Mustadrak al-Hakim — Hadith 1504

أخبرني أبو الحسن أحمد بن محمد بن إسماعيل بن مِهْران الإسماعيلي، حدثنا أبي، حدثنا محمود بن خالد الدِّمشقي، حدثنا مروان بن محمد الدِّمشقي، حدثنا يزيد بن مسلم الخَوْلاني (1) - وكان شيخَ صدقٍ، وكان عبد الله بن وَهْبٍ يحدِّث عنه - حدثنا سَيَّار بن عبد الرحمن الصَّدَفي، عن عِكرِمة، عن ابن عباس قال: فَرَضَ رسول الله ﷺ زكاةَ الفِطر طُهرةً للصِّيام (2) من اللَّغو والرَّفَث، وطُعْمةً للمساكين، مَن أدّاها قبلَ الصلاة، فهي زكاةٌ مقبولة، ومن أدّاها بعد الصلاة، فهي صدقةٌ من الصَّدقات (3).
هذا حديثٌ صحيح على شرط البخاري، ولم يُخرجاه.

It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) made Sadaqat al-Fitr obligatory as a purification for the one who fasts from idle and obscene talk, and as food for the poor. So whoever pays it before the (Eid) prayer, it is an accepted zakah, and whoever pays it after the prayer, it will be counted as just one of the ordinary charities.
This hadith is sahih on the condition of Bukhari, but the two Shaykhs did not record it.

(1) كذا وقعت تسميته عند الحاكم ﵀، وهو خطأ، صوابه أبو يزيد الخولاني، أشار إلى ذلك البيهقي في "السنن الكبرى" 4/ 162 - 163، ثم قال: ذكره أبو أحمد الحافظ في "الكنى" ولم يعرف اسمه.
Criticism of a narrator: The name al-Hakim (may Allah have mercy on him) gave for him is wrong; the correct name is "Abu Yazid al-Khawlani". Al-Bayhaqi says that his actual name could not be known.

(2) في (ص) و (ع): للصائم، والمثبت من (ز) و (ب)، ويؤيده أنها كذلك في "سنن البيهقي" في روايته عن المصنِّف نفسه بهذا الإسناد.
Note / Clarification: In manuscripts (S) and (A) it is "lil-sa'im" (for the fasting person), while the text adopted is from manuscripts (Z) and (B), and it is supported by al-Bayhaqi's narration of it from the author (al-Hakim) himself with this chain.

(3) إسناده حسن، أبو يزيد الخولاني وشيخه سيار بن عبد الرحمن صدوقان. وقال الدارقطني في "سننه" بعد أن رواه (2067): ليس في رواته مجروح.
Grading: Its chain is hasan. Abu Yazid al-Khawlani and Sayyar bin Abd al-Rahman are both saduq (truthful). According to al-Daraqutni (2067), there is no criticised narrator among its narrators.
وأخرجه أبو داود (1609) عن محمود بن خالد الدمشقي، بهذا الإسناد. وقرن بمحمود بن خالد: ¤ ¤ عبد الله بن عبد الرحمن السمرقندي.
Reference / Source: Abu Dawud (1609) narrated it through Mahmud bin Khalid al-Dimashqi.
وأخرجه ابن ماجه (1827) عن عبد الله بن أحمد بن بشير وأحمد بن الأزهر، عن مروان بن محمد، به. ووقعت تسمية الخولاني عندهما وفي سائر مصادر التخريج أبا يزيد الخولاني.
Reference / Source: Ibn Majah (1827) narrated it through Marwan bin Muhammad.
اللغو: هو تكلُّم الإنسان بالمُطَّرَح من القول، وما لا يعني.
Important point: "Al-laghw": idle and useless talk.
والرفث، نقل ابن الأثير عن الأزهري قوله: هي كلمة جامعة لكل ما يريده الرجل من المرأة.
Important point: "Al-rafath": every obscene word or act that takes place between a man and a woman (in private).
