
Criticism of a narrator: Al-Waqidi is "matruk" (abandoned, one whose narrations are left).
وأخرج الدارقطني (2119) من طريق سلَّام الطويل، عن زيد العمي، عن عكرمة، عن ابن عباس قال: قال رسول الله ﷺ: "صدقة الفطر على كل صغير وكبير، ذكر وأنثى، يهودي أو نصراني، حر أو مملوك، نصف صاع من بر، أو صاعًا من تمر، أو صاعًا من شعير". وقال الدارقطني بإثره: سلَّام الطويل متروك الحديث، ولم يسنده غيره.
Reference / Source: Al-Daraqutni (2119) narrated it through Sallam al-Tawil, from Zayd al-Ammi, from Ikrimah, from Ibn Abbas, in which the Jew and the Christian are also mentioned.
Grading: Al-Daraqutni says that Sallam al-Tawil is matruk al-hadith and that no one other than him narrated it with a connected chain (musnad).
وروى الحديث هشام بن حسان عن محمد بن سيرين عن ابن عباس، واختلف عليه فيه في رفعه ووقفه، فقد أخرج الدارقطني (2091) من طريق عبد الوهاب بن عبد المجيد الثقفي، عن هشام بن حسان، عن محمد بن سيرين، عن ابن عباس قال: أُمرنا أن نعطي صدقة رمضان عن الصغير والكبير والحر والمملوك، صاعًا من طعام، من أدّى بُرًّا قُبل منه، ومن أدى شعيرًا قبل منه، ومن أدى زبيبًا قبل منه، ومن أدى سُلتًا قبل منه. قال: وأحسبه قال: ومن أدى دقيقًا قبل منه، ومن أدى سَويقًا قبل منه.
Variation in the chain: Hisham bin Hassan narrated it from Muhammad bin Sirin, from Ibn Abbas, but there is disagreement about whether it is marfu' or mawquf. In the narration of al-Daraqutni (2091), a sa' of food, wheat, barley, raisins and sult (a kind of barley) are mentioned.
وخالفه مخلد بن الحسين الأزدي، فرواه عن هشام، عن ابن سيرين، عن ابن عباس، موقوفًا قال: ذكر في صدقة الفطر فقال: صاع من بر، أو صاع من تمر، أو صاع من شعير، أو صاع من سلت. أخرجه النسائي (2300). وعلى كلٍّ فرواية محمد بن سيرين عن ابن عباس منقطعة، كما قال علي بن المديني في "العلل" له ص 60، ونقل هناك عن شعبة قوله: أحاديث محمد بن سيرين عن ابن عباس إنما سمعها محمد عن عكرمة، لقيه أيام المختار.
Variation in the chain: Makhlad bin al-Husayn al-Azdi narrated it through Hisham, from Ibn Sirin, from Ibn Abbas as "mawquf" (al-Nasa'i 2300).
Defect / Technical note: According to Ali bin al-Madini and Imam Shu'bah, the narrations of Muhammad bin Sirin from Ibn Abbas (may Allah be pleased with him) are munqati'; he heard these things from Ikrimah.
وقد صحَّ موقوفًا من وجه آخر عن ابن عباس، أخرجه النسائي (2301) عن قتيبة بن سعيد، عن حماد بن زيد، عن أيوب السختياني، عن أبي رجاء العطاردي، قال: سمعت ابن عباس يخطب على منبركم - يعني منبر البصر - يقول: صدقة الفطر صاع من طعام.
Grading: Through another route this narration is authentically established as mawquf on Ibn Abbas (may Allah be pleased with him). Al-Nasa'i (2301) narrated it through Ayyub al-Sakhtiyani, from Abu Raja' al-Utaridi, from his sermon on the pulpit of Basrah.

(1) تعقب الذهبي المصنفَ في تصحيحه فقال: بل خبر منكر جدًّا، قال العقيلي: يحيى بن عباد عن ابن جريج حديثه يدل على الكذب، وقال الدارقطني: ضعيف. قلنا: لا يبلغ يحيى في الضعف هذه المرتبة التي أنزله إياها العقيلي، فإن الأحاديث التي ساقها له وتكلم عليه من أجلها إنما الحطُّ ¤ ¤ فيها على من دون يحيى، وأما هو فأعدل الأقوال فيه أنه ليِّن كما قال الحافظ ابن حجر، والله أعلم.
Criticism of a narrator: Imam al-Dhahabi objected to the author's (al-Hakim's) declaring it authentic and said: "Rather, it is a very munkar report." Al-Uqayli said that Yahya bin Abbad's hadith from Ibn Jurayj indicates lying, and al-Daraqutni called him weak.
Important point: But Yahya is not as low as al-Uqayli made him out to be; the correct view is that he is "layyin" (slightly weak), as al-Hafiz Ibn Hajar said.
