Mustadrak al-Hakim — Hadith 1507

أخبرنا أبو سعيد أحمد بن يعقوب الثَّقَفي، حدثنا محمد بن عبد الله الحَضْرمي، حدثنا جعفر بن محمد الثَّعْلبي، حدثنا وكيع، حدثنا سفيان، عن سَلَمةَ بن كُهَيل، عن القاسم بن مُخَيمِرة، عن أبي عمَّار الهَمْداني، عن قيس بن سعدٍ قال: أَمَرَنا رسول الله ﷺ بصَدَقةِ الفطر قبل أن تنزلَ الزكاة، فلمّا نزلت الزكاةُ لم يأمرنا ولم يَنْهَنا، ونحن نفعلُه (2).
هذا حديث صحيحٌ على شرط الشيخين، ولم يُخرجاه.
Qays bin Sa'd (may Allah be pleased with him) says: The Messenger of Allah (peace and blessings be upon him) ordered us to pay Sadaqat al-Fitr before (the obligation of) zakah (on wealth) was revealed. Then, when (the command of) zakah was revealed, he (peace and blessings be upon him) neither ordered us (again) to pay it nor forbade us from it, but we continued to pay it (as a regular practice).
This hadith is sahih on the condition of the two Shaykhs, but they did not record it.

Grading: Its chain is sahih,
Defect / Technical note: however, Imam al-Bukhari declared it defective (ma'lul), because it contradicts the narrations reported from the Prophet (peace and blessings be upon him) about zakat al-fitr being obligatory, as will come.
Criticism of a narrator: Sufyan is al-Thawri, Abu Ammar al-Hamdani's name is Arib bin Humayd, and Qays bin Sa'd is Ibn Ubadah al-Ansari al-Khazraji (may Allah be pleased with him).
وأخرجه أحمد 39/ (23843)، والنسائي (2298) من طريق وكيع بن الجراح، بهذا الإسناد.

وأخرج النسائي (2297) و (2855) من طريق الحكم بن عتيبة، عن القاسم بن مخيمرة، عن عمرو بن شرحبيل - وكنيته أبو ميسرة - عن قيس بن سعد بن عبادة قال: كنا نصوم عاشوراء، ونؤدي صدقة الفطر، فلما نزل رمضان ونزلت الزكاة، لم نؤمر به ولم نُنْهَ عنه، وكنا نفعله.
Reference / Source: Al-Nasa'i (2297, 2855) narrated through al-Hakam bin Utaybah, from al-Qasim bin Mukhaymirah, from Amr bin Shurahbil (Abu Maysarah), from Qays bin Sa'd bin Ubadah (may Allah be pleased with him), who said: "We used to fast Ashura' and pay sadaqat al-fitr; then when (the fasting of) Ramadan and (the command of) zakah were revealed, we were neither commanded to do it (the fitr charity) nor forbidden from it, and we kept doing it."
وأورد الترمذي في "العلل الكبير" (205) حديثي سلمة بن كهيل والحكم بن عتيبة، وسأل ¤ ¤ عنهما البخاري فقال: حديث سلمة بن كهيل أشبه عندي، إلّا أنَّ هذا خلاف ما يروى عن النبي ﷺ في زكاة الفطر، قال ابن عمر: فرض رسول الله ﷺ زكاة الفطر.
Reference / Source: Imam al-Tirmidhi mentioned both hadiths, of Salamah bin Kuhayl and al-Hakam bin Utaybah, in "al-Ilal al-Kabir" (205) and asked Imam al-Bukhari about them, and he said: "In my view the hadith of Salamah bin Kuhayl is more likely, but it contradicts the narrations reported from the Prophet (peace and blessings be upon him) about zakat al-fitr, as Ibn Umar (may Allah be pleased with him) said that the Messenger of Allah (peace and blessings be upon him) made zakat al-fitr obligatory."
