Mustadrak al-Hakim — Hadith 1486

أخبرنا أبو بكر أحمد بن إسحاق الفقيه، أخبرنا أحمد بن إبراهيم بن مِلْحان، حدثنا عمرو بن خالد الحَرَّاني، حدثنا عبيد الله بن عمرو الرَّقِّي، عن زيد (1) بن أبي أُنيسة، عن القاسم بن عوف الشَّيباني، عن علي بن الحسين، قال: حدثتنا أمُّ سلمة: أنَّ النبي ﷺ بينما هو في بيتها، وعنده رجالٌ من أصحابه يَتحدَّثون، إذ جاء رجلٌ فقال: يا رسول الله، كم صدقةُ كذا وكذا من التمر؟ قال رسول الله ﷺ: "كذا وكذا" فقال الرجل: إنَّ فلانًا تعدّى عليَّ فأخذ منِّي كذا وكذا، فازداد صاعًا، فقال رسول الله ﷺ: "فكيف إذا سَعَى عليكم مَن يَتعدَّى عليكم أشدَّ من هذا التّعدِّي؟ " فخاض الناسُ وبَهَرَ الحديثُ، حتى قال رجلٌ منهم: يا رسولَ الله، إن كان رجلًا غائبًا عنك في إبلِه وماشيتِه وزَرْعِه، فأدَّى زكاةَ مالِه فتُعُدِّيَ عليه الحقَّ، فكيف يَصنَعُ وهو غائب؟ فقال رسول الله ﷺ: "مَن أدّى زكاةَ مالِه طيِّبَ النفسِ بها، يريدُ به وَجْهَ الله والدارَ الآخرة، لم يُغيِّب شيئًا من ماله، وأقام الصلاةَ، وأدّى الزكاةَ، فتُعُدِّي عليه الحقِّ، فأَخَذ سلاحَه فقاتَلَ فقُتل، فهو شهيد" (1).
هذا حديث صحيح على شرط الشيخين. ولم يُخرجاه.
Umm al-Mu'minin Sayyidah Umm Salamah (may Allah be pleased with her) narrates that while the Prophet (peace and blessings be upon him) was in her house, with some of his Companions sitting with him talking, a man came and said: "O Messenger of Allah, how much is the zakah on such-and-such an amount of dates?" The Messenger of Allah (peace and blessings be upon him) said: "Such-and-such." The man said: "So-and-so transgressed against me and took such-and-such from me," that is, he took one sa' more. The Messenger of Allah (peace and blessings be upon him) said: "Then how will it be with you when those who transgress against you even more severely than this come to collect from you?" The people began discussing it and the matter weighed heavily on them, until one of them said: "O Messenger of Allah, if a man is away from you with his camels, livestock and crops, and he pays the zakah of his wealth, but the due is exceeded against him, what should he do while he is absent?" The Messenger of Allah (peace and blessings be upon him) said: "Whoever pays the zakah of his wealth willingly, for the pleasure of Allah and the Home of the Hereafter, and conceals nothing of his wealth, establishes the prayer and pays the zakah, and then (unjustly) his right is transgressed, and he takes up his weapon and fights for the sake of his right and is killed, he is a martyr."
This hadith is sahih on the condition of the two Shaykhs, but they did not record it.

(1) إسناده حسن إن شاء الله من أجل القاسم بن عوف الشيباني. علي بن الحسين: هو ابن علي بن أبي طالب زينُ العابدين.
Grading: Its chain is hasan, in sha' Allah (because of al-Qasim bin Awf al-Shaybani).
Criticism of a narrator: Ali bin al-Husayn is Imam Zayn al-Abidin.
وأخرجه أحمد 44/ (26574)، وابن حبان (3193) من طريقين عن عبيد الله بن عمرو الرقي، بهذا الإسناد. رواية أحمد مختصرة.
Reference / Source: Ahmad (44/ 26574) and Ibn Hibban (3193) narrated it through Ubaydullah bin Amr al-Raqqi.
قال ابن حبان: معنى هذا الخبر: إذا تُعدِّي على المرء في أخذ صدقته، أو ما يشبه هذه الحالة، وكان معه من المسلمين الذين يواطئونه على ذلك، وفيهم كفاية، بعد أن لا يكون قصدهم الدنيا، ولا شيئًا منها، دون إلقاء المرء نفسه إلى التهلكة، إذ المصطفى ﷺ قال لأبي ذر: "اسمع وأطع ولو عبدًا حبشيًا مجدَّعًا"، وقال ﷺ: "من حمل السلاح فليس منا".
General principle: Ibn Hibban says that it means that if someone is wronged in the collection of his zakah, he (may defend himself), provided that his aim is not worldly gain and he does not intend to throw himself into destruction, because the Prophet (peace and blessings be upon him) also commanded obedience to the ruler.
