Mustadrak al-Hakim — Hadith 1485

أخبرنا عبد الله بن الحسين القاضي بمَرْو، حدثنا الحارث بن أبي أسامة، حدثنا يزيد بن هارون، أخبرنا محمد بن إسحاق، عن يزيد بن أبي حَبيب، عن عبد الرحمن بن شُمَاسة، عن عُقْبة بن عامر قال: سمعتُ رسول الله ﷺ يقول: "لا يَدخُلُ صاحبُ مَكْسٍ الجنةَ". قال يزيد بن هارون: يعني العَشَّار (2).
هذا حديث صحيح على شرط مسلم، ولم يُخرجاه.
Sayyiduna Uqbah bin Amir (may Allah be pleased with him) narrates: I heard the Messenger of Allah (peace and blessings be upon him) say: "The one who collects unjust taxes (sahib maks) will not enter Paradise." Yazid bin Harun says: What is meant by it is the unjust 'ashshar (toll collector).
This hadith is sahih on the condition of Muslim, but the two Shaykhs did not record it.

(2) حسن لغيره، وهذا إسناد ضعيف، محمد بن إسحاق مدلس وقد عنعن. ¤ ¤ وأخرجه أحمد 28/ (17354) عن يزيد بن هارون، بهذا الإسناد.
Grading: It is "hasan li-ghayrihi" on the basis of other supporting reports, but this particular chain is weak because Muhammad bin Ishaq is a mudallis and he narrated with "'an".
Reference / Source: Ahmad (28/ 17354) narrated it through Yazid bin Harun.
وأخرجه أحمد (17294)، وأبو داود (2937) من طريق محمد بن سلمة، عن محمد بن إسحاق، به.
Reference / Source: Ahmad (17294) and Abu Dawud (2937) also narrated it through Muhammad bin Salamah, from Muhammad bin Ishaq.
وفي الباب عن رويفع بن ثابت عند أحمد 28/ (17001)، ولفظه مرفوعًا: "إنَّ صاحب المكس في النار"، وإسناده قابل للتحسين.
Corroborating chains and supporting reports: On this topic there is also the narration of Ruwayfi' bin Thabit in Ahmad (28/ 17001), whose wording is: "The one who collects unlawful tax (maks) is in the Fire." Its chain can be considered hasan.
والمَكس: قال ابن الأثير: الضريبة التي يأخذها الماكس، وهو العَشَّار. وقال السندي في حاشيته على "المسند": والعَشَّار: هو الذي يأخذ من المسلمين عُشر أموالهم في الزكاة، ولعلَّ المعنى: لا يستحق الدخول ابتداءً.
Important point: "Al-maks": the unlawful tax that is collected, and the "'ashshar" is the person who (forcibly) takes a tenth of the Muslims' wealth in the name of zakah.
وقال البيهقي في "السنن الكبرى" 7/ 16: المكس: هو النقصان، فإذا كان العامل في الصدقات ينتقص من حقوق المساكين ولا يعطيهم إياها بالتمام، فهو حينئذٍ صاحب مكس يُخاف عليه الإثم والعقوبة، والله أعلم.
Important point: Imam al-Bayhaqi says that "maks" means reducing; that is, if the collector of zakah withholds the right of the poor, he deserves sin and punishment.
